第三十一条 本法规定的行政处罚，由县级以上地方人民政府计量行政部门决定。本法第二十七条规定的行政处罚，也可以由工商行政管理部门决定。 Article 31 The administrative sanction provided for in this Law shall be determined by the metrological administrative department of a people's government at or above the county level.The administrative sanction provided for in Article 27 of this Law may also be determined by the administrative departments for industry and commerce.第三十一条 国家鼓励和扶持对农业的保险事业的发展。 Article 31 The State shall encourage and assist the development of insurance undertakings for agriculture.第三十一条 国家根据经济建设和科学技术进步的需要，统筹规划和指导科学技术研究开发机构的布局，建立现代化的科学技术研究开发体系。 Article 31 The State shall, in accordance with the demands of economic construction and scientific and technological progress, provide an overall planning and guidance for the layout of scientific and technological research and development institutions, and establish a modernized scientific and technological research and development system.第三十一条国务院化学工业主管部门指定的经销单位可经营第二类监控化学品，禁止任何非指定单位经营第二类监控化学品。 ARTICLE 31 Work units designated by the chemical industry authorities under the State Council are authorized to handle sales of Category II MCCs. No other non-designated work units shall be permitted to sell Category II MCC.第三十一条 企业有权依照法律和国务院规定录用、辞退职工。 Article 31. The enterprise shall have the right to employ or dismiss its staff members and workers in accordance with the provisions of the State Council.第三十二条 当事人对行政处罚决定不服的，可以在接到处罚通知之日起十五日内向人民法院起诉；对罚款、没收违法所得的行政处罚决定期满不起诉又不履行的，由作出行政处罚决定的机关申请人民法院强制执行。 Article 32 A party who refuses to accept the decision of the administrative sanction may,within 15 days after receipt of the notification of the decision,file suit in a people's court.If within that time limit the party does not file suit or comply with the penalty of paying a fine and having his unlawful income confiscated,the administrative authorities which have made the decision of the administrative sanction may request the people's court for compulsory execution.第三十二条 任何人发现火灾时，都应当立即报警。 Article 32 Any one who discover a fire shall immediately report to the police.第三十二条申请经营第二类监控化学品的单位，必须具备以下条件： ARTICLE 32 The following are required of work units that apply to sell Category II MCCs:第三十二条 国家对从事基础研究和应用基础研究、高技术研究、重大工程建设项目研究、重大科学技术攻关项目研究、重点社会公益性科学技术研究的研究开发机构和高等院校，在经费、实验手段等方面给予支持。 Article 32 The State shall give support, in such aspects as financial expenses and experimental means, to research and development institutions and institutions of higher learning engaged in basic research and applied basic research, high-tech research, projects for tackling major scientific and technological problems, and research on science and technology for key social and public welfare undertakings.第三十二条 国家实行动植物防疫、检疫制度。任何组织和个人都必须遵守有关动植物防疫、检疫的法律、行政法规。 Article 32 The State shall practise a system of animal and plant epidemic prevention and quarantine. All organizations or individuals must abide by the laws and administrative rules and regulations on animal and plant epidemic prevention and quarantine.第三十二条 有下列情况之一，投标书宣布作废： Article 32. The enterprise shall have the right to decide on its organizational structure and the size of its personnel.第三十三条 中国人民解放军和国防科技工业系统计量工作的监督管理办法，由国务院、中央军事委员会依据本法另行制定。 Article 33 Measures for the administration of and supervision over metrological work in the Chinese People's Liberation Army and in units under the jurisdiction of the Commission on Science,Technology and Industry for National Defence shall be formulated separately by the State Council and the Central Military Commission in accordance with this Law.第三十三条 公安消防机构在统一组织和指挥火灾的现场扑救时，火场总指挥有权根据扑救火灾的需要，决定下列事项： Article 33 Public security fire control institutions, when making unified organization and direction of on site fire fighting and rescue, the chief commander shall have the right to determine the following matters in accordance with the requirements of fire fighting and rescue work:第三十三条 国家鼓励和引导从事技术开发的研究开发机构单独或者与企业事业组织联合开发技术成果，实行技术、工业、贸易或者技术、农业、贸易一体化经营。 Article 33 The State shall encourage and guide research and development institutions engaged in technology development to develop their technological achievements independently or in collaboration with other enterprises and institutions, and carry out an integrated management of technology, industry and trade, or of technology, agriculture and trade.第三十三条取得第二类监控化学品经营权的单位，必须依法经营，产品只能出售给持有国家或省级《禁止化学武器公约》事务主管部门批准购买或使用文件的单位，不得售给未经批准的非经营单位及以出口为目的的非被指定单位。 ARTICLE 33 Work units with the right to sell Category II MCCs shall conduct their sales in accordance with the laws and sell products only to work units whose purchase or use have been approved by the national or provincial CWC affairs authorities. Sales shall not be allowed to unauthorized work units and export-oriented work units not designated.第三十三条 评标组织由建设单位及其上级主管部门（包括由建设单位委托的咨询、监理单位）和建设单位邀请的有关单位组成。 Article 33. The bid evaluation team shall consist of representatives from the construction developer and its superior competent department (including the consulting and supervising agencies entrusted by the developer) and the entities invited by the developer.第三十四条生产第二类、第三类监控化学品的企业不得将其产品销售给以出口为目的的非被指定单位。 ARTICLE 34 Enterprises producing Category II and Category III MCCs shall not sell their products to undesignated export-oriented work units.第三十四条 公安消防队参加火灾以外的其他灾害或者事故的抢险救援工作， 在有关地方人民政府的统一指挥下实施。 Article 34 Public security fire control institutions, when conducting relief and rescue work of other disasters or accidents other than fire disaster, shall carry out the task under unified direction of relevant local people's government.第三十四条 研究开发机构实行院长或者所长负责制。 Article 34 Research and development institutions shall practise a system whereby the president or director takes responsibility.第三十四条 国务院计量行政部门根据本法制定实施细则，报国务院批准施行。 Article 34 The metrological administrative department of the State Council shall,in accordance with this Law,formulate rules for its implementation,which shall go into effect after being submitted to and approved by the State Council.第三十五条 消防车、消防艇前往执行火灾扑救任务或者执行其他灾害、事故的抢险救援任务时，不受行驶速度、行驶路线、行驶方向和指挥信号的限制，其他车辆、船舶以及行人必须让行，不得穿插、超越。 Article 35 Fire trucks and fire boats, when rushing for fire fighting and rescue work or relief and rescue task for other disaster and accidents, shall not be restricted by its driving speed, driving route, driving direction and traffic signals; other vehicles, ships and pedestrians must make way and shall not conduct overtaking.第三十五条经营单位不准收购和销售未经生产特别许可批准的企业生产出的化学品。 ARTICLE 35 Sales work units shall not buy or sell MCC produced by enterprises not approved through the SPL procedures.第三十五条 国家鼓励社会力量自行创办研究开发机构，保障其合法权益不受侵犯。 Article 35 The State shall encourage various social forces to establish research and development institutions on their own and shall protect their legitimate rights and interests against any encroachment.第三十五条 本法自一九八六年七月一日起施行。 Article 35 This Law shall go into effect on July 1,1986.
