第二十二条 国家推进高技术的研究，发挥高技术在科学技术进步中的先导作用；扶持、促进高技术产业的形成和发展，运用高技术改造传统产业，发挥高技术产业在经济建设中的作用。 Article 22 The State shall promote research on high technology and bring into play the leading role of high technology in scientific and technological progress; the State shall foster and promote the formation and development of high-tech industries, and apply high technology to transform traditional industries, and bring into play the role of the high-tech industries in economic construction.第二十二条 违反本办法第七条和第十条第一款规定的，由公安机关责令停止联网，可以并处15000元以下罚款；有违法所得的，没收违法所得。 Article 22 Those who violate Article 7 and Item 1 of Article 10 of these Rules shall be ordered to terminate their networking activities by public security departments and may be imposed a fine less than RMB 15,000. Unlawful incomes, if made, shall be confiscated.第二十二条 产品未经认证或者认证不合格而擅自使用认证标志出厂销售的，由标准化行政主管部门责令停止销售，并处罚款。 Article 22 Whoever uses authentication marks,without authorization,on products leaving a factory for sale,which have not undergone authentication or have been found not up to the standards after the authentication proceedings,shall be ordered by the department of standardization administration to stop the sale and shall concurrently be fined.第二十二条 违反本办法第四条、第七条规定 的，依照有关法律、法规予以处罚。 Article 22.Violation of Article 4 or Article 7 of these regulations shall be punished according to the relevant laws and regulations.第二十三条 当事人对没收产品、没收违法所得和罚款的处罚不服的，可以在接到处罚通知之日起十五日内，向作出处罚决定的机关的上一级机关申请复议；对复议决定不服的，可以在接到复议决定之日起十五日内，向人民法院起诉。当事人也可以在接到处罚通知之日起十五日内，直接向人民法院起诉。 Article 23 A party which refuses to accept the punishment of confiscation of its products and of its unlawful proceeds and a fine may,within 15 days of receiving the penalty notice, apply for reconsideration to the office immediately above the one that made the punishment decision;a party which refuses to obey the reconsideration decision may,within 15 days of receiving the reconsideration decision,bring a suit before a people's court.The party also may,within 15 days of receiving the penalty notice,directly bring a suit before a people's court.第二十三条 各级人民政府应当制定农业综合开发规划，向农业的广度和深度开发，并组织实施。 Article 23 People's governments at various levels shall map out plans for comprehensive development of agriculture to develop agriculture in width and depth and organize the implementation thereof.第二十三条 国家金融机构应当在信贷方面支持科技成果转化，逐步增加用于科技成果转化的贷款。 Article 23 State banking institutions shall support transformation of scientific and technological achievements in matters of loans and gradually increase the amount of loans extended for such transformation.第二十三条 国务院科学技术行政部门和其他有关行政部门，在全国范围内组织科学技术力量实施高技术研究，推广高技术研究成果。 Article 23 The administrative department in charge of science and technology under the State Council and other relevant administrative departments shall organize in the whole nation scientific and technological forces to carry out research on high technology and popularize the achievements thereof.第二十三条 国家逐步提高对农业技术推广的投入。各级人民政府在财政预算内应当保障和于农业技术推广的资金，并应当使该资金逐年增长。 Article 23 The State shall gradually increase its input to agro- technical popularization. People's governments at various levels shall secure the funds to be used for agro-technical popularization in their financial budgets and shall increase such funds year by year.第二十三条 违反《暂行规定》及本办法，同时触犯其他有关法律、行政法规的，依照有关法律、行政法规的规定予以处罚；构成犯罪的，依法追究刑事责任。 Article 23 Those who violate Provisional Regulations, these Rules and other relevant laws and regulations at the same time shall be imposed punishment in accordance with relevant laws and regulations. They shall be prosecuted for criminal liabilities according to the law for any crimes committed.第二十三条 村民委员会、居民委员会应当开展群众性的消防工作，组织制定防火安全公约，进行消防安全检查。 Article 23 Villagers committee and neighborhood committee shall organize the masses to carry out fire control work, formulate fire prevention safety convention and conduct fire control safety inspection.第二十三条 未取得《制造计量器具许可证》、《修理计量器具许可证》制造或者修理计量器具的，责令停止生产、停止营业，没收违法所得，可以并处罚款。 Article 23 Whoever without a Licence for Manufactured Measuring Instruments or a Licence for Repairing Measuring Instruments manufactures or repairs measuring instruments shall be ordered to stop his production or business operations.His unlawful income shall be confiscated and a fine may concurrently be imposed.第二十三条 企业有权要求调整没有必需的计划供应物资或者产品销售安排的指令性计划。 Article 23. The enterprise shall have the right to request for the adjustment of mandatory plans when the needed materials subject to planned allocation are unavailable or when no arrangements are made for product sales.第二十三条 违反本办法第十一条、第十二条规定，不履行备案职责的，由公安机关给予警告或者停机整顿不超过六个月的处罚。 Article 23.Violations of Article 11 or Article 12 of these regulations or not fulfilling the responsibility or registering users shall be punished by a warning from Public Security or suspending network operations for six months.第二十四条 经国务院批准，选择具备条件的地区建立高新技术产业开发区。 Article 24 High and new technology industrial development zones shall be established upon approval by the State Council in selected areas with appropriate conditions.第二十四条 标准化工作的监督、检验、管理人员违法失职、徇私舞弊的，给予行政处分；构成犯罪的，依法追究刑事责任。 Article 24 Personnel responsible for the supervision,inspection and administration of standardization who violate the law or neglect their duties,or are engaged in malpractices for personal gains,shall be given disciplinary sanctions; where crimes are constituted,their criminal responsibility shall be investigated in accordance with the law.第二十四条 公安消防机构应当对机关、团体、企业、事业单位遵守消防法律、法规的情况依法进行监督检查。 Article 24 Public security fire control institutions shall monitor and conduct inspection on state organs, organizations, enterprises and institutions in terms of their observance of fire control laws and regulations.第二十四条 与香港特别行政区和台湾、澳门地区的计算机信息网络的联网，参照本办法执行。 Article 24 These Rules shall also apply to computer networking with Hong Kong Special Administrative Region, Taiwan and Macao.第二十四条 制造、销售未经考核合格的计量器具新产品的，责令停止制造、销售该种新产品，没收违法所得，可以并处罚款。 Article 24 Whoever manufactures or sells a new type of measuring instrument which has not been checked and found to be qualified shall be ordered to stop the manufacture or sale of that new product.His unlawful income shall be confiscated and he may concurrently be punished by a fine.第二十五条 违反本条例规定，构成违反治安管理行为的，依照《中华人民共和国治安管理处罚条例》的有关规定处罚；构成犯罪的，依法追究刑事责任。 ARTICLE 25 Any violation of the Regulations that constitutes a breach of the maintenance of public order shall be subject to penalties outlined in the relevant provisions of the People's Republic of China Penalty Regulations on the Maintenance of Public Order. Any conduct that constitutes a crime shall be investigated for criminal responsibility.第二十五条 乡、村集体经济组织从其举办的企业的以工补农、建农的资金中提取一定数额，用于本乡、本科农业技术推广的投入。 Article 25 Economic collectives of townships or villages shall draw a fixed portion from the funds owned by the enterprises established by them for subsidizing and developing agriculture through development of industry to be used for the input to agro-technical popularization in their own townships or villages.第二十五条 各级人民政府和农业生产经营组织应当制定规划，采取措施，组织农田水利和防护林的建设，保证旱涝保收农田面积的稳定增长。 Article 25 People's governments at various levels and agricultural production and operation organizations shall map out plans and take measures to organize the construction of irrigation and water conservancy works and shelter forests so as to ensure the steady expansion of farmland with stable yields despite of drought or waterlogging.第二十五条 对在高新技术产业开发区和高新技术产业开发区外从事高技术产品开发、生产和企业和研究开发机构，实行国家规定的优惠政策，具体办法由国务院规定。 Article 25 Preferential policies stipulated by the State shall be applied to the enterprises and the research and development institutions engaged in the development and production of high-tech products within and without the high and new technology industrial zones, and the specific measures shall be formulated by the State Council.第二十五条 公安消防机构发现火灾隐患，应当及时通知有关单位或者个人采取措施，限时消除隐患。 Article 25 Public security fire control institutions, when finding out hidden fire danger, shall inform relevant units or individuals in time to take measures and order to remove the hidden danger within a time limit.第二十五条 本法实施条例由国务院制定。 Article 25 Rules for the implementation of this Law shall be formulated by the State Council.
