第三十二条 有下列行为之一的，比照治安管理处罚条例第十九条的规定处罚：? Article 32 Any person who commits any of the following acts shall be punished in the light of the stipulations of Article 19 of the Regulations on Administrative Penalties for Public Security:第三十二条 国家安全机关工作人员玩忽职守、徇私舞弊，构成犯罪的，分别依照刑法第一百八十七条、第一百八十八条的规定处罚； Article 32 Any State security functionary who neglects his duty or engages in malpractices for personal interests, if the offence constitutes a crime, shall be punished in accordance with the provisions of Article 187 or Article 188 of the Criminal Law;第三十二条 人民防空主管部门建设通信、警报网所需的电路、频率，邮电部门、军队通信部门、无线电管理机构应当予以保障；安装人民防空通信、警报设施，有关单位或者个人应当提供方便条件，不得阻挠。 Article 32 Post and telecommunications departments, military communications departments and radio administration authorities shall guarantee provision of the circuits and frequency required by the competent departments for civil air defense in establishing communications and warning networks, the relevant units and individuals shall provide convenience for installation of facilities of civil air defense communications and warning, and may not obstruct it.第三十二条本法自公布之日起施行。 Article 32 This Law shall be effective as of the date of its promulgation.第三十二条 阻挠测绘人员依法进行测绘的，损毁、擅自移动永久性测量标志或者进行其他危害永久性测量标志安全和使用效能活动的，依照治安管理处罚条例的规定予以处罚。 Article 32 Those who obstruct surveying and mapping personnel from carrying out surveying and mapping according to law, who damage, destroy, or remove without authorization permanent surveying markers, or who engage in other activities that endanger the safety and effective utilization of permanent surveying markers, shall be punished in accordance with the provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security. 第三十二条 学员学完规定的科目，考试不合格的，由院校发给结业证书，回入学前户口所在地，由县、自治县、市、市辖区的人民政府按照国家同等院校结业生的安置办法安置。 Article 32. Cadets who have completed the required courses but have failed in the examinations shall be given a certificate of their completion of the courses by the institutes or academies and return to their places of residence before they enrolled in such military institutes or academies, and shall be placed by the people's governments of their respective counties, autonomous counties, cities or municipal districts according to state regulations on the placement for those who have completed their studies at other colleges and schools of similar status.第三十二条 为境外的机构、组织、人员窃取、刺探、收买、非法提供国家秘密的，依法追究刑事责任。 Article 32. Persons who steal, spy on, buy or illegally provide state secrets for institutions, organizations and people outside the country shall be investigated for criminal responsibility in accordance with law.第三十三条 公安机关依照本法第二条第二款的规定，执行国家安全工作任务时，适用本法有关规定。 Article 33 Any public security organ that carries out an assignment of State security according to the provisions of Paragraph 2, Article 2 of this Law shall be governed by the relevant provisions of this Law.第三十三条 扰乱军事禁区、军事管理区的管理秩序，情节严重的，对首要分子和直接责任人员比照刑法第一百五十八条的规定追究刑事责任；情节轻微，尚不够刑事处罚的，比照治安管理处罚条例第十九条的规定处罚。? Article 33 In cases of disturbance of the administrative order in the military restricted zones and the military administrative zones, the principal culprits and persons held directly responsible shall, when the case is serious, be investigated for criminal responsibility in the light of the stipulations of Article 158 of the Criminal Law, or when the case is not so serious as to be considered as a penal offence, be punished in the light of the stipulations of Article 19 of the Regulations on Administrative Penalties for Public Security.第三十三条 通信、广播、电视系统，战时必须优先传递、发放防空警报信号。 Article 33 In time of war, the communications, broadcasting and television systems must give first priority to the transmission and sending out of air defense warning signals.第三十三条 军事测绘管理办法由中央军事委员会根据本法制定。 Article 33 Measures for the management of military surveying and mapping shall be drawn up by the Central Military Commission in accordance with this Law. 第三十三条 学员因患慢性疾病或者其他原因不宜在军事院校继续学习 ， 经批准退学的，由院校发给肄业证书，由入学前户口所在地的县、自治县、市、市辖区的人民政府接收安置。 Article 33. Cadets who suffer from chronic diseases or are otherwise unfit for continuing their studies at military institutes or academies and who thus leave school upon approval shall be given a certificate by the institutes or academies of the amount of academic work they have done and shall be accepted for placement by the people's governments of the counties, autonomous counties, cities or municipal districts at their places of residence before they enrolled in such institutes or academies.第三十三条 国家保密工作部门根据本法制定实施办法，报国务院批准后施行 。 Article 33. The state secret-guarding department shall, in accordance with this Law, formulate measures for its implementation, which shall come into force after being submitted to and approved by the State Council.第三十四条 在军事禁区非法进行摄影、摄像、录音、勘察、测量、描绘和记述，不听制止的，比照治安管理处罚条例第十九条的规定处罚或者没收所使用的器材、工具；情节严重的，比照刑法第一百五十八条的规定追究刑事责任。? Article 34 Persons who engage in illegal photographing, video-taping, recording, reconnoitering, surveying, drawing or describing in the military restricted zones and refuse to be stopped shall either be punished in the light of the stipulations of Article 19 of the Regulations on Administrative Penalties for Public Security or have their equipment and instrument confiscated. When the case is serious, they shall be investigated for criminal responsibility in the light of the stipulations of Article 158 of the Criminal Law.第三十四条 军队有关部门应当向人民防空主管部门通报空中情报，协助训练有关专业人员。 Article 34 The relevant military departments shall communicate air intelligence to the competent departments for civil air defense and assist the latter in training special personnel in this field.第三十四条 本法自公布之日起施行。 Article 34 This Law shall enter into force as of the date of promulgation.第三十四条 本法自1993年7月1日起施行。 Article 34 This Law shall go into effect as of July 1, 1993. 第三十四条 学员被开除学籍的，由入学前户口所在地的县、自治县、市、市辖区的人民政府接收，按照国家同等院校开除学籍学生的处理办法办理。 Article 34. Cadets dismissed from school shall be accepted by the people's governments of the counties, autonomous counties, cities or municipal districts at their places of residence before enrollment, which shall treat them according to the state regulations on the treatment of students dismissed from other colleges and schools of similar status.第三十四条 中央军事委员会根据本法制定中国人民解放军保密条例。 Article 34. The Central Military Commission shall, in accordance with this Law, formulate the Regulations of the Chinese People's Liberation Army on the Guarding of Secrets.第三十五条 人民防空通信、警报设施必须保持良好使用状态。 Article 35 All facilities for civil air defense communications and warning must be kept in good repair.第三十五条 现役军人、军内在编职工有下列行为之一的，依照惩治军人违反职责罪暂行条例的有关规定追究刑事责任；情节轻微，尚不够刑事处罚的，给予军纪处分：? Article 35 Servicemen and permanent workers and staff of the armed forces who commit any of the following acts shall be investigated for criminal responsibility in accordance with the relevant stipulations of the Interim Regulations on Punishment for Offences in Violation of Duties by Military Personnel; if the case is not so serious as to be considered a penal offence, they shall be subjected to military disciplinary sanctions: 第三十五条 本法第三十一条、第三十二条、第三十三第、第三十四条的规定，也适用于从现役士兵中招收的学员。 Article 35. The provisions of Articles 31, 32, 33 and 34 of this Law shall also apply to cadets enrolled from among soldiers in active service.第三十五条 本法自１９８９年５月１日起施行。１９５１年６月公布的《保守国家机密暂行条例》同时废止。 Article 35. This Law shall come into force as of May 1, 1989. The Provisional Regulations on Guarding State Secrets promulgated in June 1951 shall be annulled as of the same date.第三十六条 人民防空通信、警报设施平时应当为抢险救灾服务。 Article 36 In time of peace, all facilities for civil air defense communications and warning shall be used in cases of emergency and disaster.第三十六条 国务院和中央军事委员会根据本法制定实施办法。? Article 36 Measures for implementation shall be formulated in accordance with this Law by the State Council and the Central Military Commission.
