The Chinese government protects by law the legitimate income and other lawful rights and interests of the Chinese and foreign parties to the undertaking of salvaging sunken ships and sunken articles in China's coastal waters (hereinafter referred to as Sino-foreign salvage parties).

- 第四条 船舶和船上有关航行安全的重要设备必须具有船舶检验部门签发的有效技术证书。 Article 4. Vessels and their major equipment relating to navigation safety must have valid technical certificates issued by vessel inspection departments.
- 第四条 外国运输企业在中国设立常驻代表机构的申请经中华人民共和国交通部批准后，发给《外国运输企业在中国设立常驻代表机构批准书》。 Article 4. When the application is ratified by MCT, ""the Document of Ratification for Establishment of Permanent Representative Office of Foreign Transport Enterprises in China"" will be issued.
- 第四十条买受人接收船舶后，应当持拍卖成交确认书和有关材料，向船舶登记机关办理船舶所有权登记手续。 Article 40 After accepting the ship, the vendee shall undergo formalities for registration of the ship's ownership at the ship registration authorities on the basis of the letter of confirmation for conclusion of auction and relevant data.

- 第四十条铁路与道路交叉处，应当优先考虑设置立体交叉；未设立体交叉的，可以根据国家有关规定设置平交道口或者人行过道。在城市规划区内设置平交道口或者人行过道，由铁路运输企业或者建有专用铁路、铁路专用线的企业或者其他单位和城市规划主管部门共同决定。 Article 40 At the crossing point of a railway and a highway, priority shall be given to the installation of a grade separation structure; at a crossing where a grade separation structure is not installed, a level crossing or a pedestrian cross-walk may be laid in conformity with relevant provisions of the State. The setting up of a level crossing or a pedestrian cross-walk within a planned urban area shall be decided by the railway transport enterprise, or the relevant enterprise owning the relating industrial railways or private sidings, or any other relevant unit jointly with the department in charge of city planning.
- 第四十条船长在航行中死亡或者因故不能执行职务时，应当由驾驶员中职务最高的人代理船长职务； Article 40 Should death occur to the Master or the Master be unable to perform his duties for whatever reason, the deck officer with the highest rank shall act as the Master;

- 第四十条因严重自然灾害致使国道、省道交通中断，公路管理机构应当及时修复；公路管理机构难以及时修复时，县级以上地方人民政府应当及时组织当地机关、团体、企业事业单位、城乡居民进行抢修，并可以请求当地驻军支援，尽快恢复交通。 Article 40 When break of State highways and provincial roads due to serious natural disasters, related highway administrative departments should give timely repair. Should there be any difficulties for the related highway administration to undertake repair in time, local people's governments above the county level should lose not time to organize local government institutions, people's organizations, enterprises and urban and rural residents for rush repairs. They may also ask for assistance from local army so as to restore the operation of the roads as soon as possible.
- 第四十条 违反本法第八条规定，经营信件和其他具有信件性质的物品的寄递业务的，由工商行政管理部门责令其将收寄的信件和其他具有信件性质的物品及收取的资费退还寄件人，处以罚款。 Article 40. Persons who, in violation of provisions of Article 8 of this Law, handle the business of posting and delivering mail or articles with characteristics of mail shall be ordered by industrial and commercial administrative authorities to return the mail and other articles and the postal fees they have obtained from the senders, and a fine shall be imposed on them.
- 第四十条 对影响安全航行、航道整治以及有潜在爆炸危险的沉没物、漂浮物，其所有人、经营人应当在主管机关限定的时间内打捞清除。否则，主管机关有权采取措施强制打捞清除，其全部费用由沉没物、漂浮物的所有人、经营人承担。 * Article 40. With respect to sunken or drifting objects that may affect the safety of navigation and the management of navigation lanes, as well as those constituting a threat of explosion, the owners or managers thereof shall salvage and remove such objects within a deadline set by the competent authority. Otherwise, the competent authority shall have the right to take measures to compel the salvage and removal of the objects, and their owners or managers shall bear all the expenses incurred thereby.
- 第四十一条海上货物运输合同，是指承运人收取运费，负责将托运人托运的货物经海路由一港运至另一港的合同。 Article 41 A contract of carriage of goods by sea is a contract under which the carrier, against payment of freight, undertakes to carry by sea the goods contracted for shipment by the shipper from one port to another.
- 第四十一条修建跨越河流的铁路桥梁，应当符合国家规定的防洪、通航和水流的要求。 Article 41 Any railway bridge to be built across a water course shall conform to the requirements for flood prevention, navigation and flow of current as laid down by the State in relevant regulations.
- 第四十一条空勤人员在执行飞行任务时，应当随身携带执照和体格检查合格证书，并接受国务院民用航空主管部门的查验。 Article 41 Flight personnel shall, in performing flight missions, carry on their persons licences and physical examination certificates and be subject to the check of the competent civil aviation authority under the State Council.
- 第四十一条公路用地范围内的山坡、荒地，由公路管理机构负责水土保持。 Article 41 Highway administrative departments are responsible for soil and water preservation on hillslopes and wasteland at two sides of highways.
- 第四十一条竞买人之间恶意串通的，拍卖无效。 Article 41 Malicious collusion between bidders makes the auction invalid.
