- 第三十六条国家采用依法征税的办法筹集公路养护资金，具体实施办法和步骤由国务院规定。 Article 36 Expenses for highway maintenance should be acquired through collection of fuel oil surcharge paid by units and individuals in purchase of fuel oil according to the relevant provisions by the State. In cases where fuel oil surcharge is collected, no more road maintenance fees shall be collected. Specific procedures and steps shall be set by the State Council for the purpose.
- 第三十六条当事人对公路主管部门给予的处罚不服的，可以向上级公路主管部门提出申诉； Article 36 If the party or parties concerned refuse to accept the penalty imposed by the highway department, they may appeal to the higher authorities.

A type validation certificate shall be issued if found qualified through examination.
- 第三十六条 当事人因客观原因不能自行收集的证据，可申请仲裁庭调查收集，是否准许，由仲裁庭决定。仲裁庭认为必要时,也可以自行调查事实,收集证据。 Article 36 Where the parties are unable to collect evidence by themselves for objective reasons, they can apply to the arbitration tribunal for evidence investigation and collection, and the arbitration tribunal shall decide whether so permits. The arbitration tribunal may undertake investigations and collect evidences on its own initiative if necessary.

Persons who infringe upon the citizens' right to freedom of correspondence by concealing, destroying, discarding or illegally opening mail of another person, where circumstances are serious, shall be investigated for criminal liability according to the provisions of Article 149 of the Criminal Law of the People's Republic of China, and those whose acts are not serious enough for criminal punishment shall be punished according to the provisions of Article 22 of Regulations of the People's Republic of China on Administrative Penalties for Public Security.

- 第三十六条 事故现场附近的船舶，设施，收到求救信号或发现有人遭遇生命危险时，在不严重危及自身安全的情况下，应当尽力救助遇难人员，并迅速向主管机关报告现场情况和本船舶、设施的名称、呼号和位置。 Article 36. When vessels or installations in the vicinity of the scene of an accident receive a distress signal or discover that people's lives are endangered, they shall do their best to rescue the people in distress insofar as their own safety is not seriously endangered, and promptly report to the competent authority the situation at the scene, their own names, call numbers and positions.
- 第三十六条 中华人民共和国香港特别行政区、澳门特别行政区和台湾地区与外国之间的定期飞行，按相关法律和程序办理。 Article 36 Regular flight between HK, Macao, Taiwan and foreign countries will be handled according to related law and procedure.

- 第三十七条已经取得使用权的铁路建设用地，应当依照批准的用途使用，不得擅自改作他用；其他单位或者个人不得侵占。 Article 37 Any railway transport enterprise shall, having acquired the right to use any land for railway construction, use the land for the approved purpose and shall not use the land for any other purposes without proper authorization; no other unit or individual may occupy or seize the said land.
- 第三十七条公路管理人员违反本条例的，由公路主管部门给予行政处分或经济处罚。 Article 37 For highway administrative personnel who violate these regulations, the highway department concerned may take disciplinary or economic sanctions against them.
- 第三十七条县、乡级人民政府对公路养护需要的挖砂、采石、取土以及取水，应当给予支持和协助。 Article 37 People's governments at the county and township levels should give support and assistance in fetch of sand, stone, earth or water for road maintenance.
- 第三十七条船长应当将船上发生的出生或者死亡事件记入航海日志，并在两名证人的参加下制作证明书。 Article 37 The Master shall make entries in the log book of any occurrence of birth or death on board and shall issue a certificate to that effect in the presence of two witnesses.
- 第三十七条买受人在签署拍卖成交确认书后，应当立即交付不低于百分之二十的船舶价款，其余价款在成交之日起七日内付清，但拍卖船舶委员会与买受人另有约定的除外。 Article 37 The vendee shall pay without delay not less than 20 percent of the ship's price after he signs a letter of confirmation, and the remainder of the ship's price shall be settled within seven days of the date of concluding the auction, however, except otherwise agreed upon between the ship auction committee and the vendee.

- 第三十七条 邮政工作人员私自开拆或者隐匿、毁弃邮件的，依照《中华人民共和国刑法》第一百九十一条第一款的规定追究刑事责任。 Article 37. Postal personnel who without permission open or conceal, destroy or discard postal materials shall be investigated for criminal liability in accordance with Paragraph 1 in Article 191 of the Criminal Law of the People's Republic of China.
- 第三十七条 本条例自发布之日起施行。 Article 37. These Regulations shall go into effect as of the date of promulgation.
- 第三十七条 发生碰撞事故的船舶、设施，应当互通名称、国籍和登记港，并尽一切可能救助遇难人员。在不严重危及自身安全的情况下，当事船舶不得擅自离开事故现场。 Article 37. Vessels or installations involved in a collision shall exchange their names, nationalities and ports of registry and do their best to rescue personnel in distress. The vessels involved may not leave the scene of the accident without authorization, insofar as their own safety is not seriously endangered.
- 第三十七条 本规定自发布之日起三十日后施行。1996年3月2日发布的《外国航空公司经营许可的申请程序（暂行）》（民航运函〔1996〕243号）同时废止。 Article 37 The Regulations will be executed 30 days after issuance. The issued Application Procedure for Business License of Foreign Airline Enterprise (Interim) (Civil Aviation Transport Letter [1996] No. 243), which was promulgated on March 2, 1996, is therefore repealed.
- 第三十八条买受人付清全部价款后，原船舶所有人应当在指定的期限内于船舶停泊地以船舶现状向买受人移交船舶。 Article 38 Once the vendee has settled the price in full, the original shipowner shall delivery the ship to the vendee on the basis of the current condition of the ship, at the place of berth of the ship, within a fixed time limit.
- 第三十八条县、乡级人民政府应当在农村义务工的范围内，按照国家有关规定组织公路两侧的农村居民履行为公路建设和养护提供劳务的义务。 Article 38 People's governments at the county and township levels should organise free services of rural residents on both sides of roads for highway construction and maintenance according to the related regulations of the State.
