- 第二十四条 当事人申请设立海事赔偿责任限制基金的，仲裁委员会应当将当事人的申请提交事故发生地、合同履行地或者船舶扣押地海事法院；当事人在仲裁程序开始前申请设立海事赔偿责任限制基金的，应当依照《中华人民共和国海事诉讼特别程序法》的规定，直接向事故发生地、合同履行地或者船舶扣押地海事法院提出。 Article 24 When a party applies for the constitution of a limitation fund for maritime claims, the Arbitration Commission shall submit the party's application to the maritime court at the place of the accident, the place of performance of the contract or the place of ship arrest. Where a party applies for constitution of a limitation fund for maritime claims before the commencement of the arbitration proceedings, he shall, according to the provisions of ""Maritime Procedure Law of the People's Republic of China"", submit his application directly to the maritime court at the place of the accident, the place of performance of the contract or the place of ship arrest.
- 第二十四条 调解达成协议的，当事人各方应当自动履行。达成协议后当事人翻悔的或逾期不履行协议的，视为调解不成。 Article 24. All the parties concerned shall execute the agreement of mediation of their own accord. If the parties renegue or fail to execute the agreements within the time limit after the agreement is reached, the mediation shall be regarded as failing.
- 第二十四条 邮政汇款的收款人应当自收到汇款通知之日起两个月内凭有效证明到邮政企业或者其分支机构兑领汇款；逾期未领的汇款，由邮政企业或者其分支机构退回汇款人。 Article 24. The remittees of postal remittances shall cash the postal remittances with valid documents at postal enterprises or branch offices within two months after receiving the notice of postal remittances. Remittances unclaimed when such time period expires shall be returned to the remitters by postal enterprises or branch offices.

- 第二百四十一条保险金额低于共同海损分摊价值的，保险人按照保险金额同分摊价值的比例赔偿共同海损分摊。 Article 241 Where the insured amount is lower than the value for contribution under the general average, the insurer shall be liable for the general average contribution in the proportion that the insured amount bears to the value for contribution.
- 第二百四十二条对于被保险人故意造成的损失，保险人不负赔偿责任。 Article 242 The insurer shall not be liable for the loss caused by the intentional act of the insured.

- 第二百四十五条保险标的发生保险事故后灭失，或者受到严重损坏完全失去原有形体、效用，或者不能再归被保险人所拥有的，为实际全损。 Article 245 Where after the occurrence of a peril insured against the subject matter insured is lost or is so seriously damaged that it is completely deprived of its original structure and usage or the insured is deprived of the possession thereof, it shall constitute an actual total loss.
- 第二百四十六条船舶发生保险事故后，认为实际全损已经不可避免，或者为避免发生实际全损所需支付的费用超过保险价值的，为推定全损。 Article 246 Where a ship's total loss is considered to be unavoidable after the occurrence of a peril insured against or the expenses necessary for avoiding the occurrence of an actual total loss would exceed the insured value, it shall constitute a constructive total loss.
- 第二百四十七条不属于实际全损和推定全损的损失，为部分损失。 Article 247 Any loss other than an actual total loss or a constructive total loss is a partial loss.
- 第二百四十八条船舶在合理时间内未从被获知最后消息的地点抵达目的地，除合同另有约定外，满两个月后仍没有获知其消息的，为船舶失踪。船舶失视为实际全损。 Article 248 Where a ship fails to arrive at its destination within a reasonable time from the place where it was last heard of, unless the contract provides otherwise, if it remains unheard of upon the expiry of two months, it shall constitute missing. Such missing shall be deemed to be an actual total loss.
- 第二百四十九条保险标的发生推定全损，被保险人要求保险人按照全部损失赔偿的，应当向保险人委付保险标的。 Article 249 Where the subject matter insured has become a constructive total loss and the insured demands indemnification from the insurer on the basis of a total loss, the subject matter insured shall be abandoned to the insurer.
- 第二十四条 外航在每个航季的航班经营过程中，不得随意更改航班计划。因商业原因需要更改航班计划的，外航应当在拟更改日三十日前向民航局提出申请，获得批准后方可执行。?? Article 24 A foreign airline should not change flight schedule without permission during business operation in each season. If the foreign airline needs to alter flight schedule due to commercial reason, it shall submit application to Civil Aviation Administration 30 days ahead of planned alteration and only implement it after being approved.??
- 第二十五条民用航空器优先权自援救或者保管维护工作终了之日起满三个月时终止；但是，债权人就其债权已经依照本法第二十条规定登记，并具有下列情形之一的除外： Article 25 A civil aircraft lien shall be terminated at the expiry of three months commencing from the date of the end of rescue or custody; except that the creditor has registered his obligatory rights according to the provisions of Article 20 of this Law and that the case is under one of the following circumstances:

The items and rates of miscellaneous charges for passenger and goods transport on State railways shall be laid down by the competent department in charge of railways under the State Council. Tariffs applicable to specified operating lines, specified goods and provisional operating lines of the State railways shall be worked out by the competent department in charge of railways under the State Council by agreement with the competent department in charge of prices under the State Council.
- 第二十五条航空器内禁止下列行为： Article 25 The following acts are prohibited in an aircraft:
- 第二十五条 进出保税区的运输工具应由其负责人、所有人或者他们的代理人持上海市人民政府或者其指定的主管部门批准的证件办理登记备案手续。 Article 25 The persons in charge or the owners of the means of transport entering or leaving the bonded area, or their agents, shall present the certification, approved by the Shanghai People's Government or the competent organs designated by it, for going through the procedures of registration for the record.
- 第二十五条 仲裁委员会及其分会适用统一的仲裁员名册。 Article 25 The same Panel of Arbitrators shall be used in Arbitration Commission and the Sub-Commission.
- 第二十五条公路建设项目的施工，须按国务院交通主管部门的规定报请县级以上地方人民政府交通主管部门批准。 Article 25 Undertakings of highway construction should be reported to the transportation departments of local people's governments above the county level for approval in accordance with the provisions of transportation department under the State Council.
- 第二十五条 凡向港务监督申请调解的民事纠纷，当事人中途不愿意调解的，应当向港务监督递交撤销调解的书面申请，并通知对方当事人。 Article 25. If a party to a civil dispute who has applied to the harbour superintendency administration for mediation wants to withdraw from it, the party shall send a written application to the harbour superintendency administration for mediation cancellation and notify the other party to the dispute at the same time.
