- 第二十一条 前条民事纠纷，凡已向海事法院起诉或申请海事仲裁机构仲裁的，当事人不得再申请港务监督调解。 Article 21. If s suit has been brought before a maritime court or an application sent to a maritime arbitration organ, the parties to the civil disputes mentioned in the preceding article shall not apply to the harbour superintendency administration for mediation.
- 第二十一条香港、澳门、台湾的企业、个人及其他经济组织参与打捞中国沿海水域的沉船沉物，参照本办法执行。 Article 21. Participation of enterprises, other economic organizations or individuals from Hong Kong, Macao and Taiwan in the salvage of sunken ships and sunken articles in China's coastal waters can proceed with reference to these Procedures.

- 第二百一十条违反本法第六十二条的规定，未取得机场使用许可证开放使用民用机场的，由国务院民用航空主管部门责令停止开放使用；没收违法所得，可以并处违法所得一倍以下的罚款。 Article 210 Where a civil airport is opened to traffic without obtaining an airport operating licence in violation of the provisions of Article 62 of this Law, the competent civil aviation authority under the State Council shall order it to stop its opening to traffic, confiscate its unlawful earnings, and may impose a fine of not exceeding 100% of the unlawful earnings.

- 第二百一十一条公共航空运输企业、通用航空企业违反本法规定，情节较重的，除依照本法规定处罚外，国务院民用航空主管部门可以吊销其经营许可证。对被吊销经营许可证的，工商行政管理部门应吊销其营业执照。 Article 211 Where a public air transport enterprise or a general aviation enterprise violates the provisions of this Law, in circumstances of a serious nature, the competent civil aviation authority under the State Council may, in addition to the punishment prescribed by this Law, cancel its operating licence. If the operating licence of such enterprise is cancelled, the administrative department for industry and commerce shall cancel its business licence.
- 第二百一十二条本法第二百一十条和第二百一十一条规定的赔偿限额，适用于特定场合发生的事故引起的，向船舶所有人、救助人本人和他们对其行为过失负有责任的人员提出的请求的总额。 Article 212 The limitation of liability under Articles 210 and 211 of this Code shall apply to the aggregate of all claims that may arise on any given occasion against shipowners and salvors themselves, and any person for whose act, neglect or fault the shipowners and the salvors are responsible.
- 第二百一十二条国务院民用航空主管部门和地区民用航空管理机构的工作人员，玩忽职守、滥用职权、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。 Article 212 The working personnel of the competent civil aviation authority under the State Council and of regional civil aviation administrative organs, who neglect their duties, abuse their powers, practise favouritism and embezzlement, if the case constitutes a crime, shall be investigated for criminal responsibilities according to law; if the case does not constitute a crime, they shall be subject to administrative sanctions according to law.
- 第二百一十三条本法所称计算单位，是指国际货币基金组织规定的特别提款权；其人民币数额为法院判决之日、仲裁机构裁决之日或者当事人协议之日，按照国家外汇主管机关规定的国际货币基金组织的特别提款权对人民币的换算办法计算得出的人民币数额。 Article 213 Unit of account mentioned in this Law refers to the Special Drawing Right as defined by the International Monetary Fund; its equivalent in Renminbi shall be the amount calculated in terms of the conversion rate from the Special Drawing Right of the International Monetary Fund to Renminbi as prescribed by the competent State foreign exchange authority at the date of the judgement of the court, the date of the award of arbitration agency or the date agreed between the parties concerned.
- 第二百一十三条责任人要求依照本法规定限制赔偿责任的，可以在有管辖权的法院设立责任限制基金。 Article 213 Any person liable claiming the limitation of liability under this Code may constitute a limitation fund with a court having jurisdiction.

- 第二百一十九条保险标的的保险价值由保险人与被保险人约定。 Article 219 The insurable value of the subject matter insured shall be agreed upon between the insurer and the insured.
- 第二十二条民用航空器优先权先于民用航空器抵押权受偿。 Article 22 A civil aircraft lien shall have priority over the mortgage of a civil aircraft.
- 第二十二条自铁路运输企业发出领取货物通知之日起满三十日仍无人领取的货物，或者收货人书面通知铁路运输企业拒绝领取的货物，铁路运输企业应当通知托运人，托运人自接到通知之日起满三十日未作答复的，由铁路运输企业变卖；所得价款在扣除保管等费用后尚有余款的，应当退还托运人，无法退还、自变卖之日起一百八十日内托运人又未领回的，上缴国库。 Article 22 Any shipped goods that are not claimed for thirty days as of the date of issuing the notice of claim for the shipped goods, or that the consignee has informed the railway transport enterprise in writing of refusing to accept shall be sold off by the railway transport enterprise on condition that the enterprise has served the shipper a notice about such and received no acknowledgement for thirty days as of the date of receipt of the notice. The amount of money obtained from the selling, if there is any left after deduction of storage charges and other deductible fees, shall be refunded to the shipper, or turned over to the state treasury provided it is not refundable nor claimed by the shipper within one hundred and eighty days as of the date of disposal.
