- 第二十二条下列各项海事情求具有船舶优先权： Article 22 The following maritime claims shall be entitled to maritime liens:
- 第二十二条航空器在飞行中的安全保卫工作由机长统一负责。 Article 22 The work of security of an aircraft in flight shall be the unified responsibility of the pilot-in-command.
- 第二十二条 从中国境外运入保税区的转口货物应存入保税区内海关指定的仓库、场所。 Article 22 Transit goods imported from abroad into the bonded area shall be stored in warehouses and sites, designated by the Customs, in the bonded area.
- 第二十二条 邮政企业及其分支机构应当按照国务院邮政主管部门规定的时限投交邮件。 Article 22. Postal enterprises and their branch offices shall deliver postal materials within the time limits laid down by the competent department of postal services under the State Council.
- 第二十二条本办法由中华人民共和国交通部负责解释。 Article 22. The Ministry of Communications is responsible for explanations of these Procedures.
- 第二十二条 未经主管机关批准，不得在港区、锚地、航道、通航密集区以及主管机关公布的航路内设置、构筑设施或者进行其他有碍航行安全的活动。 Article 22. Without the approval of the competent authority, no installations may be established or constructed, nor may any activities that hinder navigational safety be carried out in harbour areas, anchorages, navigation lanes, or crowded navigable areas, as well as in navigation routes announced by the competent authority.
- 第二十二条 调解由当事人各方在事故发生之日起三十日内向负责该事故调查的港务监督提交书面申请。港务监督要求提供担保的，当事人应附经济赔偿担保证明文件。 Article 22. Written applications for mediations shall be submitted, by the parties within 30 days after the accident happened, to the harbour superintendency administration responsible for the investigation of the accident. If guarantees are demanded by the harbour superintendency administration the parties shall provide papers of economic compensation guarantee.
- 第二百二十条保险金额由保险人与被保险人约定。 Article 220 The insured amount shall be agreed upon between the insurer and the insured.
- 第二百二十一条被保险人提出保险要求，经保险人同意承保，并就海上保险合同的条款达成协议后，合同成立。 Article 221 A contract of marine insurance comes into being after the insured puts forth a proposal for insurance and the insurer agrees to accept the proposal and the insurer and the insured agree on the terms and conditions of the insurance.
- 第二百二十二条合同订立前，被保险人应当将其知道的或者在通常业务中应当知道的有关影响保险人据以确定保险费率或者确定是否同意承保的重要情，如实告知保险人。 Article 222 Before the contract is concluded, the insured shall truthfully inform the insurer of the material circumstances which the insured has knowledge of or ought to have knowledge of in his ordinary business practice and which may have a bearing on the insurer in deciding the premium or whether be agrees to insure or not.
- 第二百二十三条由于被保险人的故意，未将本法第二百二十二条第一款规定的重要情况如实告知保险人的，保险人有权解除合同，并不退还保险费。 Article 223 Upon failure of the insured to truthfully inform the insurer of the material circumstances set forth in paragraph 1 of Article 222 of this Code due to his intentional act, the insurer has the right to terminate the contract without refunding the premium.
- 第二百二十四条订立合同时，被保险人已经知道或者应当知道保险标的已经因发生保险事故而遭受损失的，保险人不负赔偿责任。 Article 224 Where the insured was aware or ought to be aware that the subject matter insured had suffered a loss due to the incidence of a peril insured against when the contract was concluded, the insurer shall not be liable for indemnification but shall have the right to the premium.
- 第二百二十五条被保险人对同一保险标的就同一保险事故向几个保险人重复订立合同，而使该保险标的的保险金额总和超过保险标的的价值的，除合同有约定外，被保险人可以向任何保险人提出赔偿请求。被保险人获得的赔偿金额总和不得超过保险标的的受损价值。 Article 225 Where the insured concludes contracts with several insurers for the same subject matter insured and against the same risk, and the insured amount of the said subject matter insured thereby exceeds the insured value, then, unless otherwise agreed in the contract, the insured may demand indemnification from any of the insurers and the aggregate amount to be indemnified shall not exceed the loss value of the subject matter insured.
- 第二百二十六条保险责任开始前，被保险人可以要求解除合同，但是应当向保险人支付手续费，保险人应当退还保险费。 Article 226 Prior to the commencement of the insurance liability, the insured may demand the termination of the insurance contract but shall pay the handling fees to the insurer, and the insurer shall refund the premium.
- 第二百二十七条除合同另有约定外，保险责任开始后，被保险人和保险人均不得解除合同。 Article 227 Unless otherwise agreed in the contract, neither the insurer nor the insured may terminate the contract after the commencement of the insurance liability.
- 第二百二十八条虽有本法第二百二十七条规定，货物运输和船舶的航次保险，保险责任开始后，被保险人不得要求解除合同。 Article 228 Notwithstanding the stipulations in Article 227 of this Code, the insured may not demand termination of the contract for cargo insurance and voyage insurance on ship after the commencement of the insurance liability.
- 第二百二十九条海上货物运输保险合同可以由被保险人背书或者以其他方式转让，合同的权利、义务随之转移。 Article 229 A contract of marine insurance for the carriage of goods by sea may be assigned by the insured by endorsement or otherwise, and the rights and obligations under the contract are assigned accordingly.
- 第二十二条 外航依照民航局颁发的经营许可经营航线的过程中，应当按照夏秋和冬春两个航季申请航班计划，并在每个航季开始前六十日按规定的格式及内容向民航局提出。民航局根据本规定对航班计划进行审核后，做出批准或者不批准的决定。外航未按规定时限提出航班计划申请的，按照停航处理。 Article 22 During business operation within business license issued by Civil Aviation Administration, the foreign airline shall apply for separate flight schedules for summer and autumn season, and winter and spring season respectively. The application should be submitted to Civil Aviation Administration 60 days ahead of beginning of each season with the right format and content. Civil Aviation Administration shall make decision for approval or not after auditing flight schedule according to the Regulations. If the foreign airline fails to submit application for flight schedule within prescribed time limit, it’ll be asked to cease flight.
- 第二十三条公路主管部门负责管理和保护公路、公路用地及公路设施，有权依法检查、制止、处理各种侵占、破坏公路、公路用地及公路设施的行为。 Article 23 Departments in charge of highways are responsible for the management and protection of highways, land set aside for the exclusive use by highways and highway facilities, and have the authority to investigate, stop and deal with all activities that encroach upon or destroy highways, land for exclusive use by highways and highway facilities.
- 第二十三条有下列情形之一的，海事法院可以扣押当事船舶： Article 23 If any of the following circumstances exists, a maritime court may arrest the involved ship:
- 第二十三条因旅客、托运人或者收货人的责任给铁路运输企业造成财产损失的，由旅客、托运人或者收货人承担赔偿责任。 Article 23 Passengers, shippers or consignees who are held responsible for any loss of property of a railway transport enterprise shall be liable to compensation for the loss.
- 第二十三条公路建设项目应当按照国家有关规定实行法人负责制度、招标投标制度和工程监理制度。 Article 23 Systems of legal person responsibility, public bidding and project supervision should be introduced in projects of highway construction according to the relevant regulations of the State.
- 第二十三条本法第二十二条第一款所列各项海事请求，依照顺序受偿。但是，第（四）项海事请求，后于第（一）项至第（三）项发生的，应当先于第一）项至第（三）项受偿。 Article 23 The maritime claims set out in paragraph 1 of Article 22 shall be satisfied in the order listed. However, any of the maritime claims set out in sub-paragraph(4) arising later than those under sub-paragraph (1) through (3) shall have priority over those under sub-paragraph (1) through (3).
- 第二十三条机长在执行职务时，可以行使下列权力： Article 23 The pilot-in-command, in performing his duties, may exercise the following powers:
- 第二十三条 转口货物经海关同意，可在仓库内进行分级、挑选、刷贴标志、改换包装等简单加工。 Article 23 Transit goods, with the approval of the Customs, may undergo simple processing in warehouses, such as grading, selecting, pasting trademark tags, and changing the packing.
