- 第十九条 企业辞退、处分职工,工会认为不适当的,有权提出意见。 Article 19 A trade union which believes that an enterprise's dismissal or penalizing of an employee is inappropriate shall have the right to put forward its views on the matter.

- 第十九条 失业人员在领取失业保险金期间患病就医的,可以按照规定向社会保险经办机构申请领取医疗补助金。 Article 19 The unemployed who receive medical treatment during the period of receiving unemployment insurance compensation, may apply for medical subvention from social insurance agencies.

- 第二条 本规定所称待业职工,是指因下列情形之一,失去工作的国有企业(以下简称企业)职工: Article 2. The ""staff and workers waiting for employment"" referred to in these Regulations shall be the staff and workers of the State-owned enterprises (hereinafter referred to as the ""Enterprises""), who fit the following criteria:
- 第二条安置国有企业(以下简称企业)中的富余职工,应当遵循企业自行安置为主、社会帮助安置为辅,保障富余职工基本生活的原则。? Article 2. The placement of the surplus staff and workers of State-owned enterprises (hereinafter referred to as the ""Enterprises"") shall principally adhere to the principles of the placements made by the Enterprises themselves, and shall also adhere to the principles of socially assisted placements, as well as to the principles of maintenance of the minimum standard of living for surplus staff and workers.
- 第二条 中华人民共和国境内的企业、个体经济组织、民办非企业单位等组织(以下称用人单位)与劳动者建立劳动关系,订立、履行、变更、解除或者终止劳动合同,适用本法。 Article 2. This law is applicable to enterprises, individual economic entities and private non-enterprise organizations (“Units”) that establish labor relationships and conclude, perform, modify, dissolve, or terminate labor contracts with laborers in the People’s Republic of China.
- 第二十条 工会参加企业的劳动争议调解工作。 Article 20 A trade union shall participate in mediation work conducted in relation to labour disputes within its enterprise.
- 第二十条 劳动者在试用期的工资不得低于本单位相同岗位最低档工资或者劳动合同约定工资的百分之八十,并不得低于用人单位所在地的最低工资标准。 Article 20 During the probation period, the salary of a worker shall not be lower than the minimum salary for the same post of the same employer or not lower than 80 percent of the wage as stipulated in the labor contract, nor may it be lower than the minimum wage of the locality where the entity is situated.
- 第二十条 失业人员在领取失业保险金期间死亡的,参照当地对在职职工的规定,对其家属一次性发给丧葬补助金和抚恤金。 Article 20 If the unemployed die during the period of receiving unemployment insurance compensation, their family dependents are to be paid one-off funeral allowance and pension with reference to local regulations on employed staff and workers.
- 第二十条 用人单位必须采用有效的职业病防护设施,并为劳动者提供个人使用的职业病防护用品。 Article 20 The Employer should deploy effective occupational-disease-prevention facilities and provide the laborers with the individual-used occupational-disease-prevention articles.
- 第二十条 用人单位应当确保职业中毒危害防护设备、应急救援设施、通讯报警装置处于正常适用状态,不得擅自拆除或者停止运行。 Article 20 The employing units shall guarantee the normal service conditions of the safeguards against occupational health hazards, emergency and first-aid facilities, and communication and alarm facilities, and shall not dismantle them or stop the use of them without authorization.
- 第二十条 生活补助费和医疗补助费标准,根据其在本企业的工作年限计算。生活补助费按每满1年发给相当本人1个月的实得工资;医疗补助费按在本企业工作不满5年的,发给相当本人3个月的实得工资,5年以上的为6个月实得工资。在本企业工作6个月以上不满1年的,按1年计算。 Article 20 The standards of the living and medical treatment allowances are calculated according to the employees, working years in the FFEs. The living allowance issued to the employees with a working period of one year should be equivalent to the one month pay of the employees; the medical treatment allowance to the employees should be equivalent to three months pay to employees with less than 5 years or working term and equivalent to six months' pay to employees with more than 5 years of working term. The working time is counted as 1 year whereas the actual working term is more than 6 months but less than one year.
