第二十条 劳动合同的期限分为有固定期限、无固定期限和以完成一定的工作为期限。    Article 20 The term of a labour contract shall be divided into fixed term, flexible term or taking the completion of a specific amount of work as a term.
第二十条 劳动者在试用期的工资不得低于本单位相同岗位最低档工资或者劳动合同约定工资的百分之八十,并不得低于用人单位所在地的最低工资标准。    Article 20. During the probation period, the wages of a laborer may not be less than the lowest wage paid for the equivalent job post within the Unit or less than 80 percent of the wage agreed upon in the labor contract, nor may it be lower than the minimum wage standard of the employing Unit site.
第二十条 任何单位和个人挪用待业保险基金的,对主管人员和直接责任人员,根据情节轻重,给予行政处分;构成犯罪的,依法追究刑事责任。    Article 20. In cases where any unit or individual embezzles unemployment insurance funds, administrative punishment shall be imposed upon the personnel in charge and the personnel directly held responsible in accordance with the seriousness of the cases. If a crime has been committed, criminal liability shall be investigated according to law.
第二十一条 劳动合同可以约定试用期。试用期最长不得超过六个月。    Article 21 A probation period may be agreed upon in a labour contract. The longest probation period shall not exceed six months.
第二十一条 在试用期中,除劳动者有本法第三十九条和第四十条第一项、第二项规定的情形外,用人单位不得解除劳动合同。    Article 21 During the probation period, unless the worker is under any of the circumstances as prescribed in Article 39 and Subparagraphs (1) and (2) of Article 40of this law, the employer shall not terminate the labor contract.
第二十一条 单位招用的农民合同制工人连续工作满1年,本单位并已缴纳失业保险费,劳动合同期满未续订或者提前解除劳动合同的,由社会保险经办机构根据其工作时间长短,对其支付一次性生活补助。    Article 21 If a contract-system farmer worker engaged by a unit has been working continuously for not less than one year, and the unit has paid unemployment insurance premium, where no contract is renewed when the employment contract is expired or the contract is terminated in advance, the social insurance agency shall pay one-off living subsidy to the farmer worker according to the length of his working period.
第二十一条 企业侵犯职工劳动权益的,工会可以提出意见调解处理;职工向人民法院起诉的,工会应当给予支持和帮助。    Article 21 If an enterprise infringes on the work rights or interests of an employee, the trade union may put forward its views on mediation and handling of the matter. If an employee initiates legal proceedings with a people's court, the trade union shall give its support and assistance.
第二十一条 用人单位应当优先采用有利于防治职业病和保护劳动者健康的新技术、新工艺、新材料,逐步替代职业病危害严重的技术、工艺、材料。    Article 21 The Employer should give priority to the new technologies, new processes and new materials beneficial to the occupational disease prevention and the laborers’ health in place of the occupational-disease-inductive technologies, processes and materials step by step.
第二十一条 用人单位应当为从事使用有毒物品作业的劳动者提供符合国家职业卫生标准的防护用品,并确保劳动者正确使用。    Article 21 The employing units shall provide protective appliances that meet the national occupational health standards to their workers engaging in the operations in which toxic substances are used, and ensure their workers’ correct use of such appliances.
  第二十一条 企业按照有关规定宣布解散或经双方协商同意解除劳动合同时,对因工负伤、或者患职业病经医院证明正在治疗或疗养,以及医疗终结经劳动鉴定委员会确认为完全或者部分丧失劳动能力的职工,享受抚恤待遇的因工死亡职工遗属,在孕期、产期和哺乳期的女职工,以及未参加各项社会保险的职工,应当根据企业所在地区人民政府的有关规定,一次向社会保险机构支付所需要的生活及社会保险费用。    Article 21 Whereas a FFE disbands in line with relevant regulations or the labor contract is terminated with the agreement of both parties through consultations, the FFE should, in accordance with relevant regulations of the local people's government, pay the life and social insurance premiums as required to social insurance institutions for those employees who are in medical treatment or are recuperating due to injury at work or occupational disease as confirmed by the hospital, and those who entirely lose or partly lose working ability after medical treatment as confirmed by the labor appraisal committee, and the dependents of the deceased at work who are receiving pensions, women employees who are pregnant or are at the time of maternity or lactation, and those who get nothing insured.
第二十一条 在试用期中,除劳动者有本法第三十九条和第四十条第一项、第二项规定的情形外,用人单位不得解除劳动合同。    Article 21. During the probation period, a Unit may not dissolve a labor contract unless there is evidence proving that the laborer meets any of the conditions specified in Article 39 or the first and second items of Article 40 of this Law.
第二十一条 待业保险机构违反规定拖欠支付待业救济金和其他待业保险费的,由劳动行政主管部门责令改正;    Article 21. In cases where unemployment insurance institutions are in violation of the regulations relevant to the deferment of payment of unemployment relief funds and other unemployment insurance fees, the competent labor administrative institutions shall be ordered to make the necessary corrections.
第二十二条 城镇企业事业单位成建制跨统筹地区转移,失业人员跨统筹地区流动的,失业保险关系随之转迁。    Article 22 If enterprises and institutions in cities and towns move as a whole from one area where overall planning is conducted to another one, or if the unemployed moves among area where overall planning is conducted, the social insurance credentials are to be moved together.
  第二十二条 企业职工在职期间的福利待遇,按照国家有关规定执行。    Article 22 The current employees of the FFEs enjoy the welfare treatment in accordance with relevant State regulations.
第二十二条 产生职业病危害的用人单位,应当在醒目位置设置公告栏,公布有关职业病防治的规章制度、操作规程、职业病危害事故应急救援措施和工作场所职业病危害因素检测结果。    Article 22 The occupational-disease-inductive Employer shall publicize the regulations, operating rules, contingency measures upon occupational-disease-inductive accidents and the testing results of the workplace occupational-disease-inductive factors in the conspicuous bulletin board.
第二十二条 劳动合同当事人可以在劳动合同中约定保守用人单位商业秘密的有关事项。    Article 22 The parties involved in a labour contract may reach an agreement in their labour contract on matters concerning keeping he commercial secrets of the employing unit.
第二十二条 有毒物品必须附具说明书,如实载明产品特性、主要成分、存在的职业中毒危害因素、可能产生的危害后果、安全使用注意事项、职业中毒危害防护以及应急救治措施等内容;    Article 22 Toxic substances shall be attached with the specifications to indicate the true information such as product property, essential ingredients, existing factors of occupational poisoning hazards, possible dangerous consequences, precaution items for safe use, measures to prevent occupational poisoning hazards and the corresponding emergency and first-aid measures.
第二十二条 县级以上各级总工会可以为所属工会和职工提供法律咨询服务。    Article 22 Trade union federations at county level or above may provide legal consultancy services to affiliated trade unions and workers.
第二十二条 用人单位为劳动者提供专项培训费用,对其进行专业技术培训的,可以与该劳动者订立协议,约定服务期。    Article 22 Where an employer pays special training expenses exclusively for a worker, as well as the special technical training, it may conclude an agreement with the worker concerning the service period.
第二十二条 用人单位为劳动者提供专项培训费用,对其进行专业技术培训的,可以与该劳动者订立协议,约定服务期。    Article 22. If the Unit pays for specific vocational training expenses and provides the laborer with professional vocational training, it may sign an agreement with the laborer agreeing upon a term of service.
第二十二条 实行企业化管理的事业单位职工待业保险,依照本规定执行,待业保险费在事业单位自有资金中列支。    Article 22. Unemployment insurance of the staff and workers waiting for employment from the institutions practicing enterprise management shall be implemented in accordance with the provisions of these Regulations. The unemployment insurance premium of the institutions shall be paid out of locally controlled funds.
第二十三条 劳动合同期满或者当事人约定的劳动合同终止条件出现,劳动合同即行终止。    Article 23 A labour contract shall terminate upon the expiration of its term or the emergence of the conditions for the termination of the labour contract as agreed upon by the parties involved.
第二十三条 工会依照国家规定对新建、扩建企业和技术改造工程中的劳动条件和安全卫生设施有权提出意见,企业或者主管部门应当认真处理。    Article 23 A trade union shall, pursuant to State regulations, have the right to put forward views on work conditions and safety and hygiene facilities for a newly constructed or expanded enterprise or one undergoing technological transformation, and the said enterprise or its department in charge shall conscientiously endeavour to meet such requirements.
第二十三条 对可能发生急性职业损伤的有毒、有害工作场所,用人单位应当设置报警装置,配置现场急救用品、冲洗设备、应急撤离通道和必要的泄险区。    Article 23 At the poisonous and harmful workplace prone to contingent occupational injuries, the Employer is required to install alarm units, on-site first-aid articles, rinsing facility, emergency exit and necessary risk-elimination area.
第二十三条 用人单位与劳动者可以在劳动合同中约定保守用人单位的商业秘密和与知识产权相关的保密事项。    Article 23 Employers and workers may stipulate such issues as keeping confidential the business secrets and intellectual property of the employer in the labor contract.
