- 第二十九条 劳动者有下列情形之一的,用人单位不得依据本法第二十六条、第二十七条的规定解除劳动合同: Article 29 The employing unit shall not revoke its labour contract with a labourer in accordance with the stipulations in Article 26 and Article 27 of this Law in any of the following circumstances: ??????to be confirmed to have totally or partially lost the ability to work due ??????to occupational diseases or injuries suffered at work;
- 第二十九条 县级以上地方各级人民政府可以采取适当方式,向同级工会通报政府的重要的工作部署和与工会工作有关的行政措施,研究解决工会反映的职工群众的意见和要求。 Article 29 The various levels of people's governments at county level or above may adopt appropriate methods to report the respective government's important work plans and administrative measures relating to trade union work to their equivalent level trade unions and shall study and determine ways of handling the suggestions and requests of the working masses as reflected through the trade unions.
- 第二十九条 用人单位转产、停产、停业或者解散、破产的,应当采取有效措施,妥善处理留存或者残留有毒物品的设备、包装物和容器。 Article 29 Where the employing units halt production, change the line of production, or are shut down or dissolved, or go into bankruptcy, they shall take effective measures to dispose of equipment, packages, and containers with the residues of toxic substances.
- 第二十九条 企业职工工资低于当地最低工资标准的,由当地劳动行政部门责令其限期纠正,企业除按最低工资标准补齐外,还应按实发工资与最低工资标准差额的20%-100%发给职工赔偿金。 Article 29 Whereas an employees' wage of a FFE is lower than the local minimum wage standard, the local labor administrative department shall order the FFE to correct within a set time, and, apart from making up for the wage according to the minimum standard, should pay the employee a compensation fund in the amount of 20 to 100 percent of the difference between the actual paid wage and the minimum wage standard.
- 第二十九条 用人单位与劳动者应当按照劳动合同的约定,全面履行各自的义务。 Article 29. The Unit and the laborer shall each fully perform its/his obligations in accordance with the labor contract.
- 第二十九条 社会保险经办机构工作人员违反规定向失业人员开具领取失业保险金或者享受其他失业保险待遇单证,致使失业保险基金损失的,由劳动保障行政部门责令追回;情节严重的,依法给予行政处分。 Article 29Where a functionary of a social insurance agency, in violation of provisions, issues documents for receiving unemployment insurance compensation or enjoying other unemployment insurance benefits for the unemployed, thus causing losses of unemployment insurance funds, the administrative department of labor security shall order them to be recovered; where the circumstances are serious, administrative sanctions shall be imposed according to law.
- 第二条 城镇企业事业单位、城镇企业事业单位职工依照本条例的规定,缴纳失业保险费。 Article 2Enterprises and institutions in cities and towns as well as their staff and workers shall pay unemployment insurance premium in accordance with these Regulations.
- 第三条 在中国境内的企业、事业单位、机关中以工资收入为主要生活来源的体力劳动者和脑力劳动者,不分民族、种族、性别、职业、宗教信仰、教育程度,都有依法参加和组织工会的权利。 Article 3 All workers doing physical or mental work in enterprises, public institutions and government organs within Chinese territory who earn their living primarily from wages shall have the right to participate in and form trade union organizations pursuant to the law, regardless of their nationality, race, sex, occupation, religious beliefs or level of education.
- 第三条 劳动者享有平等就业和选择职业的权利、取得劳动报酬的权利、休息休假的权利、获得劳动安全卫生保护的权利、接受职业技能培训的权利、享受社会保险和福利的权利、提请劳动争议处理的权利以及法律规定的其他劳动权利。 Article 3 Labourers shall have the right to be employed on an equal basis, choose occupations, obtain remuneration for their labour, take rest, have holidays and leaves, obtain protection of occupational safety and health, receive training vocational skills, enjoy social insurance and welfare, and submit applications for settlement of labour disputes, and other rights relating to labour as stipulated by law.
- 第三条 订立劳动合同,应当遵循合法、公平、平等自愿、协商一致、诚实信用的原则。 Article 3 The conclusion of a labor contract shall be subject to the principle of legitimacy, justice, equality, free will, unanimity through consultation and good faith.
- 第三条 县及县以上各级人民政府的劳动行政部门依据本规定,对企业的用人、培训、工资、保险福利待遇和劳动安全卫生等实行监察。 Article 3 The labor administrative departments of the people's governments at county and above level exercise supervision over the FFEs in accordance with this set of regulations with regard to their use and training of personnel, and the personnel's wages, insurance and welfare, as well as their working safety and hygiene conditions.
- 第三条 职业病防治工作坚持预防为主、防治结合的方针,实行分类管理、综合治理。 Article 3 The prevention of occupational diseases should follow the guideline of prevention first and prevention & treatment combination, and stand to the categorized management and comprehensive treatment.
- 第三条 按照有毒物品产生的职业中毒危害程度,有毒物品分为一般有毒物品和高毒物品。 Article 3 Toxic substances are classified into general toxic substances and high toxic substances in light of the extent of occupational poisoning hazards caused by toxic substances.
- 第三条 患二、三期矽肺病离职休养的工人,如果本人自愿,也可以退休。 Article 3 Workers who have been afflicted with secondary or tertiary silicosis and who have left their posts for rest and treatment , may retire of their own will.

In the placement of surplus staff and workers, the Enterprises shall, in accordance with these Regulations, explore diversified business, organize labor activities, develop the tertiary industry, and comprehensively utilize available resources and other measures.
- 第三条 待业保险工作应当与职业介绍、就业训练和生产自救等就业服务工作紧密结合,统筹安排。 Article 3. Unemployment insurance shall be closely incorporated with such employment services as vocational introductions, employment training and self-reliance, and shall be organized in an overall plan.
- 第三条 订立劳动合同,应当遵循合法、公平、平等自愿、协商一致、诚实信用的原则。 Article 3. When a Unit and a laborer conclude a labor contract, they shall abide by the principles of legitimacy, fairness, equality, voluntariness, unanimity through consultation and good faith.
- 第三十条 企业不为职工办理社会保险手续的,应按照劳动行政部门规定的期限补办;不按期缴纳各项社会保险费的,应当从逾期之日起按日加收应缴金额2‰的滞纳金。滞纳金分别纳入各项社会保险费用。 Article 30 A FFE that does not go through the formalities of social insurance for the employees should do it in a set time in line with the regulations of labor administrative department; if it fails to pay various social insurance in time, it should pay 2 percent of the delaying fund beginning from the date of expiration. And the delaying fund is put into various social insurances.
- 第三十条 用人单位应当按照劳动合同约定和国家规定,向劳动者及时足额支付劳动报酬。 Article 30 An employer shall pay the workers thereof the full amount of remunerations in a timely manner in accordance with the contractual stipulations and the provisions of the state.
- 第三十条 用人单位与劳动者订立劳动合同(含聘用合同,下同)时,应当将工作过程中可能产生的职业病危害及其后果、职业病防护措施和待遇等如实告知劳动者,并在劳动合同中写明,不得隐瞒或者欺骗。 Article 30 The Employer is required to inform the laborers of the potential occupational-disease-inductive factors and the aftereffect in the work as well as the occupational-disease-prevention measures and remuneration among other related information before the execution of labor contract (including the employment contract, the same below). It is also required to completely and accurately record the above information in the labor contract.
- 第三十条 用人单位应当对本单位执行本条例规定的情况进行经常性的监督检查;发现问题,应当及时依照本条例规定的要求进行处理。 Article 30 The employing units shall frequently supervise and inspect their implementation of the provisions of these Regulations, and shall promptly solve the discovered problems in accordance with the requirements as provided for in these Regulations.
- 第三十条 全民所有制企业职工代表大会是企业实行民主管理的基本形式,是职工行使民主管理权力的机构,依照《中华人民共和国全民所有制工业企业法》的规定行使职权。 Article 30 The representative assembly of the workers of an enterprise owned by the whole people shall be the primary structure through which the enterprise executes democratic management as it is the body through which the workers may exercise their rights to democratic management in accordance with the provisions of the Law of the People's Republic of China on Industrial Enterprises Owned by the Whole People.
- 第三十条 用人单位解除劳动合同,工会认为不适当的,有权提出意见。如果用人单位违反法律、法规或者劳动合同,工会有权要求重新处理;劳动者申请仲裁或者提起诉讼的,工会应当依法给予支持和帮助。 Article 30 The trade union of an employing unit shall have the right to air its opinions if it regards as inappropriate the revocation of a labour contract by the unit. If the employing unit violates laws, rules and regulations or labour contracts, the trade union shall have the right to request for reconsideration. Where the labourer applies for arbitration or brings in a lawsuit, the trade union shall render him support and assistance in accordance with the law.
- 第三十条 用人单位应当按照劳动合同约定和国家规定,向劳动者及时足额支付劳动报酬。 Article 30. Units shall pay labor remuneration on time and in full accordance with state regulations and the labor contract.
- 第三十条 劳动保障行政部门和社会保险经办机构的工作人员滥用职权、徇私舞弊、玩忽职守,造成失业保险基金损失的,由劳动保障行政部门追回损失的失业保险基金; Article 30Where a functionary of the administrative department of labor security and the social insurance agency abuses his power, neglects his duties and practice favoritism, thus resulting in the losses of unemployment insurance funds, the administrative department of labor security shall recover the lost unemployment insurance funds;
