- 第二十三条 企业应当按照当地人民政府的规定，提取使用中方职工住房基金。 Article 23 FFEs should draw a certain amount of housing fund for their Chinese employees in line with the regulations of the local people's government.

Packages for toxic substances shall have conspicuous warning marks and warning specifications in Chinese.
- 第二十三条 用人单位与劳动者可以在劳动合同中约定保守用人单位的商业秘密和与知识产权相关的保密事项。 Article 23. A Unit and a laborer may include provisions concerning the safeguarding of trade secrets and intellectual property of the Unit in the labor contract.
- 第二十三条 本规定不适用企业招用的农民合同制工人。 Article 23. These Regulations shall not apply to the contracted workers who are recruited from rural areas by the Enterprises.
- 第二十三条 失业人员符合城市居民最低生活保障条件的，按照规定享受城市居民最低生活保障待遇。 Article 23If the unemployed are qualified for minimal living ensuring standard for urban residents, they are entitled to enjoy the benefit of the minimal living ensuring standard for urban residents.
- 第二十四条 经劳动合同当事人协商一致，劳动合同可以解除。 Article 24 A labour contract may be revoked upon agreement reached between the parties involved through consultation.
- 第二十四条 企业职工享受国家规定的节假日、公休假日、探亲假、婚丧假、女职工产假等假期。 Article 24 Employees of FFEs enjoy leaves for festivals, vacations, public holidays, visiting parents or spouses and handling funeral affairs, and maternity leave for women employees in line with the State regulations.
- 第二十四条 工会发现企业行政方面违章指挥、强令工人冒险作业，或者生产过程中发现明显重大事故隐患和职业危害，有权提出解决的建议；当发现危及职工生命安全的情况时，有权向企业行政方面建议组织职工撤离危险现场，企业行政方面必须及时作出处理决定。 Article 24 If a trade union discovers that an enterprise's administrative authority is breaking rules and regulations by directing or forcing workers to undertake risks or if distinct and significant hidden dangers or occupational hazards are discovered during the production process, the trade union shall have the right to suggest a resolution. On discovering a situation where the personal safety of workers is jeopardized, a trade union shall have the right to suggest to the enterprise's administrative authority that the workers abandon the dangerous site and the said administrative authority must decide promptly on measures to resolve the matter.
- 第二十四条 劳动保障行政部门管理失业保险工作，履行下列职责： Article 24 In the administration of social insurance, the administrative department of labor security shall perform the following duties:
- 第二十四条 用人单位应当实施由专人负责的职业病危害因素日常监测，并确保监测系统处于正常运行状态。 Article 24 The Employer should appoint respective employee to make routine supervision over occupational-disease-inductive factors and ensure the normal operation of the monitoring systems.
- 第二十四条 用人单位维护、检修存在高毒物品的生产装置，必须事先制订维护、检修方案，明确职业中毒危害防护措施，确保维护、检修人员的生命安全和身体健康。 Article 24 The employing units shall, when maintaining or overhauling production installations involving the use of high toxic substances, work out maintenance or overhaul scheme in advance to specify protective measures against occupational poisoning hazards, so as to safeguard the maintenance or overhaul staff's life safety and body health.
- 第二十四条 竞业限制的人员限于用人单位的高级管理人员、高级技术人员和其他负有保密义务的人员。 Article 24 The personnel under limitation of competition shall be limited to senior mangers, senior technicians and other personnel who have the obligation to keep secrets in the entity.
- 第二十四条 省、自治区、直辖市人民政府可以根据本规定制定实施办法。 Article 24. The people's government of the province, autonomous region and municipality directly under the Central Government shall, in light of the provisions of these Regulations, formulate the measures for implementation.
- 第二十四条 竞业限制的人员限于用人单位的高级管理人员、高级技术人员和其他负有保密义务的人员。 Article 24. The personnel subject to non-competition provisions shall be limited to the Unit’s senior management, senior technicians and other personnel who have knowledge of trade secrets of the Unit.
- 第二十五条 向用人单位提供可能产生职业病危害的设备的，应当提供中文说明书，并在设备的醒目位置设置警示标识和中文警示说明。警示说明应当载明设备性能、可能产生的职业病危害、安全操作和维护注意事项、职业病防护以及应急救治措施等内容。 Article 25 Any occupational-disease-inductive equipment supplied to the Employer shall be accompanied with a user manual in Chinese as well as the conspicuous warning mark and warning message in Chinese. The warning message should indicate the performance, the occupational-disease-inductive factors, precautions for safe operation and maintenance, occupational disease prevention and contingency measures, etc.
- 第二十五条 除本法第二十二条和第二十三条规定的情形外，用人单位不得与劳动者约定由劳动者承担违约金。 Article 25 Except for the circumstances as prescribed in Articles 22 and 23 of this Law, the employer shall not stipulate in the labor contract that the worker shall pay the penalty for breach of contract.
- 第二十五条 企业发生停工、怠工事件，工会应当会同企业行政方面或者有关方面，协商解决职工提出的可以解决的合理的要求，尽快恢复正常生产秩序。 Article 25 If an enterprise is subject to stop work or slow down measures, the trade union shall, in conjunction with the enterprise's administrative authority or other relevant authorities, negotiate a resolution of demands raised by the workers which are found to be reasonable and able to be resolved so as to enable the normal production process to be resumed as quickly as possible.
- 第二十五条 企业因订立集体合同与工会或工人代表发生争议，争议双方协商不能解决的，可以由当地劳动行政部门组织争议双方协商处理；企业因履行集体合同发生的争议，经双方协商不能解决的，可以依法申请仲裁、提起诉讼。 Article 25 If the two sides cannot solve through consultations the disputes that occur between the FFEs and the trade unions or the worker representatives while concluding collective labor contracts, the local labor administrative departments may invite the disputing parties together for a solution; if the two sides cannot solve through consultations the disputes that occur while the FFEs implement the collective contract, they may apply for arbitration or take legal proceeding according to laws.
- 第二十五条 劳动者有下列情形之一的，用人单位可以解除劳动合同： Article 25 The employing unit may revoke the labour contract with a labourer in any of the following circumstances: ???

- 第二十五条 本规定由国务院劳动行政主管部门负责解释。 Article 25. These Regulations shall be interpreted by the competent labor administrative institution under the State Council.
- 第二十五条 除本法第二十二条和第二十三条规定的情形外，用人单位不得与劳动者约定由劳动者承担违约金。 Article 25. With the exception of the circumstances specified in Articles 22 and 23 hereof, a Unit may not stipulate with a laborer damages which the laborer is required to bear.
- 第二十六条 企业的劳动争议、劳动安全卫生、工伤事故报告和处理、工作时间、女职工和未成年工的特殊保护等，按国家规定执行。 Article 26 FFEs should follow the State regulations for the handling of labor disputes, labor safety and hygiene conditions, report and treatment of accidents occurred in work, working time, special protection for women employees and those under age.
- 第二十六条 财政部门和审计部门依法对失业保险基金的收支、管理情况进行监督。 Article 26 Financial departments and auditing departments shall supervise the collection, payment and administration of unemployment insurance funds according to law.
