第九条 用人单位招用劳动者,不得扣押劳动者的居民身份证和其他证件,不得要求劳动者提供担保或者以其他名义向劳动者收取财物。    Article 9 Where a worker is hired, the employer may not detain the identity card or other certificates thereof, nor may it require a guaranty or collect property from the worker under any other reason.
第九条职工距退休年龄不到五年的,经本人申请,企业领导批准,可以退出工作岗位休养。    Article 9. If the age of staff and workers is less than five (5) years below the stipulated age for retirement, such staff and workers may, upon their own voluntary application and with the approval from Enterprise authorities, remove themselves from their posts for rest.
第九条 待业保险基金及其管理费不计征税、费。    Article 9. No taxes or expenses shall be levied on unemployment insurance funds or their management fees.
第九条 用人单位招用劳动者,不得扣押劳动者的居民身份证和其他证件,不得要求劳动者提供担保或者以其他名义向劳动者收取财物。    Article 9. When hiring a laborer, a Unit may not require him to provide any guarantee or collect property from the laborer as collateral, nor may it retain the laborer’s resident identification card or other papers.
第九十条 用人单位违反本法规定,延长劳动者工作时间的,由劳动行政部门给予警告,责令改正,并可以处以罚款。    Article 90 Where the employing unit extends working hours of labourers in violation of the stipulations of this Law, the labour administrative department shall give it a warning, order it to make corrections, and may impose a fine.
第九十条 劳动者违反本法规定解除劳动合同,或者违反劳动合同中约定的保密义务或者竞业限制,给用人单位造成损失的,应当承担赔偿责任。    Article 90 With respect to any worker that is in violation of this Law because of discharge of the labor contract, or is in violation of relevant stipulations of the labor contract concerning the confidentiality obligation or limitation of competition, he shall bear the liability for compensation if any loss occurs to the employer.
第九十条 劳动者违反本法规定解除劳动合同,或者违反劳动合同中约定的保密义务或者竞业限制,给用人单位造成损失的,应当承担赔偿责任。    Article 90. If a laborer dissolves his labor contract in violation of this Law or breaches the confidentiality obligations or non-competition stipulated in his labor contract, and if such violation or breach causes his Unit to suffer loss, the laborer will be liable for damages.
第九十一条 用人单位有下列侵害劳动者合法权益情形之一的,由劳动行政部门责令支付劳动者的工资报酬、经济补偿,并可以责令支付赔偿金:    Article 91 Where an employing unit infringes in any of the following ways the legitimate rights and interests of labourers, the labour administrative department shall order it to pay labourers remuneration or to make up for economic losses, and may also order it to pay compensations:
第九十一条 用人单位招用与其他用人单位尚未解除或者终止劳动合同的劳动者,给其他用人单位造成损失的,应当承担连带赔偿责任。    Article 91 Where any worker that has not discharged or terminated a labor contract with an employer yet is hired by another employer, if any loss occurs to the former employer, the new employer shall bear joint and several liability of compensation.
第九十一条 用人单位招用与其他用人单位尚未解除或者终止劳动合同的劳动者,给其他用人单位造成损失的,应当承担连带赔偿责任。    Article 91. If a Unit hires a laborer whose labor contract with another Unit has not yet been terminated or dissolved, causing the original Unit to suffer a loss, it shall bear joint and several liability for damage.
第九十二条 劳务派遣单位违反本法规定的,由劳动行政部门和其他有关主管部门责令改正;情节严重的,以每人一千元以上五千元以下的标准处以罚款,并由工商行政管理部门吊销营业执照;给被派遣劳动者造成损害的,劳务派遣单位与用工单位承担连带赔偿责任。    Article 92 In case any labor dispatch service provider is in violation of this Law, the labor administrative department and other relevant competent authorities shall order it to make a correction. In the case of any severe circumstances, it shall be imposed a fine of not less than RMB 1, 000 but not more than RMB 5, 000 per person and its business license shall be revoked by the administrative department for industry and commerce. If any damage occurs to the dispatched workers, the labor dispatch service provider and the accepting entity shall be jointly and severally liable for compensation.
第九十二条 用人单位的劳动安全设施和劳动卫生条件不符合国家规定或者未向劳动者提供必要的劳动防护用品和劳动保护设施的,由劳动行政部门或者有关部门责令改正,可以处以罚款;情节严重的,提请县级以上人民政府决定责令停产整顿;对事故隐患不采取措施,致使发生重大事故,造成劳动者生命和财产损失的,对责任人员比照刑法第一百八十七条的规定追究刑事责任。    Article 92 Where the occupational safety fsacilities and health conditions of an employing unit do not comply with the provisions of the State or the unit fails to provide labourers with necessary labour protection articles and labour protection facilities the labour administrative department or other relevant departments shall order it to make corrections, and may impose a fine. If circumstances are serious, the above-said departments shall apply to a people’s government at or above the county level for a decision to order the unit to stop production for consolidation. If the unit fails to take measures against potential accident which later leads to the occurrence of a serious accident and the losses of labourers’ lives and properties, criminal responsibilities shall be investigated against the persons in charge of mutatis mutandis the stipulations of Article 187 of the Criminal Law.
第九十二条 劳务派遣单位违反本法规定的,由劳动行政部门和其他有关主管部门责令改正;    Article 92. If a labor dispatching Unit violates this Law, the Labor Administration Department shall order it to rectify the situation within a specified period of time.
第九十三条 对不具备合法经营资格的用人单位的违法犯罪行为,依法追究法律责任;劳动者已经付出劳动的,该单位或者其出资人应当依照本法有关规定向劳动者支付劳动报酬、经济补偿、赔偿金;给劳动者造成损害的,应当承担赔偿责任。    Article 93 In the case of any committed violation or crime by an employer without the lawful business operation qualifications, it shall be investigated for legal liabilities. If the workers have already worked for the employer, the employer or its capital contributors shall pay the workers remunerations, economic compensations or indemnities as prescribed in this Law. If any damage occurs to the worker, it shall bear the liability for compensation.
第九十三条 用人单位强令劳动者违章冒险作业,发生重大伤亡事故,造成严重后果的,对责任人员依法追究刑事责任。    Article 93 Where an employing unit forces labourers to operate with risks in violation of the rules and regulations, causing thus major accident of injuries and deaths, and serious consequences, criminal responsibilities of the person in charge shall be investigated according to law.
第九十三条 对不具备合法经营资格的用人单位的违法犯罪行为,依法追究法律责任;    Article 93. If an illegal action of an employing Unit without a business license constitutes a crime, criminal liability should be imposed under law.
第九十四条 个人承包经营违反本法规定招用劳动者,给劳动者造成损害的,发包的组织与个人承包经营者承担连带赔偿责任。    Article 94 In case any worker is hired by an individual as a business operation contractor in violation of this Law, if any damage occurs to the worker, the contract-letting organization and the individual business operation contractor shall bear joint and several liability for compensation.
第九十四条 用人单位非法招用未满十六周岁的未成年人的,由劳动行政部门责令改正,处以罚款;情节严重的,由工商行政管理部门吊销营业执照。    Article 94 Where an employing unit illegally recruits juveniles under the age of 16, the labour administrative department shall order it to make corrections, and impose a fine. If circumstances are serious, the administrative department for industry and commerce shall revoke its business license.
第九十四条 个人承包经营违反本法规定招用劳动者,给劳动者造成损害的,发包的组织与个人承包经营者承担连带赔偿责任。    Article 94. If the individual contractor recruits laborers in violation of this law and causes loss to the laborers, the individual or organization of the contract-issuing party is jointly and severally liable for economic damages.
第九十五条 用人单位违反本法对女职工和未成年工的保护规定,侵害其合法权益的,由劳动行政部门责令改正,处以罚款;对女职工或者未成年工造成损害的,应当承担赔偿责任。    Article 95 Where an employing unit encroaches upon the legitimate rights and interests of female and juvenile workers in violation of the stipulations of this Law on their protection, the labour administrative department shall order it to make corrections, and impose a fine. If harms to female and juvenile workers have been caused, the unit shall assume the responsibility for compensations.
第九十五条 劳动行政部门和其他有关主管部门及其工作人员玩忽职守、不履行法定职责,或者违法行使职权,给劳动者或者用人单位造成损害的,应当承担赔偿责任;    Article 95 Where the labor administrative department, or any other relevant administrative department, or any of the personnel thereof neglects its/his duties, fails perform the statutory duties or exercises its/his duties in violation of law, if any damage occurs to the worker or the employer, it/he shall bear the liability for compensation.
第九十五条 劳动行政部门和其他有关主管部门及其工作人员玩忽职守、不履行法定职责,或者违法行使职权,给劳动者或者用人单位造成损害的,应当承担赔偿责任;    Article 95. If the Labor Administration Department, other related departments or personnel of the Department fail(s) to fulfill its/their legal responsibility or exercises its/their power in violation of the law, thereby infringing upon the lawful rights and interests of a Unit or a laborer, it/they will be liable for damages.
第九十六条 用人单位有下列行为之一,由公安机关对责任人员处以十五日以下拘留、罚款或者警告;构成犯罪的,对责任人员依法追究刑事责任:    Article 96 Where an employing unit commits one of the following acts, the person in charge shall be taken by a public security organ into custody for 15 days or less, or fined, given a warning; and criminal responsibilities shall be investigated against the person in charge according to law if the act constitutes a crime;
第九十六条 事业单位与实行聘用制的工作人员订立、履行、变更、解除或者终止劳动合同,法律、行政法规或者国务院另有规定的,依照其规定;未作规定的,依照本法有关规定执行。    Article 96 With respect to any conclusion, performance, modification, discharge or termination of labor contract between a public institution and a worker under the labor system, it shall be subject to this Law, except that it is otherwise prescribed by any law, administrative regulation or by the State Council. If there is no such provision, it shall abide by the relevant provisions of this Law.
第九十六条 事业单位与实行聘用制的工作人员订立、履行、变更、解除或者终止劳动合同,法律、行政法规或者国务院另有规定的,依照其规定;未作规定的,依照本法有关规定执行。    Article 96. Where the laws, administrative regulations or State Council have formulated separate, special regulations concerning pinyong hiring contracts practiced by public institutions, such regulations shall prevail.
