第八十四条 因签订集体合同发生争议,当事人协商解决不成的,当地人民政府劳动行政部门可以组织有关各方协调处理。    Article 84 Where a dispute arises from the conclusion of a collective contract and no settlement can be reached through consultation by the parties concerned, the labour administrative department of the local people’s government may organize the relevant departments to handle the case in coordination.
第八十四条 用人单位违反本法规定,扣押劳动者居民身份证等证件的,由劳动行政部门责令限期退还劳动者本人,并依照有关法律规定给予处罚。    Article 84 Where an employer violates this Law due to detaining any worker's resident identity card or other certificates, it shall be ordered by the labor administrative department to return the aforesaid certificates to the worker within a time limit and shall be punished according to law.
第八十四条 用人单位违反本法规定,扣押劳动者居民身份证等证件的,由劳动行政部门责令限期退还劳动者本人,并依照有关法律规定给予处罚。    Article 84. If the employing Unit retains a laborer’s identification card or other personal documents in violation of this law, the Public Security Organ shall order the Unit to return the documents to the laborer and may impose a penalty on the Unit according to the relevant laws.
第八十五条 用人单位有下列情形之一的,由劳动行政部门责令限期支付劳动报酬、加班费或者经济补偿;    Article 85 In the case of any of the following circumstances occurring to any employer, it shall be ordered by the labor administrative department to pay the remunerations, overtime remunerations or economic compensations within a time limit.
第八十五条 县级以上各级人民政府劳动行政部门依法对用人单位遵守劳动法律、法规的情况进行监督检查,对违反劳动法律、法规的行为有权制止,并责令改正。    Article 85 The labour administrative departments of people’s governments at or above the county level shall, in accordance with the law, supervise and inspect the implementation of laws, rules and regulations on labour by the employing unit, and have the power to stop any acts that run counter to laws, rules and regulations on labour and order the rectification thereof.
第八十五条 用人单位有下列情形之一的,由劳动行政部门责令限期支付劳动报酬、加班费或者经济补偿;劳动报酬低于当地最低工资标准的,应当支付其差额部分;逾期不支付的,责令用人单位按应付金额百分之五十以上百分之一百以下的标准向劳动者加付赔偿金:(一) 未按照劳动合同的约定或者国家规定及时足额支付劳动者劳动报酬的;(二) 低于当地最低工资标准支付劳动者工资的;(三) 安排加班不支付加班费的;(四) 解除或者终止劳动合同,未依照本法规定向劳动者支付经济补偿的。    Article 85. If a Unit: (1) fails to pay a laborer labor remuneration as stipulated in the labor contract or provided for in this Law; (2) pays labor remuneration below the local minimum wage rate; (3) arranges overtime work without paying overtime pay; or (4) dissolves or terminates a labor contract without paying the laborer economic compensation pursuant to this Law; then the Labor Administration Department shall order it to pay the labor remuneration, overtime pay or economic compensation within a specified period of time. If the labor remuneration is lower than the local minimum wage rate, the Unit shall pay the difference. If payment is not made within the determined time limit, the Unit shall be ordered to pay additional damages to the laborer at a rate of no less than 50 percent and no more than 100 percent of the amount payable.
第八十六条 县级以上各级人民政府劳动行政部门监督检查人员执行公务,有权进入用人单位了解执行劳动法律、法规的情况,查阅必要的资料,并对劳动场所进行检查。    Article 86 The inspectors from the labour administrative departments of people’s governments at or above the county level shall, while performing their public duties, have the right to enter the employing units to make investigations about the implementation of laws, rules and regulations on labour examine necessary data and inspect labour sites.
第八十六条 劳动合同依照本法第二十六条规定被确认无效,给对方造成损害的,有过错的一方应当承担赔偿责任。    Article 86 Where a labor contract has been confirmed as invalid in accordance with Article 26 of this Law, if any damage occurs to the other party, the party at fault shall be liable for compensation.
第八十六条 劳动合同依照本法第二十六条规定被确认无效,给对方造成损害的,有过错的一方应当承担赔偿责任。    Article 86. If the signed labor contract is confirmed to be invalid according to Article 26 of this law and any loss has been incurred, the party at fault should assume financial responsibility.
第八十七条 县级以上各级人民政府有关部门在各自职责范围内,对用人单位遵守劳动法律、法规的情况进行监督。    Article 87 Relevant departments of people’s governments at or above the county level shall, within the scope of their respective duties and responsibilities, supervise the implementation of laws, rules and regulations on labour by the employing units.
第八十七条 用人单位违反本法规定解除或者终止劳动合同的,应当依照本法第四十七条规定的经济补偿标准的二倍向劳动者支付赔偿金。    Article 87 Where any employer is in violation of this Law because of discharge or termination of the labor contract, a compensation shall be paid to the worker at the rate of twice of the economic compensations as prescribed in Article 47 of this Law.
第八十七条 用人单位违反本法规定解除或者终止劳动合同的,应当依照本法第四十七条规定的经济补偿标准的二倍向劳动者支付赔偿金。    Article 87. If a Unit dissolves or terminates the labor contract in violation of this Law, it shall pay damage compensation to the laborer at twice the rate of the economic compensation provided for in Article 47 hereof.
第八十八条 用人单位有下列情形之一的,依法给予行政处罚;构成犯罪的,依法追究刑事责任;给劳动者造成损害的,应当承担赔偿责任:    Article 88 In the case of any of the following circumstances, an employer shall be given an administrative punishment. If there is any constituted crime, it shall be investigated for criminal liabilities. If any damage occurs to the worker, the employer shall bear the liability for compensation:
第八十八条 各级工会依法维护劳动者的合法权益,对用人单位遵守劳动法律、法规的情况进行监督。任何组织和个人对于违反劳动法律、法规的行为有权检举和控告。    Article 88 Trade unions at various levels shall, in accordance with the law, safeguard the legitimate rights and interests of labourers, and supefvise the implementation of laws, rules and regulations on labour by the employing units. Any organizations or individuals shall have the right to expose and accuse any acts in violation of laws, rules and regulations on labour.
第八十八条 用人单位有下列情形之一的,依法给予行政处罚;构成犯罪的,依法追究刑事责任;给劳动者造成损害的,应当承担赔偿责任:(一) 以暴力、威胁或者非法限制人身自由的手段强迫劳动的;(二) 违章指挥或者强令冒险作业危及劳动者人身安全的;(三) 侮辱、体罚、殴打、非法搜查或者拘禁劳动者的;(四) 劳动条件恶劣、环境污染严重,给劳动者身心健康造成严重损害的。    Article 88. If a Unit: (1) uses violence, intimidation or unlawful restriction of personal freedom to compel a laborer to work; (2) instructs or peremptorily orders a laborer to perform dangerous operations which threaten his personal safety in violation of rules and regulations; (3) insults, corporally punishes, beats, illegally searches or detains a laborer; or (4) causes serious physical or mental injury to laborers due to poor quality working conditions or a seriously polluted working environment then administrative punishment should be imposed. If such conduct constitutes a criminal offense, criminal liability shall be pursued according to law. If the laborer suffers harm as a result of the said conduct on the part of the Unit, the Unit will be liable for damages.
第八十九条 用人单位违反本法规定未向劳动者出具解除或者终止劳动合同的书面证明,由劳动行政部门责令改正;给劳动者造成损害的,应当承担赔偿责任。    Article 89 Where any employer is in violation of this Law because of failing to issue a certificate in written form for the discharge or termination of a labor contract to a worker, the labor administrative department shall order it to make a correction. If any damage occurs to the worker, it shall bear the liability for compensation.
第八十九条 用人单位制定的劳动规章制度违反法律、法规规定的,由劳动行政部门给予警告,责令改正;对劳动者造成损害的,应当承担赔偿责任。    Article 89 Where the rules and regulations on labour formulated by the employing unit run counter to the provisions of laws, rules and regulations, the labour administrative department shall give a warning to the unit, order it to make corrections; where any harms have been caused to labourers, the unit shall be liable for compensations.
第八十九条 用人单位违反本法规定未向劳动者出具解除或者终止劳动合同的书面证明,由劳动行政部门责令改正;给劳动者造成损害的,应当承担赔偿责任。    Article 89. If a Unit fails to issue to a laborer a certificate evidencing the dissolution or termination of his labor contract as required in this law, the Labor Administration Department shall order rectification. If the laborer suffers harm as the result of such failure, the Unit will be liable for damages.
第九条 工会对职工进行爱国主义、集体主义、社会主义教育,民主、法制、纪律教育,以及科学、文化、技术教育,提高职工的思想、道德和科学、文化、技术、业务素质,使职工成为有理想、有道德、有文化、有纪律的劳动者。    Article 9 A trade union shall educate workers in matters of patriotism, collectivism and socialism, democracy, legality and discipline and science, culture and technology, raise the ideological thoughts, ethics and scientific, cultural, technological and professional qualities of workers and enable them to become labourers with ideals, ethics, education and discipline.
第九条 省、自治区、直辖市人民政府根据本行政区域失业人员数量和失业保险基金数额,报经国务院批准,可以适当调整本行政区域失业保险费的费率。    Article 9 People's governments of provinces, autonomous regions and municipalities directly under the Central Government, according to the number of the unemployed and the amount of unemployment insurance funds for their respective administrative areas, and after the approval by the State Council, may adjust properly rate of unemployment insurance premium.
第九条 工人的退休费、退职生活费,企业单位,由企业行政支付;党政机关、群众团体和事业单位,由退休、退职工人居住地方的县级民政部门另列预算支付。    Article 9 Retirement pension and subsistence allowance for workers are paid by the management of their former enterprises; for Party and government organs, mass organizations and public institutions, the county level civil affairs departments of their abode should be responsible for such payments from separate budgets.
第九条 县级以上人民政府卫生行政部门及其他有关行政部门应当依据各自的职责,监督用人单位严格遵守本条例和其他有关法律、法规的规定,加强作业场所使用有毒物品的劳动保护,防止职业中毒事故发生,确保劳动者依法享有的权利。    Article 9 The administrative departments for public health and other relevant departments of the people's governments at or above the county level shall, in light of their respective functions and responsibilities, supervise employing units’ strict compliance of the provisions of these Regulations and other relevant laws and regulations, strengthen the labor protection against the use of toxic substances in workplaces, prevent the occurrence of occupational poisoning accidents, and ensure the rights enjoyed by the workers according to law.
  第九条 劳动合同签订后,应当于一个月内到当地劳动行政部门鉴证。集体合同订立后,应报送当地劳动行政部门备案。    Article 9 The labor contracts should be appraised and verified at the local labor administrative department within one month after they are signed. The signed collective contracts should be reported to the local labor administrative departments for the record.
第九条 国务院劳动行政部门主管全国劳动工作。    Article 9 The labour administrative department of the State Council shall be in charge of the management of labour of the whole country.
第九条 国务院和县级以上地方人民政府应当制定职业病防治规划,将其纳入国民经济和社会发展计划,并组织实施。    Article 9 The State Council and the county-above people’s governments should map out the plans for occupational disease prevention that are woven into the national socioeconomic development plan, and should be responsible for the enforcement of the above plans.
