- 第十六条 建设项目的职业病防护设施所需费用应当纳入建设项目工程预算，并与主体工程同时设计，同时施工，同时投入生产和使用。 Article 16 The expense of the occupational-disease-prevention facilities for any Construction Project shall be counted into the engineering budget of the Construction Project, and the occupational-disease-prevention facilities should be designed, engineered and put into operation concurrently with the main body of the project.
- 第十六条 企业应当按照有关规定进行劳动工资统计，并向所在地区劳动行政部门、财政部门及统计部门和企业主管部门报送劳动工资统计报表。 Article 16 The FFEs should make account of the wages of the employees in line with relevant regulations and report the account to the local labor administrative department, financial department, statistics department and the enterprise's authoritative department in written form.
- 第十六条 劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。 Article 16. A labor contract shall become effective when the Unit and the laborer have reached a negotiated consensus thereon and each of them has signed or sealed the text of such contract.
- 第十六条省、自治区、直辖市人民政府可以根据本规定制定实施办法。? Article 16. The people's government of the provinces, autonomous regions and municipalities directly under the Central Government may formulate their respective measures for implementation in light of these Regulations.
- 第十六条 待业职工有下列情况之一的，待业保险机构停止发给待业救济金及其他费用： Article 16. The unemployment insurance institutions shall cease payment of unemployment relief funds and other expenses for staff and workers waiting for employment in any of the following circumstances:
- 第十六条 城镇企业事业单位应当及时为失业人员出具终止或者解除劳动关系的证明，告知其按照规定享受失业保险待遇的权利，并将失业人员的名单自终止或者解除劳动关系之日起７日内报社会保险经办机构备案。 Article 16Enterprises and institutions in cities and towns shall promptly issue certificates of termination or dissolution of employment relation for the unemployed, inform persons concerned of the rights to enjoy unemployment insurance benefits and submit name lists of the unemployed to social insurance agencies for the record within 7 days of the termination and dissolution of the employment relation.
- 第十七条 劳动合同应当具备以下条款： Article 17 A labor contract shall contain the clauses as follows:
- 第十七条 用人单位应当依照职业病防治法的有关规定，采取有效的职业卫生防护管理措施，加强劳动过程中的防护与管理。 Article 17 An employing unit shall, in accordance with the relevant provisions of the Law on the Prevention and Control of Occupational Diseases, take effective occupational health protection and management measures to strengthen the protection and management for working process.
- 第十七条 企业必须按照国家有关规定参加养老、失业、医疗、工伤、生育等社会保险，按照地方人民政府规定的标准，向社会保险机构按时、足额缴纳社会保险费。保险费应按照国家规定列支。职工个人也应按照有关规定缴纳养老保险费。 Article 17 FFEs must join in old-age, unemployment, medical, on-job injures, child-bearing and other social insurance for their employees in accordance with relevant State regulations, and pay full premium to the social insurance institutions in time according to the standards set by the local people's government. The insurance premium should be listed and paid in line with the State regulations. Employees should also pay their own old-age insurance premium in line with relevant regulations.
- 第十七条 企业、事业单位违反劳动法律、法规，侵犯职工合法权益，工会有权要求企业、事业单位行政方面或者有关部门认真处理。 Article 17 If an enterprise or public institution violates labour laws or statutory regulations, thereby infringing on the legal rights and interests of workers, the trade union shall have the right to request that the said enterprise or public institution's administrative authority or other relevant departments deal with the matter seriously.
- 第十七条 职业病危害预评价、职业病危害控制效果评价由依法设立的取得省级以上人民政府卫生行政部门资质认证的职业卫生技术服务机构进行。职业卫生技术服务机构所作评价应当客观、真实。 Article 17 The pre-assessment of the occupational-disease-inductive factors and the assessment of occupational-disease-prevention measures should be undertaken by occupational-health technical service organizations approved by the public health authorities under province-above people’s governments. The assessment organization should make objective and impartial assessment.
- 第十七条 劳动合同应当具备以下条款： Article 17. A labor contract shall specify the following clauses:
- 第十七条本规定由国务院劳动行政主管部门负责解释。? Article 17. The competent labor administrative institution under the State Council shall be responsible for the interpretation of these Regulations.
- 第十七条 国务院劳动行政主管部门负责全国企业职工待业保险的管理工作。 Article 17. The competent labor administrative institutions under the State Council shall be responsible for the management of unemployment insurance for the staff and workers waiting for employment from Enterprises throughout the entire nation.
- 第十七条 失业人员失业前所在单位和本人按照规定累计缴费时间满１年不足５年的，领取失业保险金的期限最长为１２个月； Article 17If the accumulative time period in which the units to which the unemployed belong before their unemployment and the unemployed themselves pay premiums is not less than one year but not more than five years, the maximum period of receiving unemployment insurance compensation is 12 months;
- 第十八条 工会帮助、指导职工与企业、事业单位行政方面签订劳动合同。 Article 18 A trade union shall assist and provide guidance to workers signing labour contracts with the enterprise or public institution's administrative authority.
- 第十八条 国家对从事放射、高毒等作业实行特殊管理。具体管理办法由国务院制定。 Article 18 Chinese Government will exercise special administrative measures to the radioactive and highly poisonous operations. The specific measures are to be enacted by the State Council.
- 第十八条 劳动合同对劳动报酬和劳动条件等标准约定不明确，引发争议的，用人单位与劳动者可以重新协商；协商不成的，适用集体合同规定；没有集体合同或者集体合同未规定劳动报酬的，实行同工同酬；没有集体合同或者集体合同未规定劳动条件等标准的，适用国家有关规定。 Article 18 In the case of any dispute due to any unspecified remunerations, work conditions and other criterions in the labor contract, employers and workers may have another negotiation. If there is no agreement upon the negotiations, the provisions of the collective contract shall be observed. If there is no collective contract or no such stipulation relating to the remuneration, the principle of equal pay for equal work shall be followed. If there is no collective contract or no such stipulation concerning the work conditions and other criterions in the collective contract, the relevant provisions of the state shall be abided by.
- 第十八条 用人单位应当与劳动者订立劳动合同，将工作过程中可能产生的职业中毒危害及其后果、职业中毒危害防护措施和待遇等如实告知劳动者，并在劳动合同中写明，不得隐瞒或者欺骗。 Article 18 The employing units shall sign labor contracts with their workers, truthfully inform the workers of the possible occupational poisoning hazards in the working process and the corresponding consequences, the safeguards against occupational poisoning hazards and the welfares, and clearly state such information in the labor contracts without any concealment or cheating.
- 第十八条 企业应当建立职工《劳动手册》和《养老保险手册》制度，记录职工的工龄、工资及养老、失业、工伤、医疗等社会保险费用的缴纳与支付情况。 Article 18 The FFEs should establish the system of ""Labor Manual"" and ""Old-Age Insurance Manual"" for the employees, recording the age, wage and the payment and spending of various social insurance like old-age, unemployment, on-job injuries and medical treatment of the employees.
- 第十八条 失业保险金的标准，按照低于当地最低工资标准、高于城市居民最低生活保障标准的水平，由省、自治区、直辖市人民政府确定。 Article 18 The standard for unemployment insurance compensation are to be set by people's governments of provinces, autonomous regions and municipalities directly under the Central Government at a level which is lower than the minimal local salary standard but higher than the minimal living security standard for urban residents.
- 第十八条 劳动合同对劳动报酬和劳动条件等标准约定不明确，引发争议的，用人单位与劳动者可以重新协商； Article 18. If a dispute arises due to the fact that the rate or standards for labor remuneration or working conditions, etc. are not explicitly specified in the labor contract, the Unit and the laborer may renegotiate.?
- 第十八条 地方待业保险机构为非营利性的事业单位，具体经办待业保险业务。 Article 18. The local unemployment insurance institutions shall be the non-profit institutions which shall specifically conduct the business relevant to unemployment insurance.
- 第十八条本规定自发布之日起施行。 Article 18. These Regulations shall be implemented as of the date of issuance.
- 第十九条 劳动合同应当以书面形式订立，并具备以下条款： Article 19 A labour contract shall be concluded in written form and contain the following Clauses:
