- 第十一条 工会各级组织按照民主集中制原则建立。 Article 11 Trade union organizations at the various levels shall be established in accordance with the principle of democratic centralism.
- 第十一条 用人单位未在用工的同时订立书面劳动合同，与劳动者约定的劳动报酬不明确的，新招用的劳动者的劳动报酬按照集体合同规定的标准执行；没有集体合同或者集体合同未规定的，实行同工同酬。 Article 11 Where any employer fails to conclude a labor contract in written form without specific remuneration as stipulated therebetween when it starts to use a worker, the remuneration to the new worker shall be consistent with the provisions of the collective contract. If there is no collective contract or no such stipulation in the collective contract, it shall follow the principle of equal pay for equal work.
- 第十一条 工人退休、退职后，不要继续留在全民所有制单位。 Article 11 Workers, having retired or resigned, should not remain in units of public ownership.

In the event that a Unit fails to conclude a written labor contract with a laborer when carrying out the employment formalities, and it is not clear what labor remuneration is or has been agreed upon with the laborer, the labor remuneration of the newly recruited laborer shall be decided pursuant to the standard specified in the collective contract.

- 第十二条 各地区、各部门、各单位要切实加强对工人退休、退职工作的领导。对应该退休、退职的工人，要做好深入细致的思想政治工作，动员他们退休、退职。退休、退职工作要分期分批进行。 Article 12 All districts, departments and units should earnestly provide more effective guidance to the work of resettling the retired and resigned workers. Penetrating and painstaking ideological work should be taken up among those who ought to retire or resign by persuading them to do so. Such work should be carried out in stages and in groups.
- 第十二条 任何单位和个人有权对违反本法的行为进行检举和控告。 Article 12 Any organization and individual are entitled to impeach and accuse any practices in violation of this Code.
- 第十二条 有下列情形之一的，企业在征求工会意见后，可以解除劳动合同，但应提前30日以书面形式通知职工本人： Article 12 FFEs may terminate the labor contracts after soliciting the opinion of the trade union in one of the following cases, but the employees should be notified in written form 30 days in advance:
- 第十二条 劳动合同分为固定期限劳动合同、无固定期限劳动合同和以完成一定工作任务为期限的劳动合同。 Article 12 Labor contracts are classified into labor contracts with a fixed period, labor contracts without a fixed period and labor contracts with a period to complete the prescribed work.
- 第十二条 劳动者就业，不因民族、种族、性别、宗教信仰不同而受歧视。 Article 12 Labourers shall not be discriminated against in employment, regardless of their ethnic community, race, sex, or religious belief.
- 第十二条 企业、事业单位、机关有会员二十五人以上的，可以建立基层工会委员会；会员不足二十五人的，选举组织员一人，组织会员开展活动。 Article 12 The trade union of an enterprise, public institution or government organ with 25 or more members may establish a primary trade union committee. If members number less than 25, one organizer may be elected to organize activities for members.
- 第十二条 使用有毒物品作业场所应当设置黄色区域警示线、警示标识和中文警示说明。 Article 12 The yellow area-warning lines, warning marks, and warning specifications in Chinese shall be displayed in the workplaces where toxic substances are used.
- 第十二条企业因生产经营发生重大变化,必须裁减职工的,对劳动合同制职工,经企业职工代表大会讨论同意,可以提前解除劳动合同,但是应当按照合同约定履行义务； Article 12. If the Enterprises have to reduce the number of the staff and workers due to great changes in production and operation, the Enterprises may, with respect to the contractual staff and workers, upon the deliberation and agreement at the congress of the representatives of the staff and workers, terminate contracts ahead of schedule, but shall perform their liabilities as agreed upon in such contracts.

- 第十二条 待业职工领取待业救济金的期限，根据待业职工待业前在企业连续工作时间确定： Article 12. The term during which staff and workers waiting for employment may receive unemployment relief funds shall be determined in accordance with the duration of their consecutive work in the Enterprises before their unemployment.
- 第十二条 失业保险基金收支的预算、决算，由统筹地区社会保险经办机构编制，经同级劳动保障行政部门复核、同级财政部门审核，报同级人民政府审批。 Article 12Budget and settlement of unemployment insurance funds shall be made by social insurance agencies in areas where overall planning is conducted, and submitted to people's governments at the same level for examination and approval upon check by administrative departments of labor security and verification by financial departments at the same level.
- 第十三条 新建、扩建、改建的建设项目和技术改造、技术引进项目（以下统称建设项目），可能产生职业中毒危害的，应当依照职业病防治法的规定进行职业中毒危害预评价，并经卫生行政部门审核同意； Article 13 Building projects, rebuilding projects, extension projects, technological transformation projects, and technology-introduction projects (hereinafter collectively referred to as the construction projects) likely to cause occupational poisoning hazards shall be subject to a pre-evaluation of the occupational poisoning hazards in accordance with the provisions of the Law on the Prevention and Control of Occupational Diseases, and shall pass the examination and obtain the approval of the administrative departments for public health.
- 第十三条 妇女享有与男子平等的就业权利。 Article 13 Females shall enjoy equal rights as males in employment.在录用职工时，除国家规定的不适合妇女的工种或者岗位外，不得以性别为由拒绝录用妇女或者提高对妇女的录用标准。
- 第十三条 固定期限劳动合同，是指用人单位与劳动者约定合同终止时间的劳动合同。 Article 13 Labor contracts with a fixed period are the labor contract in which the termination time of the contract has been stipulated by the employer and the worker.
- 第十三条 集体所有制企业、事业单位工人的退休、退职，由省、市、自治区革命委员会参照本办法，结合本地区集体所有制单位的实际情况，自行制定具体办法，其各项待遇，不得高于本办法所定的标准。 Article 13 Retirement or resignation of workers in collectively-owned enterprises or undertakings is taken care of by provincial, municipal or autonomous regional revolutionary committees, which in accordance with the actual conditions of collective units in the area should themselves work out the procedures. However, the benefits should not exceed those specified in the present regulations.
- 第十三条 职工患职业病或因工负伤并被确认丧失或部分丧失劳动能力的，职工患病在规定的医疗期内的，女职工在孕期、产期、哺乳期内的，用人单位不得解除劳动合同。 Article 13 The employer cannot terminate the labor contract when an employee is certified of losing or partly losing work ability due to occupational disease or injury at post, or in regular medical treatment for illness or an woman employee is pregnant or is enjoying maternity and lactation.
- 第十三条 基层工会、地方各级总工会、全国或者地方产业工会组织的建立，必须报上一级工会批准。 Article 13 The establishment of a primary trade union, local all-level federation of trade unions or a national or local specific industry trade union must be reported to the trade union organization at the next highest level for approval.
- 第十三条 产生职业病危害的用人单位的设立除应当符合法律、行政法规规定的设立条件外，其工作场所还应当符合下列职业卫生要求： Article 13 The occupational-disease-inductive Employer should adhere to the stipulations of laws and regulations with regard to the set-up of organizations and create the workplace up to the following occupational health requirements:
