- 第十三条 固定期限劳动合同,是指用人单位与劳动者约定合同终止时间的劳动合同。 Article 13. A “fixed term labor contract” is a labor contract whose termination date is agreed upon by the Unit and the laborer.

Various competent labor administrative institutions and the competent administrative departments of the Enterprises shall work hard at the social placement and adjustment for surplus staff and workers, and encourage and assist surplus staff and workers by organizing them to be re-employed and find new jobs on their own. The staff and workers adjusted between the Enterprises may be officially transferred, or perhaps temporarily transferred. With respect to the staff and workers who are temporarily transferred, their wages and welfare treatment during such temporary transfer period shall be decided by the agreement through consultations of relevant Enterprises.
- 第十三条 失业保险基金的财务制度和会计制度按照国家有关规定执行。 Article 13Financial systems and accounting systems for unemployment insurance funds shall be carried out according to relevant provisions of the State.
- 第十四条 过去有关工人退休、退职的规定与本办法不一致的,按本办法执行。 Article 14 In the event of discrepancies between the past and the present stipulations, the present regulations should prevail.

- 第十四条 用人单位应当按照国务院卫生行政部门的规定,向卫生行政部门及时、如实申报存在职业中毒危害项目。 Article 14 The employing units shall, in accordance with the provisions of the administrative department for public health under the State Council, promptly and truthfully declare the operation items which involve the occupational poisoning hazards to the administrative departments for public health.

If surplus staff and workers search for employment in society on their own because their Enterprises have difficulties in placing them, they shall be entitled to unemployment insurance according to law during the period of waiting for employment.
- 第十四条 待业职工医疗费的发放标准,由省、自治区、直辖市人民政府规定。 Article 14. The distribution standards of medical care expenses for the staff and workers waiting for employment shall be determined by the people's government of the province, autonomous region or municipality directly under the Central Government.
- 第十四条 具备下列条件的失业人员,可以领取失业保险金: Article 14Qualifications for the unemployed who may receive unemployment insurance compensation are as follows:
- 第十五条 工会主席、副主席任期未满时,不得随意调动其工作。因工作需要调动时,应当征得本级工会委员会和上一级工会的同意。 Article 15 During their terms of office, a trade union chairman and deputy chairman shall be prohibited from arbitrarily transferring to other positions. If work requirements necessitate such a move, approval shall be obtained from the respective level trade union committee and higher level trade union.
- 第十五条 新建、扩建、改建建设项目和技术改造、技术引进项目(以下统称建设项目)可能产生职业病危害的,建设单位在可行性论证阶段应当向卫生行政部门提交职业病危害预评价报告。卫生行政部门应当自收到职业病危害预评价报告之日起三十日内,作出审核决定并书面通知建设单位。未提交预评价报告或者预评价报告未经卫生行政部门审核同意的,有关部门不得批准该建设项目。 Article 15 For any new/expansion/modification projects, technical modification projects and technology introduction project (hereinafter referred to as “Construction Project”) that has high occupational disease exposure, the responsible organizations should, in the feasibility study phase, submit the report for pre-assessment of occupational-health harm to the competent public health authority, which, within thirty (30) days after the receipt of the report stated hereinabove, shall notify the said organization the written decision thereof. It is not allowed to approve any Construction Project that has not submitted the above pre-assessment report or has suffered the denial of the pre-assessment report by the competent public health authority.
- 第十五条 以完成一定工作任务为期限的劳动合同,是指用人单位与劳动者约定以某项工作的完成为合同期限的劳动合同。 Article 15 Labor contracts with a period to complete the prescribed work are the labor contracts in which the period of the contract shall be stipulated upon the completion of the prescribed work by the employer and the worker.
- 第十五条 企业必须以货币形式按时足额支付职工工资,每月至少要支付一次,并为职工代扣、代缴个人所得税。 Article 15 The FFEs must pay the employees cash wage in time and adequately at least once every month and withhold and pay the income tax for the employees.
- 第十五条 失业人员在领取失业保险金期间有下列情形之一的,停止领取失业保险金,并同时停止享受其他失业保险待遇: Article 15 Where any one of the following circumstances occur during the period of receiving unemployment insurance compensation, the unemployed shall stop receiving unemployment insurance compensation and shall be deprived of other unemployment insurance benefits:
- 第十五条 以完成一定工作任务为期限的劳动合同,是指用人单位与劳动者约定以某项工作的完成为合同期限的劳动合同。 Article 15. A labor contract whose term is based on the completion of a specific amount of work is a labor contract in which the Unit and the laborer have agreed that the completion of a certain job completes the term of the labor contract.
- 第十五条企业依照本规定兴办的独立核算企业安置的职工,按照国家有关规定纳入新办企业的职工人数和经济指标的统计范围。? Article 15. The staff and workers to be placed in the independent accounting enterprises established by the Enterprises in accordance with these Regulations shall be incorporated into the numbers of the staff and workers of newly established enterprises and the statistical scope of economic indicators in accordance with relevant regulations of the State.
- 第十五条 待业职工转业训练费和生产自救费,按照上年度筹集待业保险基金的一定比例提取。 Article 15. Vocational training expenses for job change and the expenses for self-help through production of the staff and workers waiting for employment shall be drawn at a due proportion with respect to the raising of the unemployment insurance fund of the last fiscal year.
- 第十六条 劳动合同由用人单位与劳动者协商一致,并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。 Article 16 A labor contract shall be concluded upon unanimity through consultation of the employer and the employee, and it shall become effective upon the signatures or seals on the text of the labor contract by the employer and the worker.
- 第十六条 从事使用高毒物品作业的用人单位,应当配备应急救援人员和必要的应急救援器材、设备,制定事故应急救援预案,并根据实际情况变化对应急救援预案适时进行修订,定期组织演练。 Article 16 An employing unit that engages in the operations in which high toxic substances are used shall assign emergency and first-aid personnel and equip itself with necessary emergency and first-aid devices and equipment, formulate emergency and first-aid pre-schemes, revise such pre-schemes in good time according to the practical situations, and organize rehearsals at regular intervals.
- 第十六条 全民所有制和集体所有制企业事业单位违反职工代表大会制度和其他民主管理制度,工会有权提出意见,保障职工依法行使民主管理的权利。 Article 16 If an enterprise or public institution owned by the whole people or a collectively owned enterprise or public institution violates the provisions of the worker representative assembly system or other democratic management systems, the trade union of the said unit shall have the right to put forward its views and ensure that the workers' rights to democratic management are implemented pursuant to the law.
