第一条 为了完善国有企业的劳动制度,保障待业职工的基本生活,维护社会安全,制定本规定。    Article 1. These Regulations are formulated in order to improve the labor system of State-owned enterprises, guarantee a minimum standard of living for the staff and workers waiting for employment, and maintain social stability.
第一条 为了完善劳动合同制度,明确劳动合同双方当事人的权利和义务,保护劳动者的合法权益,构建和发展和谐稳定的劳动关系,制定本法。    Article 1. This Law has been formulated to improve and perfect the labor contract system, to make explicit the rights and obligations of both parties of the labor contract, to protect the lawful rights and interests of laborers and to build and develop harmonious and stable labor relationships.
第十条 工人退休、退职后,家庭生活确实困难的,或多子女上山下乡、子女就业少的,原则上可以招收其一名符合招工条件的子女参加工作。    Article 10 After retirement or resignation, when workers truly have financial difficulties in their livelihood, or many of their children have been sent working in the rural or mountainous areas, or few of their children are employed , in principle one of their children may be employed as worker.
  第十条 劳动合同期满或双方约定的终止条件出现,劳动合同即行终止。经双方同意,可以续订劳动合同。    Article 10 Labor contracts terminate when their operation terms expire or conditions on which both parties agree to terminate the contracts appear. Labor contracts may also be extended under agreement of both parties.
第十条 中华全国总工会根据独立、平等、互相尊重、互不干涉内部事务的原则,加强同各国工会组织的友好合作关系。    Article 10 The All-China Federation of Trade Unions shall, in accordance with the principles of independence, equality, mutual respect and mutual non-interference in internal affairs, improve the relations of friendly cooperation held with the trade union organizations of various other nations.
第十条 各级人民政府应当加强对使用有毒物品作业场所职业卫生安全及相关劳动保护工作的领导,督促、支持卫生行政部门及其他有关行政部门依法履行监督检查职责,及时协调、解决有关重大问题;    Article 10 The people's governments at all levels shall strengthen the leadership over the occupational health and safety as well as the relevant labor protection in the workplaces where toxic substances are used, urge and support the administrative departments for public health and other relevant administrative departments to fulfill their functions and responsibilities of supervision and inspection according to law, and coordinate the work of solving relevant major problems in time;
第十条 县级以上人民政府卫生行政部门和其他有关部门应当加强对职业病防治的宣传教育,普及职业病防治的知识,增强用人单位的职业病防治观念,提高劳动者的自我健康保护意识。    Article 10 The public health authorities under county-above people’s governments and other competent authorities should boost the public awareness and education in occupational disease prevention, publicize the knowledge for occupational disease prevention, boost the Employer’s awareness of occupational disease prevention and the laborers’ awareness of the health protection.
第十条 国家通过促进经济和社会发展,创造就业条件,扩大就业机会。    Article 10 The State shall create conditions for employment and increase opportunities for employment by means of the promotion of economic and social development.
第十条 建立劳动关系,应当订立书面劳动合同。    Article 10 To establish a labor relationship shall conclude a labor contract in written form.
第十条 失业保险基金用于下列支出:    Article 10 Unemployment insurance funs shall be used for the following expenditure:
第十条职工可以申请辞职。经企业批准辞职的职工,在办理辞职手续时,企业应当按照国家有关规定发给一次性生活补助费。?    Article 10. Staff and workers may apply for resignation. When the staff and workers whose resignation was approved by the Enterprises complete their formalities of resignation, the Enterprises shall pay them an allowance in one lump sum in accordance with relevant regulations of the State.
第十条 待业保险基金的开支项目:    Article 10. The expenditure items of the unemployment insurance fund are as follows:
第十条 建立劳动关系,应当订立书面劳动合同。    Article 10. To establish a labor relationship, a written labor contract shall be signed.
第一百条 用人单位无故不缴纳社会保险费的,由劳动行政部门责令其限期缴纳;逾期不缴的,可以加收滞纳金。    Article 100 The employing unit that fails to pay social insurance premium without reason shall be ordered by the labour administrative department to pay within fixed period of time. If the unit still fails to make the payment beyond the time limit, an additional arrears payment may be demanded.
第一百零一条 用人单位无理阻挠劳动行政部门、有关部门及其工作人员行使监督检查权,打击报复举报人员的,由劳动行政部门或者有关部门处以罚款;构成犯罪的,对责任人员依法追究刑事责任。    Article 101 Where an employing unit unjustifiably obstructs the labour administrative department and other relevant departments as well as their functionaries from exercising the powers of supervision and inspection or retaliates informers, the labour administration department or other relevant departments shall impose fines upon the unit. If a crime is constituted, the person in charge shall be investigated for criminal responsibilities according to law.
第一百零二条 劳动者违反本法规定的条件解除劳动合同或者违反劳动合同中约定的保密事项,对用人单位造成经济损失的,应当依法承担赔偿责任。    Article 102 Labourers who revoke labour contracts in violation of the conditions specified in this Law or violate terms on secret-keeping matters agreed upon the labour contracts and thus caused economic losses to the employing unit shall be liable for compensation in accordance with the law.
第一百零三条 劳动行政部门或者有关部门的工作人员滥用职权、玩忽职守、徇私舞弊,构成犯罪的,依法追究刑事责任;不构成犯罪的,给予行政处分。    Article 103 The functionaries of the labour administrative department or other relevant departments who abuse their functions and powers, neglect their duties, and engage in malpractices for selfish ends, shall be investigated for criminal responsibilities according to law if a crime is constituted, or shall be given an administrative sanction if the offences do not yet constitute a crime.
第一百零四条 国家工作人员和社会保险基金经办机构的工作人员挪用社会保险基金,构成犯罪的,依法追究刑事责任。    Article 104 The functionaries of the State or the agencies in charge of social insurance funds who misappropriate the social insurance funds, shall be investigated for criminal responsibilities according to law if a crime is constituted.
第一百零五条 违反本法规定侵害劳动者合法权益,其他法律、行政法规已规定处罚的,依照该法律、行政法规的规定处罚。    Article 105 Where other laws or administrative rules and regulations have already specified punishments for the encroachment of the legitimate rights and interests of labourers that also violate the stipulations of this Law, punishments shall be given in accordance with the stipulations of those laws or administrative rules and regulations.
第一百零六条 省、自治区、直辖市人民政府根据本法和本地区的实际情况,规定劳动合同制度的实施步骤,报国务院备案。    Article 106 People’s governments of provinces, autonomous regions and municipalities directly under the Central Government shall work out the implementing measures for the labour contract system according to this Law and in light of their local conditions, and report the measures to the State Council for the record.
第一百零七条 本法自1995年1月1日起施行。    Article 107 This Law shall become effective as of January 1, 1995 (In case of discrepancy between the English translation and the original Chinese text, the Chinese text shall prevail.---Tr).
第十一条 地方各级人民政府应当采取措施,发展多种类型的职业介绍机构,提供就业服务。    Article 11 Local people’s governments at various levels shall take measures to develop various kinds of job—introduction agencies and provide employment services.
第十一条 用人单位的设立,应当符合有关法律、行政法规规定的设立条件,并依法办理有关手续,取得营业执照。    Article 11 The establishment of an employing unit shall meet the conditions provided for in the relevant laws and administrative regulations, the relevant formalities shall be gone through according to law, and the business license shall be obtained.
  第十一条 有下列情形之一的,企业或职工可以解除劳动合同:    Article 11 The FFEs or the employees may terminate the labor contracts in one of the following cases:
第十一条 有关防治职业病的国家职业卫生标准,由国务院卫生行政部门制定并公布。    Article 11 The public health authority under the State Council shall work out and promulgate the state standard of occupation health for the purpose of preventing against occupational diseases.
