- 第二十六条 向用人单位提供可能产生职业病危害的化学品、放射性同位素和含有放射性物质的材料的,应当提供中文说明书。说明书应当载明产品特性、主要成份、存在的有害因素、可能产生的危害后果、安全使用注意事项、职业病防护以及应急救治措施等内容。产品包装应当有醒目的警示标识和中文警示说明。贮存上述材料的场所应当在规定的部位设置危险物品标识或者放射性警示标识。 Article 26 The occupational-disease-inductive chemical, radioactive isotope and radioactive substances supplied to the Employer should be accompanied with the users instructions in Chinese that indicate the product characteristics, major ingredients, harmful factors and possible aftereffect, safety precautions, occupational prevention and contingency measures, etc. The package should bear the conspicuous warning mark and warning message in Chinese. The storage place of the above substances should be equipped with the warning mark for hazardous materials or radioactive materials at the specified spot.

- 第二十六条 本规定自一九九三年五月一日起施行。一九八六年七月十二日国务院发布的《国营企业职工待业保险暂行规定》同时废止。 Article 26. These Regulations shall be implemented as of May 1, 1993. The ""Interim Regulations on Unemployment Insurance for Staff and Workers of the State-owned Enterprises"" issued by the State Council on July 12, 1986 shall, at the same time, become void.
- 第二十七条 用人单位濒临破产进行法定整顿期间或者生产经营状况发生严重困难,确需裁减人员的,应当提前三十日向工会或者全体职工说明情况,听取工会或者职工的意见,经向劳动行政部门报告后,可以裁减人员。 Article 27 During the period of statutory consolidation when the employing unit comes to the brink of bankruptcy or runs deep into difficulties in production and management, and if reduction of its personnel becomes really necessary, the unit may make such reduction after it has explained the situation to the trade union or all of its staff and workers 30 days in advance, solicited opinions from them and reported to the labour administrative department.

- 第二十七条 劳动合同部分无效,不影响其他部分效力的,其他部分仍然有效。 Article 27 In case the invalidity of any part of a labor contract does not affect the validity of the other parts thereof, the other parts shall still remain valid.
- 第二十七条 任何单位和个人不得生产、经营、进口和使用国家明令禁止使用的可能产生职业病危害的设备或者材料。 Article 27 No organizations or individuals are allowed to produce, operate, import and use any equipment or materials prohibited by the state regulations owing to its harm to occupational health.
- 第二十七条 社会保险经办机构所需经费列入预算,由财政拨付。 Article 27 Outlays for social insurance agencies shall be listed into budget and appropriated from government finance.
- 第二十七条 从事使用高毒物品作业的用人单位应当设置淋浴间和更衣室,并设置清洗、存放或者处理从事使用高毒物品作业劳动者的工作服、工作鞋帽等物品的专用间。 Article 27 The employing units that engage in the operations in which high toxic substances are used shall set up shower compartments and changing cabins as well as specialized compartments to wash, store, or dispose of working clothes, shoes, caps, etc. of the workers engaging in the operations in which high toxic substances are used.
- 第二十七条 工会会同行政方面组织职工开展业余文化、技术学习和职工培训,提高职工的文化、业务素质;组织职工开展文娱、体育活动。 Article 27 Trade unions shall, in conjunction with administrative authorities, organize employees to undertake after-hours cultural and technical studies and occupational training so as to improve the cultural and occupational quality of the workers, as well as organize them to develop recreational and sports activities.
- 第二十七条 劳动合同部分无效,不影响其他部分效力的,其他部分仍然有效。 Article 27. If certain provisions of a labor contract are invalid and such invalidity does not affect the validity of the remaining provisions, the remaining provisions shall still remain valid.
- 第二十八条 任何单位和个人不得将产生职业病危害的作业转移给不具备职业病防护条件的单位和个人。不具备职业病防护条件的单位和个人不得接受产生职业病危害的作业。 Article 28 No organizations or individuals are allowed to transfer the occupational-disease-inductive operation to other organizations or individuals without qualified occupational-disease-prevention conditions, which, in turn, are prohibited from accepting the operation indicated hereinabove.
- 第二十八条 用人单位依据本法第二十四条、第二十六条、第二十七条的规定解除劳动合同的,应当依照国家有关规定给予经济补偿。 Article 28 The employing unit shall make economic compensations in accordance with the relevant provisions of the State if it revokes its labour contracts according to the stipulations in Article 24, Article 26, and Article 27 of this Law.
- 第二十八条 用人单位应当按照规定对从事使用高毒物品作业的劳动者进行岗位轮换。 Article 28 The employing units shall, according to the provisions, shift posts for the workers engaging in the operations in which high toxic substances are used.
- 第二十八条 县级以上各级人民政府制定国民经济和社会发展计划,省、自治区的人民政府所在地的市和经国务院批准的较大的市以上的人民政府研究起草法律或者法规、规章,对涉及职工利益的重大问题,应当听取同级工会的意见。 Article 28 The views of trade unions shall be listened to when national economic and social development plans formulated by the various levels of people's governments at county level or above and draft laws and statutory rules and regulations researched by municipalities under provincial and autonomous region people's governments and people's governments of relatively large municipalities approved by the State Council involve important issues relating to the rights and interests of workers.
- 第二十八条 劳动合同被确认无效,劳动者已付出劳动的,用人单位应当向劳动者支付劳动报酬。 Article 28 Where a labor contract is confirmed as invalid, if the worker has already worked for the employer, the employer shall pay remunerations to the worker.

- 第二十九条 用人单位与劳动者应当按照劳动合同的约定,全面履行各自的义务。 Article 29 Employers and workers shall fully perform their obligations respectively in accordance with the stipulations in the labor contract.
- 第二十九条 用人单位对采用的技术、工艺、材料,应当知悉其产生的职业病危害,对有职业病危害的技术、工艺、材料隐瞒其危害而采用的,对所造成的职业病危害后果承担责任。 Article 29 The Employer should gain an understanding of occupational-disease-inductive factors of the technology, process and material in internal use, and be liable for the occupational disease victims due to the illegal use of the occupational-disease-inductive technology, process and material without advising the concerned people of the occupational-disease-inductive factors.
