第六十五条 从事使用有毒物品作业的用人单位违反本条例的规定,在转产、停产、停业或者解散、破产时未采取有效措施,妥善处理留存或者残留高毒物品的设备、包装物和容器的,由卫生行政部门责令改正,处2万元以上10万元以下的罚款;    Article 65 An employing unit engaging in the operations in which toxic substances are used that, in violation of the provisions of these Regulations, fails to take effective measures to dispose of equipment, packages, and containers with residue of high toxic substances in case of changing the line of production, stopping business, or dissolution or bankruptcy shall be ordered to make corrections, and shall be imposed a fine of not less than 20,000 yuan but not more than 100,000 yuan by the administrative department for public health;
第六十五条 用人单位违反本法规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正,逾期不改正的,处五万元以上二十万元以下的罚款;情节严重的,责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令关闭:    Article 65 The Employer liable for any of the following violation against this Code will be ordered by the competent public health authority for correction within the specified period; failure to correct the violating practices within the specified period is subject to a fine between RMB 50,000 yuan and RMB 200,000 yuan; severe illegal practices are subject to the compulsory discontinuation of the occupational-disease-inductive operation or discontinuation/shut-up of the concerned organizations by the competent people’s government within the authority awarded by the State Council:
第六十五条 用人单位应当对未成年工定期进行健康检查。    Article 65 The employing unit shall provide regular physical examinations to juvenile workers.
第六十五条 被派遣劳动者可以依照本法第三十六条、第三十八条的规定与劳务派遣单位解除劳动合同。    Article 65. Dispatched laborers may dissolve their labor contracts with their dispatching Units pursuant to Article 36 and Article 38 hereof.
第六十六条 用人单位违反本条例的规定,有下列情形之一的,由卫生行政部门给予警告,责令限期改正,处5000元以上2万元以下的罚款;逾期不改正的,责令停止使用有毒物品作业,或者提请有关人民政府按照国务院规定的权限予以关闭;    Article 66 An employing unit that, in violation of the provisions of these Regulations, comes under one of the following circumstances shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 5,000 yuan but not more than 20,000 yuan by the administrative department for public health; if it fails to make corrections within the specified time limit, it shall be ordered to stop the operations in which toxic substances are used, or a request shall be made to the relevant people's government to shut it down within the limits of authority vested by the State Council;
第六十六条 劳务派遣一般在临时性、辅助性或者替代性的工作岗位上实施。    Article 66 The dispatched workers shall assume the temporary, assistant or substitute posts generally.
第六十六条 向用人单位提供可能产生职业病危害的设备、材料,未按照规定提供中文说明书或者设置警示标识和中文警示说明的,由卫生行政部门责令限期改正,给予警告,并处五万元以上二十万元以下的罚款。    Article 66 The individual or organization who supplies the Employer with the occupational-disease-inductive equipment and materials without furnishing the user manual in Chinese or the warning mark and warning message in Chinese is subject to the order of the competent public health authority for correction within the specified period in addition to a fine between RMB 50,000 yuan and RMB 200,000 yuan.
第六十六条 国家通过各种途径,采取各种措施,发展职业培训事业,开发劳动者的职业技能,提高劳动者素质,增强劳动者的就业能力和工作能力。    Article 66 The State shall take various measures through various channels to expand vocational training undertakings so as to develop professional skills of labourers, improve their qualities, and raise their employment capability and work ability.
第六十六条 劳务派遣一般在临时性、辅助性或者替代性的工作岗位上实施。    Article 66. The labor dispatching of laborers shall generally be practiced for temporary, auxiliary or substitute job positions. The specific job positions shall be prescribed by the State Council’s Labor Administration Department.
第六十七条 用人单位违反本条例的规定,有下列情形之一的,由卫生行政部门给予警告,责令限期改正,处2万元以上5万元以下的罚款;逾期不改正的,提请有关人民政府按照国务院规定的权限予以关闭:    Article 67 An employing unit that, in violation of the provisions of these Regulations, comes under one of the following circumstances shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 20,000 yuan but not more than 50,000 yuan by the administrative department for public health; if it fails to make corrections within the specified time limit, a request shall be made to the relevant people's government to shut it down within the limits of authority vested by the State Council:
第六十七条 用人单位不得设立劳务派遣单位向本单位或者所属单位派遣劳动者。    Article 67 No accepting entity or its subordinates may be dispatched any worker by any labor dispatch service provider that is established by it itself.
第六十七条 各级人民政府应当把发展职业培训纳入社会经济发展的规划,鼓励和支持有条件的企业、事业组织、社会团体和个人进行各种形式的职业培训。    Article 67 People’s governments at various levels shall incorporate the development of vocational training in the plans of social and economic development, encourage and support all enterprises, institutional organizations. Societies and individuals, where conditions permit, to sponsor all kinds of vocational training.
第六十七条 用人单位和医疗卫生机构未按照规定报告职业病、疑似职业病的,由卫生行政部门责令限期改正,给予警告,可以并处一万元以下的罚款;弄虚作假的,并处二万元以上五万元以下的罚款;对直接负责的主管人员和其他直接责任人员,可以依法给予降级或者撤职的处分。    Article 67 The Employer and the healthcare agency failing to report the occupational diseases and occupational-disease-like diseases as stipulated are subject to the order of the competent public health authority for correction within specified period in addition to a fine of RMB 10,000 yuan; any fraudulent act is subject to a fine between RMB 20,000 yuan to 50,000 yuan; the directly-responsible executives and other directly-responsible personnel are subject to such disciplinary practices as post-lowering or dismissal.
第六十七条 用人单位不得设立劳务派遣单位向本单位或者所属单位派遣劳动者。    Article 67. Units that use labor may not establish their own dispatching Units and dispatch workers to their own Unit or their subordinate Units.
第六十八条 用人单位违反本条例的规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正,处2万元以上5万元以下的罚款;    Article 68 An employing unit that, in violation of the provisions of these Regulations, commits any of the following acts shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 20,000 yuan but not more than 50,000 yuan by the administrative department for public health;
第六十八条 违反本法规定,有下列情形之一的,由卫生行政部门责令限期治理,并处五万元以上三十万元以下的罚款;情节严重的,责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令关闭:    Article 68 Any party liable for any of the following violation against this Code is subject to the order of the competent public health authority for correction within the specified period in addition to a fine between RMB 50,000 yuan and RMB 300,000 yuan; severe violating practices are subject to the compulsory discontinuation of the occupational-disease-inductive operation or shut-up of the occupational-disease-inductive organization by the competent people’s government within the authority granted by the State Council:
第六十八条 非全日制用工,是指以小时计酬为主,劳动者在同一用人单位一般平均每日工作时间不超过四小时,每周工作时间累计不超过二十四小时的用工形式。    Article 68 Non-full-time labor refers to a form of labor for which the remuneration is generally calculated on hourly basis, the average working hours of a worker per day shall not be more than four hours and the cumulative working hours per week for the same employer shall not be more than 24 hours.
第六十八条 用人单位应当建立职业培训制度,按照国家规定提取和使用职业培训经费,根据本单位实际,有计划地对劳动者进行职业培训。从事技术工种的劳动者,上岗前必须经过培训。    Article 68 The employing unit shall establish a system for vocational training, raise and use funds for vocational training in accordance with the provisions of the State, and provide labourers with vocational training in a planned way and in the light of the actual situation of the unit. Labourers to be engaged in technical work must receive pre-job training before taking up their posts.
第六十八条 非全日制用工,是指以小时计酬为主,劳动者在同一用人单位一般平均每日工作时间不超过四小时,每周工作时间累计不超过二十四小时的用工形式。    Article 68. The term “non-full time labor use” means a form of labor for which the compensation is chiefly calculated by the hour and where the laborer generally averages no more than four hours of work per day and no more than an aggregate twenty-four hours of work per week in the same Unit.
第六十九条 用人单位违反本条例的规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正,处5000元以上2万元以下的罚款;    Article 69 An employing unit that, in violation of the provisions of these Regulations, commits any of the following acts shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 5,000 yuan but not more than 20,000 yuan by the administrative department for public health;
第六十九条 生产、经营或者进口国家明令禁止使用的可能产生职业病危害的设备或者材料的,依照有关法律、行政法规的规定给予处罚。    Article 69 Any one engaged in the production, operation or import of the occupational-disease-inductive equipment or material prohibited by Chinese Government is subject to the penalties as stipulated by applicable laws and administrative regulations.
第六十九条 非全日制用工双方当事人可以订立口头协议。    Article 69 Both parties that use non-full-time labor may sign an oral agreement.
第六十九条 国家确定职业分类,对规定的职业制定职业技能标准,实行职业资格证书制度,由经过政府批准的考核鉴定机构负责对劳动者实施职业技能考核鉴定。    Article 69 The State shall determine occupational classification, set up professional skill standards for the occupations classified, and practise a system of vocational qualification certificates. Examination and verification organizations authorized by the government are in charge of the examination and verification of the professional skills of labourers.
第六十九条 非全日制用工双方当事人可以订立口头协议。    Article 69. Agreements for non-full time labor may be concluded orally.
第六条 城镇企业事业单位按照本单位工资总额的百分之二缴纳失业保险费。    Article 6Enterprises and institutions in cities and towns shall pay unemployment insurance premium at a rate of 2% on the basis of their total amount of salaries.
