- 第五十七条 卫生行政部门的工作人员有下列行为之一，导致职业中毒事故发生的，依照刑法关于滥用职权罪、玩忽职守罪或者其他罪的规定，依法追究刑事责任； Article 57 The functionaries of the administrative departments for public health who commit any of the following acts, thus causing any occupational poisoning accident, shall be investigated for criminal liability according to the provisions of the criminal law on the crime of abuse of power, the crime of neglect of duty or other crimes;
- 第五十七条 国家建立伤亡事故和职业病统计报告和处理制度。县级以上各级人民政府劳动行政部门、有关部门和用人单位应当依法对劳动者在劳动过程中发生的伤亡事故和劳动者的职业病状况，进行统计、报告和处理。 Article 57 The State shall establish a system for the statistics, reports and dispositions of accidents of injuries and deaths, and cases of occupational diseases. The labour administrative departments and other relevant departments of the people’s governments at or above the county level and the employing unit shall, according to law, compile statistics, report and dispose of accidents of injuries and deaths that occurred in the process of their work and cases of occupational diseases.
- 第五十七条 劳务派遣单位应当依照公司法的有关规定设立，注册资本不得少于五十万元。 Article 57. Dispatching Units shall be established in accordance with the relevant provisions of the Company Law and shall have registered capital of no less than RMB ￥500,000.
- 第五十八条 用人单位违反本条例的规定，有下列情形之一的，由卫生行政部门给予警告，责令限期改正，处１０万元以上５０万元以下的罚款； Article 58 An employing unit that, in violation of the provisions of these Regulations, comes under one of the following circumstances shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 100,000 yuan but not more than 500,000 yuan by the administrative department for public health;
- 第五十八条 劳务派遣单位是本法所称用人单位，应当履行用人单位对劳动者的义务。 Article 58 Labor dispatch service providers are employers as mentioned in this Law and shall perform obligations toward workers.
- 第五十八条 职业卫生监督执法人员依法执行职务时，应当出示监督执法证件。 Article 58 The persons engaged in occupational health supervision/law-enforcement should hold the supervision/law-enforcement certificate when performing their legal duties.
- 第五十八条 国家对女职工和未成年工实行特殊劳动保护。 Article 58 The State shall provide female workers and juvenile workers with special protection. “Juvenile workers” hereby refer to labourers at the age of 16 but not 18 yet.
- 第五十八条 劳务派遣单位是本法所称用人单位，应当履行用人单位对劳动者的义务。 Article 58. Dispatching Units are laborer employing Units as mentioned in this Law and shall perform a Unit’s obligations toward its laborers.

- 第五十九条 禁止安排女职工从事矿山井下、国家规定的第四级体力劳动强度的劳动和其他禁忌从事的劳动。 Article 59 It is prohibited to arrange female workers to engage in work down the pit of mines, or work with Grade IV physical labour intensity as stipulated by the State, or other work that female workers should avoid.
- 第五十九条 职业卫生监督执法人员依法执行职务时，被检查单位应当接受检查并予以支持配合，不得拒绝和阻碍。 Article 59 The inspected organizations should accept the inspection by the occupational health supervision/law-enforcement personnel and coordinate with the personnel therein. It is not allowed for the inspected organization to refuse and hinder the inspection.
- 第五十九条 劳务派遣单位派遣劳动者应当与接受以劳务派遣形式用工的单位（以下称用工单位）订立劳务派遣协议。 Article 59 When dispatching workers, a labor dispatch service provider shall conclude labor dispatch agreements with the entity that accepts the workers in a labor dispatch manner (hereinafter referred to as the accepting entity).
- 第五十九条 劳务派遣单位派遣劳动者应当与接受以劳务派遣形式用工的单位（以下称用工单位）订立劳务派遣协议。 Article 59. When dispatching laborers, dispatching Units shall enter into dispatching agreements with the Units to which the laborer is dispatched.

- 第六条 退休工人易地安家的，一般由原单位一次发给一百五十元的安家补助费。从大中城市到农村安家的，发给三百元。 Article 6 Retired workers, who resettle elsewhere, are in general paid a lump sum of 150 yuan by their former units as resettlement subsidy, and those who move from large and medium-sized cities to resettle in the rural areas are paid 300 yuan.
- 第六条 用人单位必须依法参加工伤社会保险。 Article 6 The Employer shall effect the policy covering the work-related injuries according to applicable laws.
- 第六条 企业招聘职工时，应当在中国境内招聘中方职工；确需招聘外籍及台湾、香港、澳门地区人员的，必须按照国家有关规定，经当地劳动行政部门批准，并办理就业证等有关手续。 Article 6 The FFEs should employ their Chinese employees within China; whereas there is a real need to employ foreign personnel or personnel from Taiwan, Hong Kong and Macao regions, the employment should be made in line with relevant State regulations and with the approval of the local labor administrative department, and through relevant formalities such as the acquirement of employment certificates.
- 第六条 工会应当帮助、指导劳动者与用人单位依法订立和履行劳动合同，并与用人单位建立集体协商机制，维护劳动者的合法权益。 Article 6 The labor union shall assist and direct the workers to conclude and perform labor contracts with the employers and establish a collective negotiation mechanism with employers in order to safeguard the legitimate rights and interests of the workers.
- 第六条 国家鼓励研制、开发、推广、应用有利于预防、控制、消除职业中毒危害和保护劳动者健康的新技术、新工艺、新材料；限制使用或者淘汰有关职业中毒危害严重的技术、工艺、材料；加强对有关职业病的机理和发生规律的基础研究，提高有关职业病防治科学技术水平。 Article 6 The State encourages the research, development, popularization and application of the new technologies, new techniques and new materials that are beneficial to the prevention, control and elimination of occupational poisoning hazards and to the protection of workers' health, restricts the use of, or obsoletes, the technologies, techniques and materials that may cause serious occupational poisoning hazards, and strengthens the basic research on the mechanism and regular rules for occupational diseases so as to improve the level of science and technology in the prevention and control of occupational diseases.
- 第六条 国家提倡劳动者参加社会义务劳动，开展劳动竞赛和合理化建议活动，鼓励和保护劳动者进行科学研究、技术革新和发明创造，表彰和奖励劳动模范和先进工作者。 Article 6 The State shall advocate the participation of labourers in social voluntary labour and the development of their labour competitions and activities of forwarding rational proposals, encourage and protect the scientific research and technical renovation engaged by labourers, as well as their inventions and creations; and commend and award labour models and advanced workers.
- 第六条 工会在维护全国人民总体利益的同时，维护职工的合法权益。 Article 6 While upholding the overall rights and interests of the whole nation, trade unions shall, at the same time, safeguard the rights and interests of workers.
- 第六条 工会应当帮助、指导劳动者与用人单位依法订立和履行劳动合同，并与用人单位建立集体协商机制，维护劳动者的合法权益。 Article 6. Labor unions shall assist and guide laborers in the conclusion of labor contracts with their Units and the performance thereof in accordance with the law, and shall safeguard the legitimate rights and interests of laborers.
- 第六条企业组织本企业富余职工依法兴办的独立核算企业,可以承担本企业中原由外单位承包的技术改造或者劳务项目。? Article 6. The independent accounting enterprises established according to law by surplus staff and workers of their Enterprises may assume the technical renovation or labor projects of their Enterprises originally contracted by other units.
- 第六条 企业缴纳的待业保险费转入企业所在地的待业保险机构在银行开设的“待业保险基金专户”，专项储存，专款专用，任何部门、单位和个人不得挪用。 Article 6. Unemployment insurance premiums paid by the Enterprises shall be transferred into ""unemployment insurance fund special accounts"" opened in banks by insurance institutions in the locales of the Enterprises, deposited into banks as special deposits, and spent for authorized purposes only. No institutions, units or individuals shall be allowed to embezzle these funds.
- 第六十条 劳务派遣单位应当将劳务派遣协议的内容告知被派遣劳动者。 Article 60 A labor dispatch service provider shall notify the dispatched workers concerning the content of the dispatch agreements.
