- 第六十条 用人单位违反本条例的规定，有下列情形之一的，由卫生行政部门给予警告，责令限期改正，处５万元以上３０万元以下的罚款；逾期不改正的，提请有关人民政府按照国务院规定的权限予以关闭； Article 60 An employing unit that, in violation of the provisions of these Regulations, comes under any of the following circumstances shall be given a warming and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less than 50,000 yuan but not more than 300,000 yuan by the administrative department for public health; if it fails to make corrections within the specified time limit, a request shall be made to the relevant people's government to shut it down within the limits of authority vested by the State Council;
- 第六十条 不得安排女职工在经期从事高处、低温、冷水作业和国家规定的第三级体力劳动强度的劳动。 Article 60 Female workers during their menstrual periods shall not be arranged to engaged in work high above the ground, under low temperature, or in cold water or work with Grade III physical labour intensity as stipulated by the State.
- 第六十条 卫生行政部门及其职业卫生监督执法人员履行职责时，不得有下列行为： Article 60 The public health agencies and the persons engaged in occupational health supervision/law-enforcement are prohibited from the following practices when performing their duties:
- 第六十条 劳务派遣单位应当将劳务派遣协议的内容告知被派遣劳动者。 Article 60. Dispatching Units have an obligation to inform the dispatched laborers of the relevant content of the dispatching agreement.
- 第六十一条 从事使用高毒物品作业的用人单位违反本条例的规定，有下列行为之一的，由卫生行政部门给予警告，责令限期改正，处５万元以上２０万元以下的罚款；逾期不改正的，提请有关人民政府按照国务院规定的权限予以关闭； Article 61 An employing unit engaging in the operations in which high toxic substances are used that, in violation of the provisions of these Regulations, comes under one of the following circumstances shall be given a warning and ordered to make corrections within a specified time limit, and shall be imposed a fine of not less 50,000 yuan but not more than 200,000 yuan by the administrative department for public health; if it fails to make corrections within the specified time limit, a request shall be made to the relevant people's government to shut it down within the limits of authority vested by the State Council;
- 第六十一条 不得安排女职工在怀孕期间从事国家规定的第三级体力劳动强度的劳动和孕期禁忌从事的劳动。对怀孕七个月以上的女职工，不得安排其延长工作时间和夜班劳动。 Article 61 Female workers during their pregnancy shall not be arranged to engage in work with Grade III physical labour intensity as stipulated by the State or other work that they should avoid in pregnancy. Female workers pregnant for seven months or more shall not be arranged to extend their working hours or to work night shifts.
- 第六十一条 职业卫生监督执法人员应当依法经过资格认定。 Article 61 The persons engaged in occupational health supervision/law-enforcement should gain the qualification approval.
- 第六十一条 劳务派遣单位跨地区派遣劳动者的，被派遣劳动者享有的劳动报酬和劳动条件，按照用工单位所在地的标准执行。 Article 61 Where a labor dispatch service provider designates a worker to an accepting entity in another region, the worker's remuneration and working conditions shall be subject to relevant standards of the [] where the accepting entity is situated.
- 第六十一条 劳务派遣单位跨地区派遣劳动者的，被派遣劳动者享有的劳动报酬和劳动条件，按照用工单位所在地的标准执行。 Article 61. If a dispatching Unit dispatches a laborer to a Unit in another region, the laborer’s working conditions and labor remuneration shall be in accordance with the standards and rates of the region where the said Unit is located.
- 第六十二条 女职工生育享受不少于九十天的产假。 Article 62 After childbirth, female workers shall be entitled to no less than ninety days of maternity leaves with pay.
- 第六十二条 建设单位违反本法规定，有下列行为之一的，由卫生行政部门给予警告，责令限期改正；逾期不改正的，处十万元以上五十万元以下的罚款；情节严重的，责令停止产生职业病危害的作业，或者提请有关人民政府按照国务院规定的权限责令停建、关闭： Article 62 The construction organization liable for one of the following practices will be warned by the competent public health authority for correction within the specified period; failure to correct the concerned practices within the specified period is subject to a fine between RMB 100,000 yuan and RMB 500,000 yuan; severe illegal practices are subject to the compulsory discontinuation of the occupational-disease-inductive operation or discontinuation/shut-up of the operation by the competent people’s government according to the authority granted by the State Council:
- 第六十二条 用工单位应当履行下列义务： Article 62 The following obligations shall be performed by an accepting entity:
- 第六十二条 在作业场所使用国家明令禁止使用的有毒物品或者使用不符合国家标准的有毒物品的，由卫生行政部门责令立即停止使用，处５万元以上３０万元以下的罚款； Article 62 Whoever uses in any workplaces toxic substances that are explicitly prohibited by the State or that fail to meet the national standards shall be ordered to stop the use of such substances forthwith, and shall be imposed a fine of not less than 50,000 yuan but not more than 300,000 yuan by the administrative department for public health;
- 第六十二条 用工单位应当履行下列义务： Article 62. Units to which laborers are dispatched shall perform the following obligations:
- 第六十三条 用人单位违反本条例的规定，有下列行为之一的，由卫生行政部门给予警告，责令限期改正；逾期不改正的，处５万元以上３０万元以下的罚款； Article 63 An employing unit that, in violation of the provisions of these Regulations, commits any of the following acts shall be given a warning and ordered to make corrections within a specified time limit by the administrative department for public health; if it fails to make corrections within the specified time limit, a fine of not less than 50,000 yuan but not more than 300,000 yuan shall be imposed upon it;
- 第六十三条 不得安排女职工在哺乳未满一周岁的婴儿期间从事国家规定的第三级体力劳动强度的劳动和哺乳期禁忌从事的其他劳动，不得安排其延长工作时间和夜班劳动。 Article 63 Female workers during the period of breast-feeding their babies less than one year old shall not be arranged to engage in work with Grade III physical labour intensity as stipulated by the State or other labour that they should avoid during their breast-feeding period, or to extend their working hours or to work night shifts.
- 第六十三条 被派遣劳动者享有与用工单位的劳动者同工同酬的权利。 Article 63 The dispatched workers shall enjoy the right to obtain the same pay as that received by workers of the accepting entity for the equal work.
- 第六十三条 违反本法规定，有下列行为之一的，由卫生行政部门给予警告，责令限期改正；逾期不改正的，处二万元以下的罚款： Article 63 The organization or individual liable for one of the following practices will be warned by the competent public health authority for correction within the specified period; failure to correct the concerned practices within the specified period is subject to a fine of RMB 20,000 yuan:
- 第六十三条 被派遣劳动者享有与用工单位的劳动者同工同酬的权利。 Article 63. Dispatched laborers shall have the right to receive equal pay for equal work as other laborers in the Unit.
- 第六十四条 不得安排未成年工从事矿山井下、有毒有害、国家规定的第四级体力劳动强度的劳动和其他禁忌从事的劳动。 Article 64 No juvenile workers shall be arranged to engage in work down the pit of mines, work that is poisonous or harmful, work with Grade IV physical labour intensity as stipulated by the State, or other work that they should avoid.
- 第六十四条 被派遣劳动者有权在劳务派遣单位或者用工单位依法参加或者组织工会，维护自身的合法权益。 Article 64 The dispatched workers are entitled to join the labor union or to organize such unions in the labor dispatch service provider or in the accepting entity according to law, in order to safeguard their lawful rights and interests.
- 第六十四条 用人单位违反本法规定，有下列行为之一的，由卫生行政部门责令限期改正，给予警告，可以并处二万元以上五万元以下的罚款： Article 64 The Employer liable for one of the following practices will be warned by the competent public health authority for correction within the specified period in addition to a fine between RMB 20,000 yuan and RMB 50,000 yuan:
- 第六十四条 违反本条例的规定，未经许可，擅自从事使用有毒物品作业的，由工商行政管理部门、卫生行政部门依据各自职权予以取缔； Article 64 Whoever, in violation of the provisions of these Regulations, engages in the operations in which toxic substances are used without authorization shall be banned by the administrative department for industry and commerce and the administrative department for public health ex officio;
- 第六十四条 被派遣劳动者有权在劳务派遣单位或者用工单位依法参加或者组织工会，维护自身的合法权益。 Article 64. Dispatched laborers have the right to lawfully join the labor union of their dispatching Unit or the Unit to which they have been dispatched or to organize such unions, so as to protect their own legal rights and interests.
- 第六十五条 被派遣劳动者可以依照本法第三十六条、第三十八条的规定与劳务派遣单位解除劳动合同。 Article 65 A dispatched worker may discharge the labor contract with the labor dispatch service provider as prescribed in Articles 36 and 38 of this Law.
