- 第五十二条 过去颁布的海上交通安全法规与本法相抵触的，以本法为准。 Article 52. In cases of conflict between laws and regulations pertaining to maritime traffic safety hitherto promulgated and this Law, this Law shall prevail.
- 第五十三条海事强制令不受当事人之间关于该海事请求的诉讼管辖协议或者仲裁协议的约束。 Article 53 A maritime injunction shall not be restrained by a jurisdiction agreement or an arbitration agreement relating to the maritime claim as agreed upon between the parties.
- 第五十三条对聚众拦截列车或者聚众冲击铁路行车调度机构的，铁路职工有权制止；不听制止的，公安人员现场负责人有权命令解散；拒不解散的，公安人员现场负责人有权依照国家有关规定决定采取必要手段强行驱散，并对拒不服从的人员强行带离现场或者予以拘留。 Article 53 Any railway worker shall have the right to stop persons who have gathered up to intercept a train, or to assault a railway traffic control office. The responsible public security personnel on site shall have the right to order those persons who refuse to stop such action to disperse; and if such a demand is refused, the responsible public security personnel on site shall, according to relevant regulations established by the State, choose to force them to disperse by necessary means. Those who refuse to obey shall be taken away from the site by force or detained.
- 第五十三条 如果双方当事人有调解愿望或一方当事人有调解愿望并经仲裁庭征得另一方当事人同意的,仲裁庭可以在仲裁程序进行过程中对其审理的案件进行调解。 Article 53 If both parties have a desire for conciliation or one party so desires and the other party agrees to it when consulted by the arbitration tribunal, the arbitration tribunal may conciliate the case under its cognizance in the process of arbitration.
- 第五十三条承运人在舱面上装载货物，应当同托运人达成协议，或者符合航运惯例，或者符合有关法律、行政法规的规定。 Article 53 In case the carrier intends to ship the goods on deck, he shall come into an agreement with the shipper or comply with the custom of the trade or the relevant laws or administrative rules and regulations.
- 第五十三条本法所称民用机场，是指专供民用航空器起飞、降落、滑行、停放以及进行其他活动使用的划定区域，包括附属的建筑物、装置和设施。 Article 53 The civil airport as referred to in this Law means a defined area, including any subsidiary buildings, installations and equipment, intended to be used for the takeoff, landing, taxiing, parking and other activities of civil aircraft.
- 第五十三条造成公路损坏的，责任者应当及时报告公路管理机构，并接受公路管理机构的现场调查。 Article 53 Those who have caused damages to roads should timely report the cases concerned to and accept on-the-spot investigations by road administrative organizations.
- 第五十三条 本法自一九八四年一月一日起施行。 Article 53. This Law shall go into effect on January 1, 1984.
- 第五十四条海事请求人申请海事强制令，应当向海事法院提交书面申请。 Article 54 A maritime claimant applying for a maritime injunction shall submit a written application to a maritime court.
- 第五十四条对哄抢铁路运输物资的，铁路职工有权制止，可以扭送公安机关处理；现场公安人员可以予以拘留。 Article 54 Any railway worker shall have the right to stop those persons who try to start a riot and rob goods and materials being transported on railways and may seize them and hand them over to the public security authorities; the public security personnel on site may detain them.
- 第五十四条任何单位和个人未经县级以上地方人民政府交通主管部门批准，不得在公路用地范围内设置公路标志以外的其他标志。 Article 54 No unit or individual is allowed to erect signs other than road signs within the land used by roads without the approval of the the transportation departments of local people's governments above the county level.
- 第五十四条 仲裁庭可以按照其认为适当的方式进行调解。 Article 54 The arbitration tribunal may conciliate cases in the manner it considers appropriate.
- 第五十四条民用机场的建设和使用应当统筹安排、合理布局，提高机场的使用效率。 Article 54 The construction and utilization of civil airports shall be subject to overall arrangement and rational distribution, and the efficiency of airport utilization shall be raised.
- 第五十四条货物的灭失、损坏或者迟延交付是由于承运人或者承运人的受雇人、代理人的不能免除赔偿责任的原因和其他原因共同造成的，承运人仅在不能免除赔偿责任的范围内负赔偿责任； Article 54 Where loss or damage or delay in delivery has occurred from causes from which the carrier or his servant or agent is not entitled to exoneration from liability, together with another cause, the carrier shall be liable only to the extent that the loss, damage or delay in delivery is attributable to the causes from which the carrier is not entitled to exoneration from liability;
- 第五十五条海事法院受理海事强制令申请，可以责令海事请求人提供担保。 Article 55 A maritime court accepting an application for a maritime injunction may order the maritime claimant to provide guarantee.
- 第五十五条在列车内，寻衅滋事，扰乱公共秩序，危害旅客人身、财产安全的，铁路职工有权制止，铁路公安人员可以予以拘留。 Article 55 Any railway worker shall have the right to stop any person who is picking quarrels and stirring up troubles on board a train causing public disorder or jeopardizing the physical being or property of other passengers; the railway security personnel may detain such person.
- 第五十五条在公路上增设平面交叉道口，必须按照国家有关规定经过批准，并按照国家规定的技术标准建设。 Article 55 The addition of road crossings should get prior approval according to the related regulations of the State and the crossings should be built according to the State prescribed standards.
- 第五十五条货物灭失的赔偿额，按照货物的实际价值计算；货物损坏的赔偿额，按照货物受损前后实际价值的差额或者货物的修复费用计算。 Article 55 The amount of indemnity for the loss of the goods shall be calculated on the basis of the actual value of the goods so lost, while that for the damage to the goods shall be calculated on the basis of the difference between the values of the goods before and after the damage, or on the basis of the expenses for the repair.
- 第五十五条 仲裁庭在进行调解的过程中,任何一方当事人提出终止调解或仲裁庭认为已无调解成功的可能时,应停止调解。 Article 55 The arbitration tribunal shall terminate conciliation when one of the parties requests a termination of conciliation or when the arbitration tribunal believes that further efforts to conciliate will be futile.
- 第五十五条民用机场建设规划应当与城市建设规划相协调。 Article 55 The civil airport construction plan shall be coordinated with city construction planning.
- 第五十六条除公路防护、养护需要的以外，禁止在公路两侧的建筑控制区内修建建筑物和地面构筑物；需要在建筑控制区内埋设管线、电缆等设施的，应当事先经县级以上地方人民政府交通主管部门批准。 Article 56 Except as required by road protection and maintenance, it is forbidden to construct buildings or ground structures within the control areas on both side of roads. Necessary layings of pipelines and cables and other facilities within the control areas of roads, prior approvals of the transportation departments of local people's governments above the county level should be conveyed.
- 第五十六条在车站和旅客列车内，发生法律规定需要检疫的传染病时，由铁路卫生检疫机构进行检疫；根据铁路卫生检疫机构的请求，地方卫生检疫机构应予协助。 Article 56 If a certain kind of infectious disease which demands quarantine as stated in legal provisions is discovered in a railway station or on board a passenger train, the railway sanitation and quarantine authority shall carry out the necessary quarantine process; the local sanitation and quarantine authority shall render assistance to the former upon request.
- 第五十六条 在仲裁庭进行调解的过程中,双方当事人在仲裁庭之外达成和解的,应视为是在仲裁庭调解下达成的和解。 Article 56 If the parties have reached an amicable settlement outside the arbitration tribunal in the course of conciliation conducted by the arbitration tribunal, such settlement shall be considered as one which has been reached through conciliation by the arbitration tribunal.
- 第五十六条承运人对货物的灭失或者损坏的赔偿限额，按照货物件数或者其他货运单位数计算，每件或者每个其他货运单位为６６６．６７计算单位，者按照货物毛重计算，每公斤为２计算单位，以二者中赔偿限额较高的为准。但是，托运人在货物装运前已经申报其性质和价值，并在提单中载明的，或者承运人与托运人已经另行约定高于本条规定的赔偿限额的除外。 Article 56 The carrier's liability for the loss of or damage to the goods shall be limited to an amount equivalent to 666.67 Units of Account per package or other shipping unit, or 2 Units of Account per kilogramme of the gross weight of the goods lost or damaged, whichever is the higher, except where the nature and value of the goods had been declared by the shipper before shipment and inserted in the bill of lading, or where a higher amount than the amount of limitation of liability set out in this Article had been agreed upon between the carrier and the shipper.
- 第五十六条新建、改建和扩建民用机场，应当符合依法制定的民用机场布局和建设规划，符合民用机场标准，并按照国家规定报经有关主管机关批准并实施。 Article 56 The construction, modification and extension of a civil airport shall conform to the plan of civil airport distribution and construction formulated according to law and to the standards of civil airport, and shall be subject to the approval of the competent authority concerned and implemented in accordance with State regulations.
