Where the supervisory personnel are found to have abused powers or bend the law for personal gains or to be guilty of dereliction or leaking classified information, they should be punished with administrative sanctions; criminal liability shall be affixed through the process of law if there is breach of the criminal code.第四十七条 在常务委员会会议期间，省、自治区、直辖市、自治州、设区的市的人民代表大会常务委员会组成人员五人以上联名，县级的人民代表大会常务委员会组成人员三人以上联名，可以向常务委员会书面提出对本级人民政府、人民法院、人民检察院的质询案。质询案必须写明质询对象、质询的问题和内容。 Article 47 A group of five or more standing committee members of the people's congress of a province, autonomous region, municipality directly under the Central Government, autonomous prefecture, or a city divided into districts or a group of three or more standing committee members of a people's congress at the county level may, when the standing committee is in session, submit to the standing committee written proposals for addressing questions to the people's government, People's Court or People's Procuratorate at the corresponding level. Where there is infringement upon and damage to the legitimate interests of citizens, legal persons, or other organizations as a result of the supervisory organ or personnel illegally exercising their powers, compensations shall be made in accordance with law.第四十七条 除法律规定终局的复议外，申请人对复议决定不服的，可以在收到复议决定书之日起十五日内，或者法律、法规规定的其他期限内向人民法院起诉。 Article 47. With the exception that the reconsideration is final as provided for by law, an applicant who does not accept a reconsideration decision may, within 15 days from the day of receiving the written decision, or within other time limits as prescribed by laws and regulations, bring a suit before the people's court.第四十八条 经人民法院两次合法传唤，原告无正当理由拒不到庭的，视为申请撤诉；被告无正当理由拒不到庭的，可以缺席判决。 Article 48 If the plaintiff refuses to appear in court without justified reasons after being twice legally summoned by the people's court, the court shall consider this an application for the withdrawal of the suit; if the defendant refuses to appear in court without justified reasons, the court may make a judgment by default.第四十八条在边远、水上、交通不便地区，行政机关及其执法人员依照本法第三十三条、第三十八条的规定作出罚款决定后，当事人向指定的银行缴纳罚款确有困难，经当事人提出，行政机关及其执法人员可以当场收缴罚款。 Article 48 If, after a decision on fine is made by an administrative organ or its law-enforcing officers in accordance with the provisions of Article 33 or Article 38 of this Law, it is really difficult for the party in the area which is outlying, on water or not easily accessible to pay the fine to the bank as designated, the administrative organ or its law-enforcing officers may, upon the request of the party, collect the fine on the spot.第四十八条 省、自治区、直辖市、自治州、设区的市的人民代表大会常务委员会主任、副主任和秘书长组成主任会议；县、自治县、不设区的市、市辖区的人民代表大会常务委员会主任、副主任组成主任会议。主任会议处理常务委员会的重要日常工作。 Article 48 The chairman, vice-chairmen and secretary-general of the standing committee of the people's congress of a province, autonomous region, municipality directly under the Central Government, autonomous prefecture, or city divided into districts shall constitute its council of chairmen; the chairman and vice-chairmen of the standing committee of the people's congress of a county, autonomous county, city not divided into districts, or municipal district shall constitute its council of chairmen. The hour and the day from which a time period begins shall not be counted as within the time period.第四十九条 诉讼参与人或者其他人有下列行为之一的，人民法院可以根据情节轻重，予以训诫、责令具结悔过或者处一千元以下的罚款、十五日以下的拘留；构成犯罪的，依法追究刑事责任： Article 49 If a participant in the proceedings or any other person commits any of the following acts, the people's court may, according to the seriousness of his offence, reprimand him, order him to sign a statement of repentance or impose upon him a fine of not more than 1,000 yuan or detain him for not longer than 15 days; if a crime is constituted, his criminal responsibility shall be investigated:第四十九条 常务委员会主任因为健康情况不能工作或者缺位的时候，由常务委员会在副主任中推选一人代理主任的职务，直到主任恢复健康或者人民代表大会选出新的主任为止。 Article 49 In the event that the chairman of a standing committee is unable to work due to feeble health or that his office falls vacant, the standing committee shall select one of the vice-chairmen to act on behalf of the chairman until he recovers his health or a new chairman is elected by the people's congress.第四十九条 本章规定的各项罚敦、拘留处罚，也适用于协助外国人非法入境或者出境、造成外国人非法居留或者停留、聘雇私自谋职的外国人、为未持有效旅行证件的外国人前往不对外国人开放的地区旅行提供方便的有关责任者。 Article 49 Penalties such as fines and detention provided for in this Chapter shall also apply to persons held responsible for assisting aliens to enter or leave China illegally, or causing aliens to reside to stay illegally in China, or employing aliens who seek jobs without permission, or providing facilities for aliens to travel without valid travel permits to areas closed to aliens.第四十九条被许可人要求变更行政许可事项的，应当向作出行政许可决定的行政机关提出申请；符合法定条件、标准的，行政机关应当依法办理变更手续。 Article 49 Where a licensee requests for modifying the matters under administrative license, it shall file an application to the administrative organ that made the decision about the administrative license. If it meets the statutory conditions and standards, the administrative organ shall handle the modification procedures in accordance with the law第四十九条行政机关及其执法人员当场收缴罚款的，必须向当事人出具省、自治区、直辖市财政部门统一制发的罚款收据；不出具财政部门统一制发的罚款收据的，当事人有权拒绝缴纳罚款。 Article 49 Where fines are collected on the spot by an administrative organ or its law-enforcing officers, the parties shall be given receipts for the fines as are uniformly made and issued by finance departments of provinces, autonomous regions or municipalities directly under the Central Government; if such receipts are not given, the parties shall have the right to refuse to pay the fines.第四十九条 送达复议决定书必须有送达回证，由受送达人在送达回证上记明收到日期，签名或者盖章。 Article 49. The service of a written reconsideration decision must be certified by a certificate of service, on which the date of receipt shall be indicated by the recipient of the service and his signature or seal shall be affixed.第四条公民行使集会、游行、示威的权利的时候，必须遵守宪法和法律，不得反对宪法所确定的基本原则，不得损害国家的、社会的、集体的利益和其他公民的合法的自由和权利。 Article 4In exercising their right to assembly, procession and demonstration, citizens must abide by the Constitution and the laws, shall not oppose the cardinal principles specified in the Constitution and shall not impair state, public or collective interests or the lawful freedoms and rights of other citizens.
