第四十一条行政机关及其执法人员在作出行政处罚决定之前，不依照本法第三十一条、第三十二条的规定向当事人告知给予行政处罚的事实、理由和依据，或者拒绝听取当事人的陈述、申辩，行政处罚决定不能成立；当事人放弃陈述或者申辩权利的除外。 Article 41 If, before making a decision on administrative penalty, an administrative organ or its law-enforcing officer, fails to notify, as stipulated in Articles 31 and 32 of this Law, the party of the facts about the violation, grounds and basis on which the administrative penalty is imposed, or refuses to heed the party's statement and self- defense, the decision on administrative penalty shall be invalid, except that the party relinquishes the right to make a statement or to defend himself.第四十一条 提起诉讼应当符合下列条件： Article 41 The following requirements shall be met when a suit is brought:第四十一条 省、自治区、直辖市、自治州、设区的市的人民代表大会常务委员会由本级人民代表大会在代表中选举主任、副主任若干人、秘书长、委员若干人组成。 Article 41 The standing committee of the people's congress of a province, autonomous region, municipality directly under the Central Government, autonomous prefecture, or city divided into districts shall be composed of a chairman, vice-chairmen, a secretary-general and members to be elected by the people's congress from among its deputies.第四十一条 全国人民代表大会代表应当同原选举单位和人民保持密切联系，可以列席原选举单位的人民代表大会会议，听取和反映人民的意见和要求，努力为人民服务。 Article 41. Deputies to the National People's Congress should maintain close contact with the units that elected them and with the people. They may attend, without voting rights, meetings of the people's congresses of the units that elected them, so as to heed and convey the opinions and demands of the people and work hard to serve them.第四十一条 复议机关审理复议案件，以法律、行政法规、地方性法规、规章，以及上级行政机关依法制定和发布的具有普遍约束力的决定、命令为依据。 Article 41. In handling reconsideration cases, the administrative body for reconsideration shall base itself on the laws, administrative rules and regulations, local regulations and rules as well as the decisions and orders with a general binding force formulated and promulgated by administrative bodies at higher levels according to the law.第四十一条 公安人员在执行本条例时，应当严格遵守法纪，秉公执法，不得徇私舞弊。禁止对违反治安管理的人打骂、虐待或者侮辱。违反的给予行政处分；构成犯罪的，依法追究刑事责任。 Article 41. In implementing these Regulations, the public security officials should strictly abide by laws and disciplines and impartially implement the provisions, allowing no favouritism and fraudulent practices. It is forbidden to beat or abuse, mistreat or insult the offender. An administrative disciplinary sanction shall be incurred against those who break the above mentioned provision. If such actions constitute a crime, criminal responsibility shall be investigated. 第四十一条 上一级监察机关的复核决定和国务院监察机关的复查决定或者复审决定为最终决定。 Article 41. The decisions made by the higher supervisory organization after re-examination and the decisions of the State Council's supervisory department made after re-examination or retrial shall be final.第四十二条 对违反本实施细则第十六、十九、二十条规定，非法居留的外国人，可以处警告或者每非法居留1日，处500元罚款，总额不超过5000元，或者处3日以上、１０日以下拘留，情节严重的，并处限期出境。 Article 42 Aliens who illegally stay in China in contravention of the provisions of Articles 16, 19 and 20 of the present Rules may be served a warning, fined 500 yuan (RMB) per day for the period of his/her illegal stay in China with the total sum of fine not exceeding 5,000 yuan (RMB), or detained from 3-10 days. Those whose offenses are serious may at the same time be ordered to leave the country within a specified time.第四十二条除可以当场作出行政许可决定的外，行政机关应当自受理行政许可申请之日起二十日内作出行政许可决定。 Article 42 An administrative organ shall make a decision on the administrative license within 20 days from the day when it accepts such an application unless it can make a decision on the spot.第四十二条行政机关作出责令停产停业、吊销许可证或者执照、较大数额罚款等行政处罚决定之前，应当告知当事人有要求举行听证的权利；当事人要求听证的，行政机关应当组织听证。当事人不承担行政机关组织听证的费用。听证依照以下程序组织： Article 42 An administrative organ, before making a decision on administrative penalty that involves ordering for suspension of production or business, rescission of business permit or license or imposition of a comparatively large amount of fine, shall notify the party that he has the right to request a hearing; if the party requests a hearing, the administrative organ shall arrange for the hearing. The party shall not bear the expenses for the hearing arranged by the administrative organ. The hearing shall be arranged according to the following procedure:第四十二条社会团体、企业事业单位的信访工作参照本条例执行。 Article 42 Complaint reporting of social organizations, enterprises or institutions concerning shall be handled by reference to these Regulations.第四十二条 县级以上的地方各级人民代表大会常务委员会每届任期同本级人民代表大会每届任期相同，它行使职权到下届本级人民代表大会选出新的常务委员会为止。 Article 42 The standing committee of a local people's congress at or above the county level shall have the same term of office as that people's congress and shall exercise its functions and powers until a new standing committee is elected by the succeeding people's congress at the same level.第四十二条 人民法院接到起诉状，经审查，应当在七日内立案或者作出裁定不予受理。原告对裁定不服的，可以提起上诉。 Article 42 When a people's court receives a bill of complaint, it shall, upon examination, file a case within seven days or decide to reject the complaint. If the plaintiff refuses to accept the decision, he may appeal to a people's court.第四十二条 复议机关经过审理，分别作出以下复议决定： Article 42. The administrative body for reconsideration shall, after the hearing, respectively make the following reconsideration decisions:第四十二条 公安机关对公民给予的治安管理处罚错误的，应当向受处罚人承认错误，退回罚款及没收的财物；对受处罚人的合法权益造成损害的，应当赔偿损失。 Article 42. The public security organs shall admit their mistakes to those who are punished by mistake and return fines and the confiscated property; in case the legal rights and interests of those who are so punished have been infringed upon, the loss shall be compensated for. 第四十二条 对监察建议有异议的，可以自收到监察建议之日起三十日内向作出监察建议的监察机关提出，监察机关应当自收到异议之日起三十日内回复； Article 42. Where there is disagreement over a recommendation of supervision, the party concerned may raise it with the supervisory organ that has made the recommendation within 30 days of receipt of the recommendation; the supervisory organ shall make a reply within 30 days of receipt of the disagreement.第四十二条 全国人民代表大会代表在出席全国人民代表大会会议和执行其他属于代表的职务的时候，国家根据实际需要给予适当的补贴和物质上的便利。 Article 42. While deputies to the National People's Congress attend meetings of the Congress or perform other duties required of them as deputies, the state shall provide them with appropriate allowances and material facilities according to their actual needs.第四十三条 人民法院应当在立案之日起五日内，将起诉状副本发送被告。 Article 43 A people's court shall send a copy of the bill of complaint to the defendant within five days of filing the case.第四十三条 对违反本实施细则第二十四、二十五条规定，不按要求缴验居留证，不随身携带护照或者居留证件，或者拒绝民警查验证件的外国人，可以处警告或者５００元以下的罚款，情节严重的，并处限期出境。 Article 43 Aliens who, in contravention of the provisions of Articles 24 and 25 of the present Rules, fail to submit their residence certificates for examination as required or to carry their passports or residence certificates with them or refuse to produce their certificates to police for examination may be served a warning or fined up to 500 yuan (RMB), and those whose offenses are serious may at the same time be ordered to leave the country within a specified time.第四十三条对外国人、无国籍人、外国组织信访事项的处理，参照本条例执行。 Article 43 Complaint reporting made by foreigners, stateless persons or foreign organizations shall be handled by reference to these Regulations.第四十三条依法应当先经下级行政机关审查后报上级行政机关决定的行政许可，下级行政机关应当自其受理行政许可申请之日起二十日内审查完毕。但是，法律、法规另有规定的，依照其规定。 Article 43 For an administrative license that is subject to the examination of a lower administrative organ before it is reported and submitted to an upper administrative organ, the lower administrative organ shall complete the examination within 20 days from the day when the application for administrative license is accepted. But, if it is otherwise provided for in the laws and regulations, the latter shall prevail第四十三条 省、自治区、直辖市的人民代表大会常务委员会在本级人民代表大会闭会期间，根据本行政区域的具体情况和实际需要，在不同宪法、法律、行政法规相抵触的前提下，可以制定和颁布地方性法规，报全国人民代表大会常务委员会和国务院备案。 Article 43 The standing committees of the people's congresses of provinces, autonomous regions, and municipalities directly under the Central Government may, when their respective people's congresses are not in session, formulate and promulgate local regulations in accordance with the specific conditions and actual needs of their respective administrative areas, provided that these regulations do not contravene the Constitution, the law and administrative rules and regulations; they shall report such local regulations to the Standing Committee of the National People's Congress and the State Council for the record.第四十三条听证结束后，行政机关依照本法第三十八条的规定，作出决定。 Article 43 When a hearing is concluded, the administrative organ shall make a decision in accordance with the provisions of Article 38 of this Law.第四十三条 本条例所说以上、以下、以内，都包括本数在内。 Article 43. No deputy to the National People's Congress or member of its Standing Committee may be held legally liable for his speeches or votes at various meetings of the National People's Congress and its Standing Committee.
