第三十五条(5)国务院公安部门可以根据本法制定实施条例，报国务院批准施行。 Article 35The public security department under the State Council may, in accordance with this Law, formulate rules of implementation, which shall go into effect after being submitted to and approved by the State Council.第三十六条各级行政机关应当及时分析信访事项反映的社会情况和人民群众的愿望，提出建议，改进工作。 Article 36 Administrative authorities at various levels shall earnestly study the social implications and the wishes of the masses reflected in a complaint reporting and shall come up with suggestions for the improvement of work accordingly.第三十六条 外国入领取旅行证后，如要求延长旅行证有效期、增加不对外国人开放的旅行地点、增加倍行人数，必须向公安局申请延期或者变更。 Article 36 An alien who, after obtaining a travel permit, wishes to extend its validity, tour more places closed to aliens or increase the number of accompanying persons shall apply to the public security bureau for extension or alteration.第三十六条除本法第三十三条规定的可以当场作出的行政处罚外，行政机关发现公民、法人或者其他组织有依法应当给予行政处罚的行为的，必须全面、客观、公正地调查，收集有关证据；必要时，依照法律、法规的规定，可以进行检查。 Article 36 Except for the administrative penalties which may be imposed on the spot as provided in Article 33 of this Law, administrative organs, when discovering that citizens, legal persons or other organizations have committed acts for which administrative penalty should be imposed according to law, shall conduct investigation in a comprehensive, objective and fair manner and collect relevant evidence; when necessary, they may conduct inspection in accordance with the provisions of laws and regulations.第三十六条本法自公布之日起施行。 Article 36 This Law shall enter into force on the date of promulgation.第三十六条 在证据可能灭失或者以后难以取得的情况下，诉讼参加人可以向人民法院申请保全证据，人民法院也可以主动采取保全措施。 Article 36 Under circumstances where there is a likelihood that evidence may be destroyed or lost or difficult to obtain later on, the participants in proceedings may apply to the people's court for the evidence to be preserved. The people's court may also on its own initiative take measures to preserve such evidence.第三十六条 地方各级人民代表大会代表在出席人民代表大会会议和执行代表职务的时候，国家根据需要给予往返的旅费和必要的物质上的便利或者补贴。 Article 36 When deputies to local people's congresses at various levels attend people's congress sessions or perform their duties as deputies, the state shall, as necessary, provide them with round-trip travelling expenses and requisite material facilities or subsidies.第三十六条行政机关对行政许可申请进行审查时，发现行政许可事项直接关系他人重大利益的，应当告知该利害关系人。申请人、利害关系人有权进行陈述和申辩。行政机关应当听取申请人、利害关系人的意见。 Article 36 When examining the applications for administrative license, if the administrative organ finds that any party has important direct interests to the matters under the administrative license, it shall inform the interested party. The applicant and the interested party shall be entitled to make a statement and defense. The administrative organ shall listen to the opinions of the applicant and the interested party第三十六条 受罚款处罚的人应当将罚款当场交公安人员或者在接到罚款通知或者裁决书后五日内送交指定的公安机关。无正当理由逾期不交纳的，可以按日增加罚款一元至五元。拒绝交纳罚款的，可以处十五日以下拘留，罚款仍应执行。 Article 36. A fine shall be paid by the offender on the spot to the public security officials or paid to the appointed public security organs within five days after receiving the notice of fine or written ruling. Failure to pay a fine in time without good cause shall be punished by an addition of one to five yuan per day. Whoever refuses to pay a fine shall be detained for a maximum of fifteen days and shall still be subject to the fine. 第三十六条 有关单位和人员应当自收到监察决定或者监察建议之日起三十日内将执行监察决定或者采纳监察建议的情况通报监察机关。 Article 36. After receiving a written notice on supervisory decisions or recommendations. the concerned units should inform the supervisory organization within 30 days on the situation of implementing the supervisory decisions or accepting the supervisory recommendations.第三十六条 法律、法规规定应当先向行政机关申请复议，对复议不服再向人民法院提起诉讼的，申请人对复议机关不予受理的裁决不服，可以在收到不予受理裁决书之日起十五日内，向人民法院起诉。法律、法规另有规定的除外。 Article 36. Except as otherwise provided by the laws and regulations, in circumstances where, in accordance with the provisions of pertinent laws and regulations, a person concerned shall first apply to an administrative body for reconsideration and then bring a suit before a people's court if the person concerned does not accept the reconsideration decision, if the applicant does not accept the decision made by the administrative body for reconsideration to reject the application, the applicant may, within 15 days from the date of receiving the written decision on rejection of the application, bring a suit before the people's court.第三十六条 各专门委员会主任委员主持委员会会议和委员会的工作。副主任委员协助主任委员工作。 Article 36. The chairman of each special committee shall preside over meetings of the committee and direct its work. The vice-chairmen shall assist the chairman in his work.第三十七条 对属于人民法院受案范围的行政案件，公民、法人或者其他组织可以先向上一级行政机关或者法律、法规规定的行政机关申请复议，对复议不服的，再向人民法院提起诉讼；也可以直接向人民法院提起诉讼。 Article 37 A citizen, a legal person or any other organization may, within the scope of cases acceptable to the people's courts, apply to an administrative organ at the next higher level or to an administrative organ as prescribed by the law or regulations for reconsideration, anyone who refuses to accept the reconsideration decision may bring a suit before a people's court; a citizen, a legal person or any other organization may also bring a suit directly before a people's court.第三十七条 行政机关对行政许可申请进行审查后，除当场作出行政许可决定的外，应当在法定期限内按照规定程序作出行政许可决定。 Article 37 After the administrative organ has examined the application for administrative license, it shall make a decision about the administrative license in light of the prescribed procedures within the statutory time limit, unless the decision on the administrative license shall be made on the spot第三十七条 外国人未经允许，不得进入不对外开放的场所。 Article 37 Aliens shall not enter places closed to aliens without permission.第三十七条 地方各级人民代表大会代表应当和原选举单位或者选民保持密切联系，宣传法律和政策，协助本级人民政府推行工作，并且向人民代表大会及其常务委员会、人民政府反映群众的意见和要求。 Article 37 Deputies to local people's congresses at various levels shall maintain close contact with the units that elected them or with their constituencies; publicize laws and policies; assist the people's governments at the corresponding levels in their work; and relay the opinions and demands of the masses to the people's congresses, their standing committees and the people's governments.第三十七条对在信访工作中做出优异成绩的单位或者个人，由有关行政机关给予奖励。 Article 37 The relevant administrative authorities shall give rewards to those units or individuals who have made outstanding contribution to the handling of complaint reporting.第三十七条行政机关在调查或者进行检查时，执法人员不得少于两人，并应当向当事人或者有关人员出示证件。当事人或者有关人员应当如实回答询问，并协助调查或者检查，不得阻挠。询问或者检查应当制作笔录。 Article 37 When administrative organs conduct investigations or inspections, there shall be not less than two law-enforcing officers, who shall show their identification papers to the party or other persons concerned. The party and other persons concerned shall truthfully answer the questions and assist in the investigation or inspection; they may not obstruct such investigation or inspection. Written record shall be made for the inquiry or inspection.第三十七条 裁决机关没收财物，应当给被没收人开具收据。 Article 37. A receipt shall be given to the offender after the penalty of confiscation is enforced by the ruling organs.第三十七条 行政复议实行书面复议制度，但复议机关认为有必要时，可以采取其他方式审理复议案件。 Article 37. Administrative reconsideration shall be conducted by applying the system of reconsideration by written documents; however, when the administrative body for reconsideration deems it necessary, other forms for hearing of reconsideration cases may be adopted.第三十七条 各专门委员会的工作如下： Article 37. The work of the special committees shall be as follows: 第三十七条 国家公务员和国家行政机关任命的其他人员对主管行政机关作出的行政处分决定不服的，可以自收到行政处分决定之日起三十日内向监察机关提出申诉，监察机关应当自收到申诉之日起三十日内作出复查决定； Article 37. When government functionaries or staff members appointed by state administrative organs do not concur with the administrative punishment made by the organization in charge of personnel action, they may make appeals to the supervisory organization within 30 days from receiving the administrative decision. The supervisory organization should re-examine the decision with 30 days after receiving such a request.第三十八条调查终结，行政机关负责人应当对调查结果进行审查，根据不同情况，分别作出如下决定： Article 38 After an investigation has been concluded, leading members of an administrative organ shall examine the results of the investigation and make the following decisions in light of different circumstances:第三十八条 外国人应当在签证准予停留的期限内或者居留证件的有效期内出境。 Article 38 Aliens shall leave China within the time limit prescribed in the visas or within the period of validity of their residence certificates.第三十八条 省、自治区、直辖市、自治州、设区的市的人民代表大会代表受原选举单位的监督；县、自治县、不设区的市、市辖区、乡、民族乡、镇的人民代表大会代表受选民的监督。 Article 38 Deputies to the people's congresses of provinces, autonomous regions, municipalities directly under the Central Government, autonomous prefectures and cities divided into districts shall be subject to supervision by the units which elected them; deputies to the people's congresses of counties, autonomous counties, cities not divided into districts, municipal districts, townships, nationality townships, and towns shall be subject to supervision by their constituencies.
