- 第三十条 统计机构、统计人员违反本法规定，泄露私人、家庭的单项调查资料或者统计调查对象的商业秘密，造成损害的，依法承担民事责任，并对负有直接责任的主管人员和其他直接责任人员依法给予行政处分。 Article 30 Statistics institutions or statisticians that, in violation of the provisions of this Law, disclose single-item personal or family investigation data or commercial secrets of an investigated unit or individual and thus cause losses shall bear civil liability, and the persons who are directly in charge and other persons who are directly responsible for the case shall be given administrative sanctions according to law.
- 第三十条本条例的具体应用问题由市公安局负责解释。 Article 30 The Municipal Public Security Bureau are responsible for the interpretation of the specific application of the present regulations.
- 第三十条 省、自治区、直辖市、自治州、设区的市的人民代表大会根据需要，可以设法制（政法）委员会、财政经济委员会、教育科学文化卫生委员会等专门委员会。各专门委员会受本级人民代表大会领导；在大会闭会期间，受本级人民代表大会常务委员会领导。 Article 30 The people's congresses of provinces, autonomous regions, municipalities directly under the Central Government, autonomous prefectures and cities divided into districts may, where necessary, establish special committees such as legislative (political and law) committees, finance and economic committees, and education, science, culture and public health committees. The special committees shall work under the direction of the respective people's congresses; when the people's congresses are not in session, they shall work under the direction of the standing committees of the people's congresses.
- 第三十条 外国人在中国居民家中住宿，在城镇的，须于抵达后24小时内，由留宿或者本人持住宿人的护照、证件和留宿人的户口簿到当地公安机关申报，填写临时住宿登记表；在农村的，须于72小时内向当地派出所或者户籍办公室申报。 Article 30 When an alien wishes to lodge at the home a Chinese resident in urban areas, the host or the lodger shall, within 24 hours of the lodger's arrival, report to the local public security organ with the lodger's passport and certificate as well as the host's residence booklet and fill in registration forms of temporary accommodation. In rural areas, the host or lodger shall report to the local police station or residence registration office within 72 hours of the lodger's arrival.
- 第三十条公民、法人或者其他组织违反行政管理秩序的行为，依法应当给予行政处罚的，行政机关必须查明事实；违法事实不清的，不得给予行政处罚。 Article 30 Where citizens, legal persons or other organizations violate administration order and should be given administrative penalty according to law, administrative organs must ascertain facts; if the facts about the violations are not clear, no administrative penalty shall be imposed.
- 第三十条各级行政机关直接办理的信访事项应当在30日内办理完毕，并视情况将办理结果答复信访人； Article 30 Within 30 days, administrative authorities at various levels shall resolve complaint reporting matters within its jurisdiction, and shall advise the concerned complainant of the result of the decision according to the circumstances.
- 第三十条 严厉禁止卖淫、嫖宿暗娼以及介绍或者容留卖淫、嫖宿暗娼，违者处十五日以下拘留、警告、责令具结悔过或者依照规定实行劳动教养，可以并处五千元以下罚款；构成犯罪的，依法追究刑事责任。 Article 30. Prostitution, whoring, pandering or housing prostitution or whoring with a prostitute is strictly forbidden. Whoever breaks the above ban shall be detained for a maximum of fifteen days, given a warning, made to sign a statement of repentance or given re-education through labour according to regulations, and may be concurrently fined a maximum of five thousand yuan. Criminal responsibility shall be investigated if the actions constitute a crime.
- 第三十条 监察机关按照下列程序对违反行政纪律的行为进行调查处理： Article 30. Supervisory organs conduct investigations of and handle the behavior in violation of administrative discipline according to the following procedures:
- 第三十条 常务委员会举行会议的时候，可以由各省、自治区、直辖市的人民代表大会常务委员会派主任或者副主任一人列席会议，发表意见。 Article 30. When the Standing Committee is in session, the standing committees of the people's congresses of the provinces, autonomous regions, and municipalities directly under the Central Government may each send a chairman or vice-chairman to attend the meetings and express their opinions.
- 第三十条 公民、法人或者其他组织向人民法院起诉，人民法院已经受理的，不得申请复议。 Article 30. Where a citizen, a legal person or any other organization brings a suit before the people's court and the people's court has accepted the case, then he/she or it may not apply for reconsideration.
- 第三十条(2)扰乱、冲击或者以其他方法破坏依法举行的集会、游行、示威的，公安机关可以处以警告或者十五日以下拘留，情节严重，构成犯罪的，依照刑法有关规定追究刑事责任。 Article 30Those who disturb, break into or undermine by other means an assembly, a procession or a demonstration held in compliance with law may be punished by the public security organ by warning or by criminal detention of not more than 15 days; if the circumstances are serious and a crime is constituted, they shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.
- 第三十一条 县级以上的地方各级人民代表大会可以组织关于特定问题的调查委员会。 Article 31 A local people's congress at or above the county level may appoint an investigation committee on specific questions.
- 第三十一条 国家机关违反本法规定，未报经审查或者备案，擅自制发统计调查表的，由县级以上人民政府统计机构责令改正，予以通报批评。 Article 31 Any State organ that, in violation of the provision of this Law, draws up and issues statistical investigation forms without submitting the matter for examination or for the record shall be ordered by the statistics institution of the people's government at or above the county level to set it right and criticized in a circulated notice.
- 第三十一条行政机关在作出行政处罚决定之前，应当告知当事人作出行政处罚决定的事实、理由及依据，并告知当事人依法享有的权利。 Article 31 Before deciding to impose administrative penalties, administrative organs shall notify the parties of the facts, grounds and basis according to which the administrative penalties are to be decided on and shall notify the parties of the rights that they enjoy in accordance with law.
- 第三十一条 证据有以下几种： Article 31 Evidence shall be classified as follows:
- 第三十一条 本法所称的外国人是指依照《中华人民共和国国籍法》不具有中国国籍的人。 Article 31 For the purposes of this Law the term ""alien"" means any person not holding Chinese nationality according to the Nationality Law of the People's Republic of China.
- 第三十一条本条例自１９９８年１月１日起施行。 Article 31 The present Regulations shall become effective on January 1, 1998.
- 第三十一条 外国人在中国的外国机构或者在中国的外国人家中住宿，须于住宿人抵达２４小时内，由留宿机构、留宿人或者本人持住宿人的居留证件，向当地公安机关申报，并填写临时住宿登记表。 Article 31 When an alien lodges at a foreign institution in China or at the home of an alien in China, the institution in question or the host or the lodger shall, within 24 hours of the lodger's arrival, report to the local public security organ with the lodger's passport or residence certificate and fill in registration forms of temporary accommodation.
- 第三十一条申请人申请行政许可，应当如实向行政机关提交有关材料和反映真实情况，并对其申请材料实质内容的真实性负责。行政机关不得要求申请人提交与其申请的行政许可事项无关的技术资料和其他材料。 Article 31 When applying for administrative license, an applicant shall faithfully submit relevant materials to the administrative organ, report the actual information, and shall be liable for the authenticity of the substantial contents of the application materials. The administrative organ may not ask the applicant to submit technical materials and other materials that have nothing to do with the matters under the administrative license
- 第三十一条各级行政机关对交办的信访事项，应当自收到之日起90日内办结，并将办理结果报告交办机关； Article 31 Within 90 days, administrative authorities at various levels shall resolve complaint reporting matters which have been assigned to them and shall advise the administrative authority that originally assigned the matter of the result of the decision.
- 第三十一条 严厉禁止违反政府规定种植罂粟等毒品原植物，违者除铲除其所种罂粟等毒品原植物以外，处十五日以下拘留，可以单处或者并处三千元以下罚款；构成犯罪的，依法追究刑事责任。非法运输、买卖、存放、使用罂粟壳的，收缴其非法运输、买卖、存放、使用的罂粟壳，处十五日以下拘留，可以单处或者并处三千元以下罚款；构成犯罪的，依法追究刑事责任。 Article 31. Planting opium poppy and other raw narcotics in violation of government decrees is strictly forbidden. Whoever violates the above decree shall be detained for a maximum of fifteen days and may be fined simply or concurrently a maximum of three thousand yuan, in addition to having his opium poppy and other narcotic plants rooted out; criminal responsibility shall be investigated if the actions constitute a crime.
- 第三十一条 申请复议应当符合下列条件： Article 31. The following requirements shall be met when an application is made for reconsideration:
- 第三十一条 常务委员会审议的法律案和其他议案，由常务委员会以全体组成人员的过半数通过。 Article 31. The legislative bills and other bills brought before the Standing Committee for deliberation shall be adopted by a simple majority vote of all its members.
- 第三十一条 监察机关对于立案调查的案件，经调查认定不存在违反行政纪律事实的，或者不需要追究行政纪律责任的，应当予以撤销，并告知被调查单位及其上级部门或者被调查人员及其所在单位。 Article 31. Where a supervisory organ determines that the fact of a violation of administrative discipline does not exist in an established case after investigation, or there is no need to determine the administrative disciplinary responsibility, it should withdraw the case and inform the unit being investigated and its higher department, or the individuals being investigated and their units, of the withdrawal.
- 第三十一条(1)当事人对公安机关依照本法第二十八条第二款或者第三十条的规定给予的拘留处罚决定不服的，可以自接到处罚决定通知之日起五日内，向上一级公安机关提出申诉，上一级公安机关裁定不服的，可以自接到裁决通知之日起五日内，向人民法院提起诉讼。 Article 31If a party refuses to accept the decision on punishment by detention made in accordance with the provisions of the second paragraph of Article 28 or Article 30 of this Law, he may appeal to the public security organ at the next higher level within five days of receiving the notice on the decision on punishment; the public security organ at the next higher level shall make a decision within five days of receiving the appeal; if the party refuses to accept the decision of the public security organ at the next higher level, he may institute proceedings in the people's court within five days of receiving the notice on the decision.
