To apply for a travel permit, the following procedures must be completed:第三十四条 地方各级人民代表大会代表、常务委员会组成人员，在人民代表大会和常务委员会会议上的发言和表决，不受法律追究。 Article 34 Deputies to local people's congresses at various levels and members of their standing committees may not be legally liable for their speeches and voting at sessions of the people's congresses or meetings of their standing committees.第三十四条执法人员当场作出行政处罚决定的，应当向当事人出示执法身份证件，填写预定格式、编有号码的行政处罚决定书。行政处罚决定书应当当场交付当事人。 Article 34 If a law-enforcing officer decides to impose administrative penalty on the spot, he shall show the party his identification papers for law enforcement, fill out an established and coded form of decision for administrative penalty. The form of decision for administrative penalty shall be given to the party on the spot.第三十四条对原办理机关的处理决定或者复查意见不服的，信访人可以自收到处理决定书或者复查意见书之日起30日内请求上一级行政机关复查，上一级行政机关应自收到复查请求之日起30日内提出复查意见。 Article 34 If the complainant is unsatisfied with the the decision or opinion upon review by the original administrative authority, he may appeal to the administrative authority at the next higher level for a review within 30 days from receipt of the written decision or the written opinions after review, and the latter shall propose opinions thereon within 30 days from receipt of the application for review.第三十四条 本法自1984年1月1日起施行。1963年国务院发布的《统计工作试行条例》即行废止。 Article 34 This Law shall go into effect as of January 1, 1984. When a supervisory organization makes important supervisory decision or puts forward important supervisory recommendations, it should be approved by the people's government at the same level and supervisory organization at the higher level. The important supervisory decision and important supervisory recommendations made by supervisory organizations under the State Council should be approved by the State Council.第三十四条外国人在中国境内举行集会、游行、示威，适用本法的规定。 Article 34This Law shall apply to assemblies, processions and demonstrations held by foreigners within the territory of China.第三十五条 外国人旅行证的有效期最长为1年，但不得超过外国人所持签证或者居留 证件的有效期限。 Article 35 An alien's travel permit shall be valid for one year at the most, and may not exceed the period of validity of his/her visa or residence certificate.第三十五条当事人对当场作出的行政处罚决定不服的，可以依法申请行政复议或者提起行政诉讼。 Article 35 If a party refuses to accept the decision on administrative penalty made on the spot, he may apply for administrative reconsideration or bring an administrative lawsuit in accordance with law.第三十五条依法应当先经下级行政机关审查后报上级行政机关决定的行政许可，下级行政机关应当在法定期限内将初步审查意见和全部申请材料直接报送上级行政机关。上级行政机关不得要求申请人重复提供申请材料。 Article 35 In accordance with law, where an administrative license is subject to the examination of the lower administrative organ before it is reported and submitted to the upper administrative organ for decision, the lower administrative organ shall directly submit the preliminary examination opinions and the complete set of application materials to the upper administrative organ within the statutory time limit. The upper administrative organ shall not require the applicant to provide the application materials again第三十五条 在诉讼过程中，人民法院认为对专门性问题需要鉴定的，应当交由法定鉴定部门鉴定；没有法定鉴定部门的，由人民法院指定的鉴定部门鉴定。 Article 35 In the course of legal proceedings, when a people's court considers that an expert evaluation for a specialized problem is necessary, the expert evaluation shall be made by an expert evaluation department as specified by law. In the absence of such a department, the people's court shall designate one to conduct the expert evaluation.第三十五条 县级以上的地方各级人民代表大会代表，非经本级人民代表大会主席团许可，在大会闭会期间，非经本级人民代表大会常务委员会许可，不受逮捕或者刑事审判。如果因为是现行犯被拘留，执行拘留的公安机关应当立即向该级人民代表大会主席团或者常务委员会报告。 Article 35 No deputy to a local people's congress at or above the county level may be arrested or placed on criminal trial without the consent of the presidium of that people's congress or, when the people's congress is not in session, without the consent of its standing committee. If a deputy is caught in the act of crime and detained, the public security organ executing the detention shall immediately report the matter to the presidium or the standing committee of that people's congress.第三十五条 本法自一九八六年二月一日起施行。 Article 35 This Law shall go into effect on February 1, 1986.第三十五条行政机关发现本机关对信访事项的处理、复查确有错误的，应当重新处理。 Article 35 Upon discovery of its own mistaken decision or review opinion on a complaint reporting matter, an administrative authority shall make necessary corrections. 第三十五条 监察决定、监察建议应当以书面形式送达有关单位或者有关人员。 Article 35. The decisions and recommendations made by the supervisory organization should be sent to related units or personnel in written form.第三十五条 全国人民代表大会设立民族委员会、法律委员会、财政经济委员会、教育科学文化卫生委员会、外事委员会、华侨委员会和全国人民代表大会认为需要设立的其他专门委员会。各专门委员会受全国人民代表大会领导；在全国人民代表大会幕会期间，受全国人民代表大会常务委员会领导。 Article 35. The National People's Congress shall establish a Nationalities Committee, a Law Committee, a Finance and Economic Committee, an Education, Science, Culture and Public Health Committee, a Foreign Affairs Committee, an Overseas Chinese Committee and such other special committees as may be deemed necessary by the National People's Congress. The special committees shall be under the direction of the National People's Congress, and of its Standing Committee when the Congress is not in session.第三十五条 公民、法人或者其他组织依法提出复议申请，复议机关无正当理由拒绝受理或者不予答复的，上一级行政机关或者法律、法规规定的行政机关应当责令其受理或者答复。 Article 35. Where a citizen, a legal person, or any other organization has filed an application for reconsideration according to the law, but the administrative body for reconsideration refuses, without any justification, to accept the application or fails to respond, the administrative body at the next higher level, or the administrative body prescribed by the laws and regulations, shall instruct the said administrative body for reconsideration to accept the said application or to respond.第三十五条 受拘留处罚的人应当在限定的时间内，到指定的拘留所接受处罚。对抗拒执行的，强制执行。 Article 35. Whoever shall be detained should receive the penalty in a specified detention house over a specified time. Compulsory detainment shall be used against one who resists enforcement of the punishment.
