The administrative body for reconsideration shall, within 7 days from the day of filing the case, deliver a copy of the written application for reconsideration to the defending party of the said application. The defending party of the application shall, within 10 days from the day of receiving the copy of the written application for reconsideration, provide the administrative body for reconsideration with the relevant materials or evidence for undertaking the specific administrative act and submit a written defense. Failure by the defending party to submit a written defense within the time limit shall not stop the procedures of reconsideration.第三十八条 全国人民代表大会或者全国人民代表大会常务委员会可以组织对于特定问题的调查委员会。调查委员会的组织和工作，由全国人民代表大会或者全国人民代表大会常务委员会决定。 Article 38. The National People's Congress and its Standing Committee may appoint committees for the investigation of specific issues. The organization and work of the committees shall be decided by the National People's Congress or its Standing Committee. 第三十八条 监察机关对受理的不服主管行政机关行政处分决定的申诉，经复查认为原决定不适当的，可以建议原决定机关予以变更或者撤销； Article 38. When handling appeals by units or individuals who do not agree with the administrative punishment made by their administrative units, the supervisory organizations may recommend changes or cancellation of the original decisions if the original decisions are found to be inappropriate after reinvestigation.第三十八条 被裁决赔偿损失或者负担医疗费用的，应当在接到裁决书后五日内将费用交裁决机关代转；数额较大的，可以分期交纳。 Article 38. Whoever is required by a ruling to make reparations for loss or to bear medical cost shall deliver the cost to the organ making the ruling for transmission within five days after receiving the written ruling. Payments by instalments may be accepted if the amount is large.第三十九条行政机关在信访工作中不履行职责、推诿、敷衍、拖延的，上级行政机关可以通报批评，并视情节对有关责任人员依法给予行政处分。 Article 39 Administrative authorities which have failed to perform their duties, shifted their responsibilities to others, conducted in a perfunctory manner or delayed decision may be reprimanded publicly by the higher administrative authorities.Those responsible persons may be subject to disciplinary sanctions according to the circumstances.第三十九条 行政机关作出准予行政许可的决定，需要颁发行政许可证件的，应当向申请人颁发加盖本行政机关印章的下列行政许可证件： Article 39 For an administrative organ that makes a decision about the approval of the administrative license, it shall issue one of the following certificates for administrative license with the seal of this administrative organ:第三十九条 公民、法人或者其他组织直接向人民法院提起诉讼的，应当在知道作出具体行政行为之日起三个月内提出。法律另有规定的除外。 Article 39 If a citizen, a legal person or any other organization brings a suit directly before a people's court, he or it shall do so within three months from the day when he or it knows that a specific administrative act has been undertaken, except as otherwise provided for by law.第三十九条 地方各级人民代表大会代表因故不能担任代表职务的时候，由原选举单位或者由原选区选民补选。 Article 39 In the event that a deputy to a local people's congress is unable to perform his duties as deputy for any reason, the unit which elected him or the voters in the electoral district shall hold a by- election to replace him.第三十九条 持有外国人居留证件的人，在其居留证件有效期内出境并需返回中国的，应当在出境前按本实施细则第五、六条有关规定向当地公安机关申请办理返回中国的签证。 Article 39 The holder of an alien's residence certificate who wishes to leave and then re-enter China within the period of validity of the said certificate shall, before leaving China, apply to the local public security organ for a re-entry visa in accordance with the relevant provisions of Articles 5 and 6 of the present Rules.第三十九条行政机关依照本法第三十八条的规定给予行政处罚，应当制作行政处罚决定书。行政处罚决定书应当载明下列事项： Article 39 To impose administrative penalty according to the provisions of Article 38 of this Law, an administrative organ shall fill out form of decision for administrative penalty. The following particulars shall be clearly recorded in a form of decision for administrative penalty:第三十九条 被裁决受治安管理处罚的人或者被侵害人不服公安机关或者乡（镇）人民政府裁决的，在接到通知后五日内，可以向上一级公安机关提出申诉，由上一级公安机关在接到申诉后五日内作出裁决；不服上一级公安机关裁决的，可以在接到通知后五日内向当地人民法院提起诉讼。 Article 39. If an offender or victim protests the ruling of the public security organ or the people's governments of townships or towns, he may petition to the public security organs at the next higher level within five days after receiving the notice, and the public security organs at the next higher level shall make a new ruling within five days after receiving the petition. Whoever protests the ruling of the public security organ at the next higher level may file suit with the local people's court within five days after the notice.第三十九条 复议期间具体行政行为不停止执行。但有下列情形之一的，可以停止执行： Article 39. In the course of hearing a reconsideration case, execution of the specific administrative act shall not be suspended.
