- 第二十三条 全国人民代表大会常务委员会由下列人员组成： Article 23. The Standing Committee of the National People's Congress shall be composed of the following personnel:
- 第二十三条本法自１９９０年１月１日起施行。１９５４年１２月３１日全国人民代表大会常务委员会通过的《城市居民委员会组织条例》同时废止。 Article 23. This Law shall enter into force on January 1, 1990. The Organic Regulations of the Urban Residents Committees, adopted by the Standing Committee of the National People's Congress on December 31, 1954, shall be abrogated as of the same date.
- 第二十三条 有下列侵犯公私财物行为之一，尚不够刑事处罚的，处十五日以下拘留或者警告，可以单处或者并处二百元以下罚款： Article 23. Whoever commits one of the following acts encroaching upon public or private property, but not serious enough for criminal punishment, shall be detained for a maximum of fifteen days, given a warning or fined simply or concurrently a maximum of two hundred yuan:
- 第二十三条(6)在下列场所周边距离十米内至三百米内，不得举行集会、游行、示威，经国务院或者省、自治区、直辖市的人民政府批准的除外： Article 23No assembly, procession or demonstration shall be held within a peripheral distance of 10-300 metres from the following places, with the exception of those approved by the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government:
- 第二十四条 依照本法提起诉讼的公民、法人或者其他组织是原告。 Article 24 A citizen, a legal person or any other organization that brings a suit in accordance with this Law shall be a plaintiff.
- 第二十四条 在中国定居的外国人必须每年一次在指定的时间到居住地的公安局缴验外国人居留证。 Article 24 Aliens residing permanently in China shall, once every year and at a prescribed time, submit their residence cards for examination to the public security bureau at their place of residence.
- 第二十四条行政机关在其法定职权范围内，依照法律、法规、规章的规定，可以委托其他行政机关实施行政许可。委托机关应当将受委托行政机关和受委托实施行政许可的内容予以公告。 Article 24 An administrative organ may, within its statutory functions, authorize other administrative organs to implement the administrative license in light of the laws, regulations and rules. The authorizing organ shall announce to the public the authorized administrative organs and the authorized particulars of the administrative license
- 第二十四条对当事人的同一个违法行为，不得给予两次以上罚款的行政处罚。 Article 24 For the same illegal act committed by a party, the party shall not be given an administrative penalty of fine for more than once.
- 第二十四条 有下列情形之一的外国人，边防检查机关有权阻止出境，并依法处理： Article 24 Frontier inspection offices shall have the power to stop aliens belonging to any of the following categories from leaving the country and to deal with them according to law:
- 第二十四条有下列行为之一的，由县级以上人民政府档案行政管理部门、有关主管部门对直接负责的主管人员或者其他直接责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任： Article 24 If any of the following acts is committed, the archives administration department of the people's government at or above the county level, or the competent authorities concerned shall, in accordance with law, impose administrative sanctions on persons directly in charge or other persons directly responsible for the case; and if the case constitutes a crime, criminal responsibility shall be investigated according to law:
- 第二十四条 地方各级人民代表大会选举本级国家机关领导人员，获得过半数选票的候选人人数超过应选名额时，以得票多的当选。如遇票数相等不能确定当选人时，应当就票数相等的人再次投票，以得票多的当选。 Article 24 In elections for leading persons of State organs conducted by local people's congresses at the corresponding levels, when the number of candidates who obtain more than half of the votes exceeds the number of leading persons to be elected, those who obtain more votes shall be elected. If the number of votes for some candidates is tied, thus making it impossible to determine the elected, another balloting shall be conducted for those candidates to resolve the tie, and those who obtain more votes shall be elected.
- 第二十四条违反本条例的人员，应当给予治安处罚的，由公安部门依照《中华人民共和国治安管理处罚条例》的规定处罚。 Article 24 Offenders of the present regulations are to be punished according to the Regulations of the People’s Republic of China on Public Security Administration and Imposition of Punishment.
- 第二十四条 统计人员应当坚持实事求是，恪守职业道德，具备执行统计任务所需要的专业知识。统计机构应当加强对统计人员的专业培训，组织专业学习。 Article 24 Statisticians shall adhere to the principle of seeking truth from facts, abide by professional ethics and possess the professional knowledge necessary for carrying out statistical tasks. Statistics institutions shall provide more professional training for statisticians and organize them for professional studies.
- 第二十四条地方各级人民政府行政机构的设置和编制管理办法另行制定。 Article 24 The measures for administration of agency establishment and staffing of the agencies of the local people’s governments shall be otherwise formulated.
- 二十四、国家行政机关和企业事业单位、社会团体的印章，如因单位撤销、名称改变或换用新印章而停止使用时，应及时送交印章制发机关封存或销毁，或者按公安部会同有关部门另行制定的规定处理。 Article 24 The seals of the state administrative departments, enterprises and institutions and the social organizations, which will not be used again for the cancel of the organizations, the change of the title or the use of the new seals, shall be handed over to the seals making and distributing organizations for sealing up for keeping or destroy in time, or be disposed according to the other rules provided by the Ministry of Public Security of the People’s Republic of China jointly with other organizations concerned.
- 二十四、国家行政机关和企业事业单位、社会团体的印章，如因单位撤销、名称改变或换用新印章而停止使用时，应及时送交印章制发机关封存或销毁，或者按公安部会同有关部门另行制定的规定处理。 Article 24 The seals of the state administrative departments, enterprises and institutions and the social organizations, which will not be used again for the cancel of the organizations, the change of the title or the use of the new seals, shall be handed over to the seals making and distributing organizations for sealing up for keeping or destroy in time, or be disposed according to the other rules provided by the Ministry of Public Security of the People’s Republic of China jointly with other organizations concerned.
- 第二十四条公民、法人和其他组织发现可能造成社会影响的重大、紧急信访事项和信访信息时，可以就近向有关行政机关报告。 Article 24 Upon discovery of a complaint reporting matter or any information about a complaint reporting of major importance or urgency which may have social impact, a citizen, legal person or any other organization may report it to the nearest administrative authority.
- 第二十四条 县级以上的地方各级人民政府的复议机构，应当设在政府法制工作机构内或者与政府法制工作机构合署办公。 Article 24. Reconsideration offices of various local people's governments at or above the county level shall be established within the government's office of legislative affairs, or the government's office of legislative affairs will work in the name of the reconsideration office.
- 第二十四条 监察机关根据检查、调查结果，遇有下列情形之一的，可以作出监察决定或者提出监察建议： Article 24. Supervisory organs may make a decision or recommendation for supervision, if they find out one of the following circumstances in the results of inspection and investigation:
- 第二十四条 常务委员会委员长主持常务委员会会议和常务委员会的工作。副委员长、秘书长协助委员长工作。副委员长受委员长的委托，可以代行委员长的部分职权。 Article 24. The Chairman of the Standing Committee shall preside over meetings of the Standing Committee and direct its work. The Vice- Chairmen and the Secretary-General shall assist the Chairman in his work. When entrusted by the Chairman, a Vice-Chairman may exercise certain functions and powers of the Chairman.
- 第二十四条 有下列妨害社会管理秩序行为之一的，处十五日以下拘留、二百元以下罚款或者警告： Article 24. Whoever commits one of the following acts impairing the administration of social order shall be detained for a maximum of fifteen days, fined a maximum of two hundred yuan or given a warning:
- 第二十四条(2)举行集会、游行、示威的时间限于早六时至晚十时，经当地人民政府决定或者批准的除外。 Article 24The time for holding an assembly, a procession or a demonstration shall be limited to 6 a.m. - 10 p.m., with the exception of those held by decision or approval of the local people's governments.
- 第二十五条 在中国居留或者停留的年满16岁以上的外国人必须随身携带居留证件或者护照，以备外事民警查验。 Article 25 Alien at the age of 16 and upwards who reside or stay in China shall carry with them their residence certificates or passports for possible examination by police in charge of foreign affairs.
- 第二十五条 中国政府在国外受理外国人入境、过境申请的机关，是中国的外交代表机关、领事机关和外交部授权的其他驻外机关。 Article 25 China's diplomatic missions, consular offices and other resident agencies abroad authorized by the Ministry of Foreign Affairs shall be the Chinese Government's agencies abroad to handle aliens' applications for entry and transit.
- 第二十五条对于可能造成社会影响的重大、紧急信访事项和信访信息，有关行政机关应当在职权范围内依法采取措施，果断处理，防止不良影响的发生、扩大。 Article 25 For any complaint reporting matter or information about a complaint reporting of major importance or urgency which may have social impact, the relevant administrative authorities shall, within their duties and powers, take legal measures to handle the situation in a resolute and decisive manner to prevent the occurrence or expansion of adverse social impact.
