- 一、 本通知所称人民币外汇货币掉期，是指在约定期限内交换约定数量人民币与外币本金，同时定期交换两种货币利息的交易协议。本金交换的形式包括： 1. The term ""RMB and foreign exchange currency swap"" means a trading agreement on exchanging between a stipulated amount of RMB principal and a stipulated amount of foreign currency principal within the prescribed period of time and exchanging the interests on the two currencies on a regular basis. Principals may be exchanged in the following modes:
- （一）交易佣金属于基金、集合计划持有人的财产； 1. The trading commissions shall be the property of the holders of a fund or pool plan; and
- 一、外商投资企业以及外国企业在中国境内设立的机构、场所（以下称企业）以各种方式从政府无偿取得货币资产或非货币资产（以下称政府补助），应分别以下情况进行税务处理： 1. The various forms of monetary assets or non-monetary assets gratuitously acquired from the government (hereinafter referred to as government subsidies) by the agencies and offices set up by foreign-funded enterprises and foreign enterprises inside China (hereinafter referred to as enterprises) shall be dealt with respectively in light of the following circumstances:
- （一）没有仲裁协议的； 1. there is no arbitration agreement between the parties;
- （一）从事仲裁工作满八年的； 1. they have been engaged in arbitration work for at least eight years;
- （一）有仲裁协议； 1. they must have an arbitration agreement;
- （一）能够最大限度地满足招标文件中规定的各项综合评价标准； 1. to be able to satisfy the maximum various comprehensive assessment standards set in the tender documents; or
- （一）自主制定属于市场调节的价格；? 1. To fix prices that are subject to market regulation;
- （一）询问当事人或者有关人员，并要求其提供证明材料和与价格违法行为有关的其他资料；? 1. To inquire into people concerned or related personnel and demand for evidences or other materials relating to law-violating acts;
- （一）责令金融机构停业整顿或者吊销其经营许可证。 1. to order the financial institution to stop its business for internal rectification or revoking its business license;
- ㈠违反国家规定，擅自将外汇存放在境外的； 1. to pay, in violation of the government regulations, in Renminbi or in kind for imports that require payment in foreign exchange or for other similar types of expenses;
- ㈠违反国家规定，擅自将外汇存放在境外的； 1. to place foreign exchange deposit abroad without authorization and in violation of government regulations;
- ㈠擅自办理对外借款的； 1. to process external borrowing without authorization;
- （一）恐怖组织、恐怖分子募集、占有、使用资金或者其他形式财产。 1. to raise, possess or use funds or other forms of property by terrorist organizations or terrorists;
- 一、整顿边地贸易经营秩序、制止假冒伪劣商品出境，既是关系边地贸易发展前途和生命力的一件大事，也是关系国家和民族声誉的一个政治问题。 1. To rectify the management order of frontier and local trade and check the flow of the fake and low-quality commodities across the border is not only an important issue in relation to the future and vitality of the development of frontier and local trade, but also a political issue affecting the reputation of our State and nation.
- ㈠以外币在境内计价结算的； 1. to use foreign exchange in China for pricing or settlement;
- （一）相互串通，操纵市场价格，损害其他经营者或者消费者的合法权益；? 1. To work collaboratively with others to control market prices to great detriments to the lawful rights and interests of other business operators or consumers;
- （一）与该货物同时或者大约同时向同一国家或者地区出口的相同货物的成交价格； 1. transaction value of the same goods that are exported to the same country or region at the same time or at approximately the same time;
