未取得医生执业资格的人擅自为他人进行节育复通手术、假节育手术、终止妊娠手术或者摘取宫内节育器，情节严重的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；严重损害就诊人身体健康的，处三年以上十年以下有期徒刑，并处罚金；造成就诊人死亡的，处十年以上有期徒刑，并处罚金。 Whoever, without obtaining the qualification for practising medicine, undoes a contraception operation, or performs a false contraception operation or an operation for terminating gestation or for removing intrauterine devices, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance and shall also, or shall only, be fined; if severe harm is caused to the health of the person seeking medical service, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years and shall also be fined; if the consequences are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined.以牟利为目的，在林区非法收购明知是盗伐、滥伐的林木，情节严重的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；情节特别严重的，处三年以上七年以下有期徒刑，并处罚金。 Whoever,forthepurposeofprofit,illegallypurchasesinaforestareatrees,bamboo,etc.,whichheknowsarefelledstealthilyorarbitrarily,ifthecircumstancesareserious,shallbesentencedtofixed-termimprisonmentofnotmorethanthreeyears,criminaldetentionorpublicsurveillanceandshallalso,orshallonly,befined;ifthecircumstancesareespeciallyserious,heshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsbutnotmorethansevenyearsandshallalsobefined.违反狩猎法规，在禁猎区、禁猎期或者使用禁用的工具、方法进行狩猎，破坏野生动物资源，情节严重的，处三年以下有期徒刑、拘役、管制或者罚金。 Whoever,inviolationofthelaworregulationsonhunting,huntswildlifeinanareaorduringaseasonclosedtohuntingorusesprohibitedhuntinggearormethodsforthepurpose,thusdamagingwildliferesources,ifthecircumstancesareserious,shallbesentencedtofixed-termimprisonmentofnotmorethanthreeyears,criminaldetention,orpublicsurveillanceorbefined.违反森林法的规定，滥伐森林或者其他林木，数量较大的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；数量巨大的，处三年以上七年以下有期徒刑，并处罚金。 Whoever,inviolationoftheprovisionsoftheForestryLaw,arbitrarilyfellstrees,bamboo,etc.inforestorwoods,iftheamountinvolvedisrelativelylarge,shallbesentencedtofixed-termimprisonmentofnotmorethanthreeyears,criminaldetentionorpublicsurveillanceandshallalso,orshallonly,befined;iftheamountinvolvedishuge,heshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsbutnotmorethansevenyearsandshallalsobefined.违反矿产资源法的规定，采取破坏性的开采方法开采矿产资源，造成矿产资源严重破坏的，处五年以下有期徒刑或者拘役，并处罚金。 Whoever,inviolationoftheprovisionsoftheMineralResourcesLaw,minesmineralresourcesinadestructiveway,thuscausingseveredamagetomineralresources,shallbesentencedtofixed-termimprisonmentofnotmorethanfiveyearsorcriminaldetentionandshallalsobefined.强迫他人吸食、注射毒品的，处三年以上十年以下有期徒刑，并处罚金。 Whoeverforcesanotherpersontoingestorinjectnarcoticdrugsshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsbutnotmorethan10yearsandshallalsobefined.非法种植罂粟三千株以上或者其他毒品原植物数量大的，处五年以上有期徒刑，并处罚金或者没收财产。 Whoeverillegallycultivatesopiumpoppyofnotlessthan3,000plantsoranymotherplantsofothernarcoticdrugsinlargequantitiesshallbesentencedtofixed-termimprisonmentofnotlessthanfiveyearsandshallalsobefinedorbesentencedtoconfiscationofproperty.引诱、教唆、欺骗或者强迫未成年人吸食、注射毒品的，从重处罚。 Whoeverlures,aidsandabetsorcheatsaminorintodrugingestionorinjectionorforcesaminortoingestorinjectnarcoticdrugsshallbegivenaheavierpunishment.利用、教唆未成年人走私、贩卖、运输、制造毒品，或者向未成年人出售毒品的，从重处罚。 Whoevermakesuseofminorsoraidsandabetsthemtosmuggle,trafficin,transportormanufacturenarcoticdrugsorsellsnarcoticdrugstominorsshallbegivenaheavierpunishment.明知他人制造毒品而为其提供前款规定的物品的，以制造毒品罪的共犯论处。 Whoeverprovidesanotherpersonwiththesubstancesmentionedintheprecedingparagraph,whileclearlyknowingthatthepersonmanufacturesnarcoticdrugs,shallberegardedasajointoffenderinthecrimeofmanufacturingnarcoticdrugsandpunishedassuch.走私、贩卖、运输、制造毒品，有下列情形之一的，处十五年有期徒刑、无期徒刑或者死刑，并处没收财产： Whoeversmuggles,trafficsin,transportsormanufacturesnarcoticdrugsandfallsunderanyofthefollowingcategories,shallbesentencedtofixed-termimprisonmentof15years,lifeimprisonmentordeathandalsotoconfiscationofproperty:走私、贩卖、运输、制造鸦片不满二百克、海洛因或者甲基苯丙胺不满十克或者其他少量毒品的，处三年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处三年以上七年以下有期徒刑，并处罚金。 Whoeversmuggles,trafficsin,transportsormanufacturesopiumoflessthan200grams,orheroinormethylanilineoflessthan10gramsoranyothernarcoticdrugsofsmallquantitiesshallbesentencedtofixed-termimprisonmentofnotmorethanthreeyears,criminaldetentionorpublicsurveillanceandshallalsobefined;ifthecircumstancesareserious,heshallbesentencedtofixed-termimprisonmentofnotlessthanthreeyearsbutnotmorethansevenyearsandshallalsobefined.走私、贩卖、运输、制造鸦片二百克以上不满一千克、海洛因或者甲基苯丙胺十克以上不满五十克或者其他毒品数量较大的，处七年以上有期徒刑，并处罚金。 Whoeversmuggles,trafficsin,transportsormanufacturesopiumofnotlessthan200gramsbutlessthan1,000grams,orheroinormethylanilineofnotlessthan10gramsbutlessthan50gramsoranyothernarcoticdrugsofrelativelylargequantitiesshallbesentencedtofixed-termimprisonmentofnotlessthansevenyearsandshallalsobefined.盗伐、滥伐国家级自然保护区内的森林或者其他林木的，从重处罚。 Whoeverstealthilyorarbitrarilyfellstrees,bamboo,etc.inforestorwoods,ofnaturereservesatthenationallevelshallbegivenaheavierpunishment.遗嘱必须表示遗嘱人的真实意思，受胁迫、欺骗所立的遗嘱无效。 Wills shall manifest the genuine intention of the testators; those made under duress or as a result of fraud shall be void.辩护律师经人民检察院或者人民法院许可，并且经被害人或者其近亲属、被害人提供的证人同意，可以向他们收集与本案有关的材料。 With permission of the People's Procuratorate or the People's Court and with the consent of the victim, his near relatives or the witnesses provided by the victim, defence lawyers may collect information pertaining to the current case from them.营业性射击场配置射击运动枪支，由省级人民政府公安机关报国务院公安部门批准。 With regard to equipment with sports guns for profit-making shooting grounds, the matter shall be submitted by the public security organ of a people's government at the provincial level to the public security department under the State Council for approval.配备、配置给个人使用的枪支，必须采取有效措施，严防被盗、被抢、丢失或者发生其他事故。 With regard to guns armed or equipped for personal use, effective measures must be taken strictly to prevent their being stolen, robbed or lost, as well as other accidents.对交由个人使用的枪支，必须建立严格的枪支登记、交接、检查、保养等管理制度，使用完毕，及时收回。 With regard to guns for personal use, a strict control system must be established for registration, handing over, inspection and maintenance of the guns, and the guns must be taken back as soon as they are not to be used any more.对于补充侦查的案件，人民检察院仍然认为证据不足，不符合起诉条件的，可以作出不起诉的决定。 With respect to a case for which supplementary investigation has been conducted, if the People's Procuratorate still believes that the evidence is insufficient and the case does not meet the conditions for initiation of a prosecution, the People's Procuratorate may decide not to initiate a prosecution.对于补充侦查的案件，人民检察院仍然认为证据不足，不符合起诉条件的，可以作出不起诉的决定。 With respect to a case for which supplementary investigation has been conducted, if the People's Procuratorate still believes that the evidence is insufficient and the case does not meet the conditions for initiation of a prosecution, the People's Procuratorate may decide not to initiate a prosecution.人民检察院决定不起诉的案件，应当同时对侦查中扣押、冻结的财物解除扣押、冻结。 With respect to a case for which the People's Procuratorate has decided not to initiate a prosecution, the People's Procuratorate shall, at the same time, cancel the seizure or freeze of the property or things of value seized or frozen during the period of investigation.
