第四条国务院卫生行政部门主管全国的医师工作。 Article 4 The administrative department of health under the State Council shall be responsible for the work for doctors throughout the country.第四条国务院卫生行政部门主管全国母婴保健工作，根据不同地区情况提出分级分类指导原则，并对全国母婴保健工作实施监督管理。 Article 4 The administrative department of public health under the State Council shall be in charge of the work of maternal and infant health care throughout the country, put forth the guiding principles for the work in different areas and at different administrative levels in light of their specific conditions, and exercise supervision and management of the nationwide work of maternal and infant health care.第四条检验检疫机构根据医疗器械进口单位的管理水平、诚信度、进口医疗器械产品的风险等级、质量状况和进口规模，对医疗器械进口单位实施分类监管，具体分为三类。 Article 4 The IQ organs shall perform the classified surveillance over the medical instrument importers according to the level of management and credibility thereof and the risk level, quality and import scale of the imported medical instruments, and there are three categories specifically.第四条 中国红十字会遵守宪法和法律，遵循国际红十字和红新月运动确立的基本原则，依照中国参加的日内瓦公约及其附加议定书和中国红十字会章程，独立自主地开展工作。 Article 4 The Red Cross Society of China shall abide by the Constitution and laws of China, adhere to the Fundamental Principles laid down by the International Red Cross and the Red Crescent Movement, and carry out its work independently in accordance with the Geneva Conventions and their Additional Protocols acceded to by China and the Statutes of the Red Cross Society of China.第四条 国家鼓励研究和创制新药，保护公民、法人和其他组织研究、开发新药的合法权益。 Article 4 The State shall encourage the research and production of new medicine and protect the legal rights and interests of its citizens, natural persons and other organizations in the research and development of new medicine.第四条 各级政府领导传染病防治工作，制定传染病防治规划，并组织实施。 Article 4. Governments at various levels shall direct the work of preventing and treating infectious diseases, draw up programmes for the prevention and treatment of infectious diseases and be responsible for their implementation.第四十条（医疗证明文件的出具） Article 40 (Issuance of Medical Certificates)第四十条阻碍医师依法执业，侮辱、诽谤、威胁、殴打医师或者侵犯医师人身自由、干扰医师正常工作、生活的，依照治安管理处罚条例的规定处罚；构成犯罪的，依法追究刑事责任。 Article 40 Anyone who obstructs a doctor from his legal practice of medicine, insults, slanders, threats or strikes a doctor, or encroaches on the personal freedom of a doctor, or interferes in normal work and life of a doctor shall be penalized according to the provisions of the Regulations on Administrative Penalties for Public Security; if a crime has been constituted, criminal liability shall be investigated according to law.第四十条 药品必须从允许药品进口的口岸进口，并由进口药品的企业向口岸所在地药品监督管理部门登记备案。海关凭药品监督管理部门出具的《进口药品通关单》放行。无《进口药品通关单》的，海关不得放行。 Article 40 Pharmaceuticals must be imported through the ports which allow the import of pharmaceuticals, and the pharmaceutical import enterprise shall submit a report to the pharmaceutical supervisory and administrative department of the place where the port is located. Customs shall rely on the Import Pharmaceuticals Customs Form issued by the pharmaceutical supervisory and administrative department to proceed. Those without the Import Pharmaceuticals Customs Form shall not be permitted to pass through customs.第四十条用于科研及其他非作用于患者目的的进口旧医疗器械，经国家质检总局及其他相关部门批准后，方可进口。 Article 40 The used medical instruments for scientific research or other non-applied-to-patient purposes may be imported only upon the approvals of the GAQSIQ and other relevant authorities.第四十条 国务院卫生行政部门根据本法制定实施办法，报国务院批准后施行。 Article 40. The health administration department under the State Council shall, in accordance with this Law, formulate rules for its implementation which shall come into force after being submitted to and approved by the State Council.第四十一条（保护性医疗措施） Article 41 (Protective Medical Measure)第四十一条医疗、预防、保健机构未依照本法第十六条的规定履行报告职责，导致严重后果的，由县级以上人民政府卫生行政部门给予警告；并对该机构的行政负责人依法给予行政处分。 Article 41 If any institution of medical treatment, prevention or health care fails to perform its duty of reporting according to the provisions of Article 16 of this Law and thereby causes severe consequences, the administrative department of health under the people’s government at or above the county level shall give it a warning and impose disciplinary sanctions upon the person in charge of this institution according to law.第四十一条 国务院药品监督管理部门对下列药品在销售前或者进口时，指定药品检验机构进行检验；检验不合格的，不得销售或者进口： Article 41 The pharmaceutical supervisory and administrative department under the State Council shall appoint inspection institutions to carry out inspections before the sale and import of the following pharmaceuticals. Those having not passed the inspection shall not be allowed to be sold or imported.第四十一条擅自销售、使用未报检或者未经检验的属于法定检验的进口医疗器械，或者擅自销售、使用应当申请进口验证而未申请的进口医疗器械的，由检验检疫机构没收违法所得，并处商品货值金额5%以上20%以下罚款；构成犯罪的，依法追究刑事责任。 Article 41 Where any importer sells or uses the imported medical instruments that is subject to the statutory inspection and fails to apply for the inspection or to go through the inspection, or it sells or uses the imported medical instruments that fails to be applied for the import verification that it should be, it shall be confiscated of the illegal income by an IQ organ, and be imposed upon a fine of 5 percent or not more than 20 percent of the value of commodities; if any crime is constituted, the criminal liability shall be investigated in accordance with relevant laws.第四十一条 本法自１９８９年９月１日起施行。 Article 41. This Law shall come into force as of September 1, 1989.第四十二条（医疗纠纷报告制度） Article 42 (The Report System for Medical Disputes)第四十二条卫生行政部门工作人员或者医疗、预防、保健机构工作人员违反本法有关规定，弄虚作假、玩忽职守、滥用职权、徇私舞弊，尚不构成犯罪的，依法给予行政处分；构成犯罪的，依法追究刑事责任。 Article 42 Personnel of the administrative department of health or of any institution of medical treatment, prevention or health care who, in violation of relevant provisions of this Law, practice fraud, neglect duties, abuse powers or engage in malpractice for their personal gains, if the act has not constituted a crime, shall be imposed disciplinary sanctions according to law; if the act has constituted a crime, the offender shall be investigated for criminal liability according to law.第四十二条 国务院药品监督管理部门对已经批准生产或者进口的药品，应当组织调查；对疗效不确、不良反应大或者其他原因危害人体健康的药品，应当撤销批准文号或者进口药品注册证书。 Article 42 The pharmaceutical supervisory and administrative department under the State Council shall organize investigations on medicines which have been approved for production or import. It shall revoke the registered documents of approval or the registered certificate of import if it discovers that the curative effects of the medicines are uncertain or poor, that they produce serious adverse reactions, or that for other reasons they are harmful to people's health.第四十二条销售、使用经法定检验、抽查检验或者验证不合格的进口医疗器械的，由检验检疫机构责令停止销售、使用，没收违法所得和违法销售、使用的商品，并处违法销售、使用的商品货值金额等值以上3倍以下罚款；构成犯罪的，依法追究刑事责任。 Article 42 Where any importer sells or uses the imported medical instruments that are unqualified after the statutory inspection, sample inspection or verification, it shall be ordered by an IQ organ to stop sales or use, its illegal income and illegally sold or used commodities shall be confiscated, and it shall be imposed upon a fine of the value or not more than three times the value of commodities as sold or used illegally; if any crime is constituted, the criminal liability shall be investigated in accordance with relevant laws.第四十三条（医疗执业活动的限制） Article 43 (Restrictions on Medical Practising Activities)第四十三条 国家实行药品储备制度。 Article 43 A pharmaceutical reserve system shall be carried out by the State.第四十三条医疗器械的进口单位进口国家禁止进口的旧医疗器械的，按照国家有关规定予以退货或者销毁。 Article 43 Where any importer of medical instruments imports the used medical instruments that are forbidden from being imported by the state, it shall return or destroy the said instruments in accordance with the relevant provisions of the state.第四十三条本法颁布之日前按照国家有关规定取得医学专业技术职称和医学专业技术职务的人员，由所在机构报请县级以上人民政府卫生行政部门认定，取得相应的医师资格。 Article 43 With respect to those who obtained technical titles and technical posts in medicine according to relevant state provisions before the date of promulgation of this Law, the institutions to which they belong shall report the case to the administrative department of health under the people’s government at or above the county level for ratification and then the qualifications as doctors shall be granted respectively to them.第四十四条（医疗费用） Article 44 (Medical Fees)
