第三十二条 药品必须符合国家药品标准。中药饮片依照本法第十条第二款的规定执行。 Article 32 Pharmaceuticals must meet the pharmaceutical standards of the State. Article 10 (2) of this Law shall be applied to traditional Chinese medicines prepared in ready-to-use forms.第三十二条县级以上人民政府卫生行政部门负责指导、检查和监督医师考核工作。 Article 32 The administrative department of health under the people’s government at or above the county level shall be responsible for guiding, inspecting and supervising evaluation of doctors.第三十二条国家质检总局建立对进口医疗器械的风险预警机制。通过对缺陷进口医疗器械等信息的收集和评估，按照有关规定发布警示信息，并采取相应的风险预警措施及快速反应措施。 Article 32 The GAQSIQ shall set up a risk warning mechanism for imported medical instruments, it shall issue warning information under relevant provisions and adopt corresponding risk warning measures and fast response measures by collecting and assessing the information concerning the defective imported medical instruments.第三十二条 各级政府卫生行政部门对传染病防治工作行使下列监督管理职权： Article 32. Health administration departments of governments at various levels shall exercise the following supervisory and managerial functions and powers regarding the prevention and treatment of infectious diseases:第三十三条（医疗机构名称的使用） Article 33 (Use of the Name of a Medical Institution)第三十三条检验检疫机构需定期了解辖区内使用的进口医疗器械的质量状况，发现进口医疗器械发生重大质量事故，应及时报告国家质检总局。 Article 33 An IQ organ shall be aware of the information relating to the quality of imported medical instruments as used within its jurisdiction at regular intervals, and report to the GAQSIQ timely, if any major quality accident concerning imported medical instruments is found.第三十三条从事本法规定的遗传病诊断、产前诊断的人员，必须经过省、自治区、直辖市人民政府卫生行政部门的考核，并取得相应的合格证书。 Article 33 Personnel engaged in making genetic disease diagnosis or prenatal diagnosis as provided by this Law must pass the examination of the administrative department of public health under the people's government of the province, autonomous region or municipality directly under the Central Government, and obtain a corresponding qualification certificate.第三十三条 国务院药品监督管理部门组织药学、医学和其他技术人员，对新药进行审评，对已经批准生产的药品进行再评价。 Article 33 The pharmaceutical supervisory and administrative department under the State Council may organize pharmaceutical, medicinal and other technological personnel to carry out examination and evaluation of new medicines, and to reevaluate medicines already placed into production.第三十三条医师有下列情形之一的，县级以上人民政府卫生行政部门应当给予表彰或者奖励： Article 33 Under any of the following circumstances, the administrative department of health under the people’s government at or above the county level should commend or give awards to the doctors.第三十三条 各级政府卫生行政部门和受国务院卫生行政部门委托的其他有关部门卫生主管机构以及各级各类卫生防疫机构内设立传染病管理监督员，执行卫生行政部门或者其他有关部门卫生主管机构交付的传染病监督管理任务。 Article 33. The health administration departments of governments at various levels, the institutions in charge of health of other departments concerned authorized by the health administration department under the State Council, and health and anti-epidemic agencies at various levels and of different types shall appoint supervisors of infectious disease management to execute the tasks of surveillance and management of infectious diseases assigned by the health administration departments or the institutions in charge of health of other departments concerned.第三十四条（明示制度） Article 34 (The Display System)第三十四条从事母婴保健工作的人员应当严格遵守职业道德，为当事人保守秘密。 Article 34 Personnel engaged in the work of maternal and infant health care shall strictly abide by the professional ethics and keep secrets for the parties concerned.第三十四条 药品生产企业、药品经营企业、医疗机构必须从具有药品生产、经营资格的企业购进药品；但是，购进没有实施批准文号管理的中药材除外。 Article 34 Pharmaceutical producing enterprises, pharmaceutical trading enterprises and medical organizations must purchase pharmaceuticals from the qualified enterprises with the certificates for production and trade of pharmaceuticals. However, this does not apply to the purchase of the traditional Chinese medicinal herbs which are not controlled under the registered document of approval.第三十四条县级以上人民政府卫生行政部门应当制定医师培训计划，对医师进行多种形式的培训，为医师接受继续医学教育提供条件。 Article 34 The administrative department of health under the people’s government at or above the county level should work out plans for training of doctors, train doctors in various forms and provide conditions for doctors to receive continued medical education.第三十四条进口医疗器械的制造商、进口单位和使用单位在发现其医疗器械中有缺陷的应当向检验检疫机构报告，对检验检疫机构采取的风险预警措施及快速反应措施应当予以配合。 Article 34 Where any defect in the medical instrument is found by the producer, importer or user thereof, it shall be reported to the IQ organ, and assistance shall be made in the risk warning measures and fast response measures taken by the IQ organ.第三十四条 各级各类医疗保健机构设立传染病管理检查员，负责检查本单位及责任地段的传染病防治管理工作，并向有关卫生防疫机构报告检查结果。 Article 34. The medical care and health institutions at various levels and of different types shall appoint inspectors of infectious disease management to inspect the prevention and treatment of infectious diseases in their respective units and in the communities for which they are responsible, and report the results of inspection to the health and anti-epidemic agencies concerned.第三十五条（门诊、急诊、住院诊疗制度） Article 35 (The System of Ambulatory Treatment, Emergency Treatment and Hospitalization)第三十五条对缺陷进口医疗器械的风险预警措施包括： Article 35 As for any defective imported medical instrument, the risk warning measures shall include:第三十五条 国家对麻醉药品、精神药品、医疗用毒性药品、放射性药品，实行特殊管理。管理办法由国务院制定。 Article 35 For narcotics, psychotropic substances, toxic drugs for medicinal use, and radioactive drugs, the State Council shall formulate administrative measures to carry out special control.第三十五条医疗、预防、保健机构应当按照规定和计划保证本机构医师的培训和继续医学教育。 Article 35 Institutions of medical treatment, prevention or health care should guarantee training and continued medical education of their own doctors according to provisions and planning.第三十五条未取得国家颁发的有关合格证书的，有下列行为之一，县级以上地方人民政府卫生行政部门应当予以制止，并可以根据情节给予警告或者处以罚款： Article 35 Where anyone who has not obtained a relevant qualification certificate issued by the State commits any of the following acts, the administrative department of public health under the local people's government at or above the county level shall stop such act and give a warning to or impose a fine upon him in light of the circumstances:第三十五条 违反本法规定，有下列行为之一的，由县级以上政府卫生行政部门责令限期改正，可以处以罚款；有造成传染病流行危险的，由卫生行政部门报请同级政府采取强制措施： Article 35. Any unit or individual who, in violation of the provisions of this Law, commits any of the following acts shall be ordered to rectify it or may be fined by the health administration department of a government at or above the county level; when there is a risk of causing an epidemic of an infectious disease, the health administration department shall report to the government at the same level for the adoption of compulsory measures:第三十六条（危重病人的处理） Article 36 (Treatment of Patients in Serious Case)第三十六条对缺陷进口医疗器械的快速反应措施包括： Article 36 As for the defective imported medical instruments, the fast response measures shall include:第三十六条以不正当手段取得医师执业证书的，由发给证书的卫生行政部门予以吊销；对负有直接责任的主管人员和其他直接责任人员，依法给予行政处分。 Article 36 If anyone obtains the practicing certificate for doctors by unjustified means, the administrative department of health issuing the practicing certificate shall revoke the practicing certificate. The person in charge directly responsible and other persons directly responsible shall be imposed disciplinary sanctions according to law.
