- 第十一条 申请商标注册的，应当按规定的商品分类表填报使用商标的商品类别和商品名称。 Article 11. An applicant for the registration of a trademark shall, in a form, indicate, in accordance with the prescribed classification of goods, the class of the goods and the designation of the goods in respect of which the trademark is to be used.
- 第十一条 合作作品不可以分割使用的，合作作者对著作权的行使如果不能协商一致，任何一方无正当理由不得阻止他方行使。 Article 11. Where joint authors failed to reach an agreement on the exercise of copyright in a work of joint authorship which can not be used piecemeal, any party may not unreasonably prohibit the exercise by others of the said copyright.

- 第一百一十条 有关部门收到遗失物，知道权利人的，应当及时通知其领取；不知道的，应当及时发布招领公告。 Article 110 After receiving a lost-and-found object, the related department shall notify the right holder to claim the object in a timely manner in case it knows who is the right holder; it shall publish an announcement on the claiming of the lost property in a timely manner in case it does not know.
- 第一百一十条 申请人发现提交的说明书、权利要求书或者附图中的文字的中文译文存在错误的，可以在下列规定期限内依照原始国际申请文本提出改正： Article 110 Where the applicant discovers any diction errors in the Chinese translation of the submitted specification, patent claim or appended drawings, he/it may, within the following provided time limit, make a request for a correction in accordance with the original international application:
- 第一百一十一条 对要求获得发明专利权的国际申请，国务院专利行政部门经初步审查认为符合专利法和本细则有关规定的，应当在专利公报上予以公布； Article 111 For an international application claiming the patent right for invention, the administrative department for patent under the State Council shall, if considering it to be in conformity with relevant provisions in the Patent Law and these Rules after the preliminary examination, publish it in the Patent Gazette;
- 第一百一十一条 拾得人在遗失物送交有关部门前，有关部门在遗失物被领取前，应当妥善保管遗失物。因故意或者重大过失致使遗失物毁损、灭失的，应当承担民事责任。 Article 111 The person who finds the object shall properly keep it before it is handed over to the related department, and the related department also shall do so before it is claimed by the right holder. Where the object is injured or lost deliberately or for gross negligence, the personnel concerned shall assume the civil liabilities.
- 第一百一十二条 权利人领取遗失物时，应当向拾得人或者有关部门支付保管遗失物等支出的必要费用。 Article 112 The right holder of the object, when obtaining a lost-and-found object, shall pay the person who finds the object or the related department such necessary expenses as the cost for safekeeping the object.
- 第一百一十二条 国际申请包含两项以上发明或者实用新型的，申请人在办理进入中国国家阶段手续后，依照本细则第四十二条第一款的规定，可以提出分案申请。 Article 112 Where an international application contains two or more inventions or utility models, the applicant may, after fulfilling the formalities for the entry of the National Phase in China, file a division of application in accordance with Paragraph 1 of Article 42 of these Rules.
- 第一百一十三条 遗失物自发布招领公告之日起六个月内无人认领的，归国家所有。 Article 113 In case a lost-and-found object fails to be claimed within 6 months as of the date when the claiming announcement o is published, it shall be owned by the state.
- 第一百一十三条 申请人依照本细则第一百零一条的规定提交文件和缴纳费用的，以国务院专利行政部门收到文件之日为提交日、收到费用之日为缴纳日。 Article 113 Where the applicant submit the documents or pay the fees in accordance with Article 101 of these Rules, the date when the administrative department for patent under the State Council receives the documents shall be regarded as the submission date, and the date when it receives the fees shall be regarded as the payment date.
- 第一百一十四条 拾得漂流物、发现埋藏物或者隐藏物的，参照拾得遗失物的有关规定。文物保护法等法律另有规定的，依照其规定。 Article 114 As regards the finding of a drifter or the discovery of an object buried underground or a hidden property, the relevant provisions on the finding of a lost-and-found property shall apply by analogy. Where there is any other provision in such laws as the law concerning the protection of cultural relics, such provisions shall prevail.
- 第一百一十四条 国际申请要求优先权的，申请人应当在办理进入中国国家阶段手续时缴纳优先权要求费；未缴纳或者未足额缴纳的，国务院专利行政部门应当通知申请人在指定的期限内缴纳；期满仍未缴纳或者未足额缴纳的，视为未要求该优先权。 Article 114 Where the right of priority is claimed in an international application, the applicant shall, when fulfilling the formalities for the entry of the National Phase in China, pay the fee for claiming the right of priority; if the said fee has not been paid or fully paid, the administrative department for patent under the State Council shall notify the applicant to make the payment within a specified time limit; where it has still not been paid or fully paid at the expiry of the time limit, the right of priority shall be deemed to have not been claimed.
- 第一百一十五条 主物转让的，从物随主物转让，但当事人另有约定的除外。 Article 115 Unless it is otherwise stipulated by the parties concerned, the accessory res shall be alienated together with the alienation of the principal res.
- 第一百一十五条 国际申请在国际阶段被有关国际单位拒绝给予国际申请日或者宣布视为撤回的，申请人在收到通知之日起２个月内，可以请求国际局将国际申请档案中任何文件的副本转交国务院专利行政部门，并在该期限内向国务院专利行政部门办理本细则第一百零一条规定的手续； Article 115 Where, in the International Phase, an international application is refused by a relevant international entity to grant an international application date on it or is declared to be deemed to have been withdrawn, the applicant may, within 2 months as of his/its receipt of the notice, request the International Bureau to transfer the copy of any document in the file of the international application to the administrative department for patent under the State Council, and fulfill the formalities provided in Article 101 of these Rules in the administrative department for patent under the State Council within this period.
- 第一百一十六条 天然孳息，由所有权人取得；既有所有权人又有用益物权人的，由用益物权人取得。当事人另有约定的，按照约定。 Article 116 Natural fruits shall be enjoyed by the owner; it shall be obtained by the holder of usufructuary right where there are both owner and holder of usufructuary right. In case there are otherwise stipulations between by the parties concerned, such stipulation shall apply.
- 第一百一十六条 基于国际申请授予的专利权，由于译文错误，致使依照专利法第五十六条规定确定的保护范围超出国际申请的原文所表达的范围的，以依据原文限制后的保护范围为准； Article 116 Where, for the patent right granted upon the international application, the protection scope determined in accordance with Article 56 of the Patent Law has exceeded the scope expressed in the original text of the international application due to errors in the translation, the protection scope which is limited on the basis of the original text shall prevail;
- 第一百一十七条 经国务院专利行政部门同意，任何人均可以查阅或者复制已经公布或者公告的专利申请的案卷和专利登记簿，并可以请求国务院专利行政部门出具专利登记簿副本。 Article 117 Any person may, upon approval by the administrative department for patent under the State Council, inspect or copy the files of the published or announced patent applications and the Patent Register, and may request the administrative department for patent under the State Council to issue a copy of the Patent Register.
- 第一百一十七条 用益物权人对他人所有的不动产或者动产，依法享有占有、使用和收益的权利。 Article 117 As regards the realty or chattel owned by someone else, a usufructuary right holder is entitled to possess, use and seek proceeds from it in accordance with law.
- 第一百一十八条 向国务院专利行政部门提交申请文件或者办理各种手续，应当使用国务院专利行政部门制定的统一格式，由申请人、专利权人、其他利害关系人或者其代表人签字或者盖章； Article 118 Any application document which is submitted to, and any formalities which are fulfilled in the administrative department for patent under the State Council, shall use the unified format prepared by the administrative department for patent under the State Council which shall be signed or sealed by the applicant, the patent holder, any other interested person or his/its representative.
- 第一百一十八条 国家所有或者国家所有由集体使用以及法律规定属于集体所有的自然资源，单位、个人依法可以占有、使用和收益。 Article 118 As regards the natural resources that are owned by the state or that are owned by the state but used by the collective as well as those that are owned by the collective as prescribed by law, an entity or individual may possess, use and seek proceeds from them.
- 第一百一十九条 向国务院专利行政部门邮寄有关申请或者专利权的文件，应当使用挂号信函，不得使用包裹。 Article 119 The documents relating to a patent application or patent right which are mailed to the administrative department for patent under the State Council shall be mailed by registered letter, not by parcel.
- 第一百一十九条 国家实行自然资源有偿使用制度，但法律另有规定的除外。 Article 119 Unless it is otherwise prescribed by any law, the state practices the system of paid use of natural resources.
- 第十一条 发明和实用新型专利权被授予后，除本法另有规定的以外，任何单位或者个人未经专利权人许可，都不得实施其专利，即不得为生产经营目的制造、使用、许诺销售、销售、进口其专利产品，或者使用其专利方法以及使用、许诺销售、销售、进口依照该专利方法直接获得的产品。 Article 11?After the grant of the patent right for an invention or utility model, except where otherwise provided for in this Law, no entity or individual may, without the authorization of the patentee, exploit the patent, that is, make, use, offer to sell, sell or import the patented product, or use the patented process, and use, offer to sell, sell or import the product directly obtained by the patented process, for production or business purposes.
