- （一）科学发现； (1) scientific discoveries;
- （一）认真执行文物政策法令，保护文物成绩显著的； (1) serious implementation of the policies, laws and regulations concerning cultural relics and remarkable achievements in protecting cultural relics;
- （一）具有历史、艺术、科学价值的古文化遗址、古墓葬、古建筑、石窟寺和石刻； (1) sites of ancient culture, ancient tombs, ancient architectural structures, cave temples and stone carvings that are of historical, artistic or scientific value;
- （一）在申请日前或者最迟在申请日（有优先权的，指优先权日），将该生物材料的样品提交国务院专利行政部门认可的保藏单位保藏，并在申请时或者最迟自申请日起４个月内提交保藏单位出具的保藏证明和存活证明； (1) submit a sample of the biomaterial to a depository institution admitted by the administrative department for patent under the State Council before the application date, or, at the latest, on the application date (or the priority date if there is a right of priority concerned) for deposit, and submit, at the time of application, or, at the latest, within 4 months as of the application date, a receipt of deposit and the viability proof from the depository institution;
- （一）提交其国际申请进入中国国家阶段的书面声明。声明中应当写明国际申请号，并以中文写明要求获得的专利权类型、发明创造的名称、申请人姓名或者名称、申请人的地址和发明人的姓名，上述内容应当与国际局的记录一致； (1) submit the written declaration of the international application to enter the National Phase in China; the international application number shall be indicated in the declaration, and the type of patent right which is required to be obtained, the name of the invention-creation, the name of the applicant, the address of the applicant and the name of the inventor shall be indicated in Chinese; the above-mentioned contents shall be consistent with the records in the International Bureau;
- （1）改革开放以来，我国经济社会持续快速发展，科学技术和文化创作取得长足进步，创新能力不断提升，知识在经济社会发展中的作用越来越突出。我国正站在新的历史起点上，大力开发和利用知识资源，对于转变经济发展方式，缓解资源环境约束，提升国家核心竞争力，满足人民群众日益增长的物质文化生活需要，具有重大战略意义。 (1)???? Since the reform and opening-up, China has enjoyed a sustained and fast economic and social development, made a marked progress in science and technology as well as cultural creation, and substantially improved its innovative ability, and the intellect has been playing an increasingly important role in the economic and social development. As China is standing at a new historical starting point, it is strategically significant to develop and utilize intellectual resources with great efforts, transform economic developing modes, release constrains from the resource environment, enhance state core competitiveness and satisfy people’s growing needs for material and cultural lives.
- （十二）整理，指对内容零散、层次不清的已有文字作品或者材料进行条理化、系统化的加工，如古籍的校点、补遗等。 (12) Sorting-out is the rearrangement of pre-existing works or materials by changing their former state of being fragmented and poorly-ordered into a one of being systematic and orderly, such as the glossing and repairing of ancient classics.
- （二）盗运珍贵文物出口或者进行文物投机倒把活动情节严重的； (2) serious cases of smuggling valuable cultural relics out of thecountry or speculating in cultural relics;
- （二）符合规定的软件鉴别材料。 (2) Software identifying material in keeping with the rules.
- （二）录音制品，指任何声音的原始录制品； (2) Sound recordings refers to the original recordation of any sounds;
- （二） 供役地和需役地的位置； (2) []s of servient tenement and dominant tenement;
- （三）将私人收藏的文物私自卖给外国人的，由工商行政管理部门罚款，并可没收其文物和非法所得。 (3) selling cultural relics in private collections to foreigners without permission, for which the persons involved shall be fined by the departments for the administration of industry and commerce, and the cultural relics in question and the illegal earnings derived therefrom may be confiscated.
- （三）软件开发者：指实际组织、进行开发工作，提供工作条件以完成软件开发，并对软件承担责任的法人或者非法人单位（简称单位，下同）；依靠自己具有的条件完成软件开发，并对软件承担责任的公民。 (3) Software developers: refers to those legal persons or units which are not legal persons (hereinafter referred to as units) who actually organize, undertake the work of development, and provide working conditions to complete the development of software and who take responsibility for the software as well; citizens who rely on their own conditions to complete software and who take responsibility for the software.
- （三） 建筑物、构筑物及其附属设施占用的空间； (3) space to be covered by buildings, fixtures and affiliated facilities thereof;
- （三）国际申请以中文以外的文字提出的，应当提交原始国际申请的说明书、权利要求书、附图中的文字和摘要的中文译文；国际申请以中文提出的，应当提交国际公布文件中的摘要副本； (3) submit the Chinese translation of the words in the specification, the patent claim, and the appended drawings and of the abstract of the international application which is filed in a language other than Chinese; or submit a copy of the abstract in the international publishing document if the international application is filed in Chinese;
- （四）国家工作人员玩忽职守，造成珍贵文物损毁或者流失，情节严重的。 (4) serious damage of, or serious losses to valuable cultural relics caused by the dereliction of duty on the part of state personnel.
- （四）在他人开发的软件上署名或者涂改他人开发的软件上的署名； (4) Signing one's name to software developed by another person or altering the signature on software developed by another;
- （四）软件著作权人：指按本条例的规定，对软件享有著作权的单位和公民。 (4) Software copyright owners: refers to those units and citizens who, in accordance with these regulations, enjoy the copyright of a computer software.
- （四）国际申请有附图的，应当提交附图副本。国际申请以中文提出的，应当提交国际公布文件中的摘要附图副本。 (4) submit a copy of the appended drawing if there is any in the international application; and submitting copies of the drawings appended to the abstract in the international publishing document if the international application is filed in Chinese.
- （五）用原子核变换方法获得的物质。 (5) substances obtained by means of nuclear transformation.
- （五） 可以转让的注册商标专用权、专利权、著作权等知识产权中的财产权； (5) such transferable property rights in intellectual property as exclusive trademark rights, patent rights, copyrights, etc;
- ——知识产权保护状况明显改善。盗版、假冒等侵权行为显著减少，维权成本明显下降，滥用知识产权现象得到有效遏制。 -Situation of intellectual property protection is obviously improved. Infringing acts such as pirate and counterfeiting are reduced considerably; costs for protection of rights are decreased considerably; and abuse of intellectual properties is effectively prevented.
- （二）战略目标。 2. Strategic objectives
- （五）对未经批准冠以市或者区、县行政区域名举办体育竞赛或者参赛的，责令限期改正，并可以处以500元以上1万元以下罚款。 5. Sponsors or participants of sports contests preceded by the name of the municipality or the district or county administrative area without approval or those contestants whose names are preceded by the above-mentioned name without approval shall be ordered to make correction within a time limit and may be fined between RMB 500 yuan and 10,000 yuan.
- （五）加强知识产权行政管理。 5. Strengthening intellectual property administration
