- （一）国际申请中未指明发明人的，在进入中国国家阶段声明中指明发明人姓名； (1) he/it shall designate the name of the inventor in the declaration for the entry of the National Phase in China if the inventor has not been designated in the international application;
- （一）在地下、内水、领海及其他场所中发现文物隐匿不报，不上交国家的，由公安部门给予警告或者罚款，并追缴其非法所得的文物； (1) hiding cultural relics discovered underground, in inland waters, in territorial seas or in other places and failing to report and deliver them to the state, for which the persons involved shall be warned or fined by a public security department and the cultural relics illegally acquired by them shall be recovered;
- （二）国际阶段向国际局已办理申请人变更手续的，应当提供变更后的申请人享有申请权的证明材料； (2) he/it shall, if, in the International Phase, having fulfilled the formalities on the change of the applicant in the International Bureau, provide the certified documents proving that the applicant after the change enjoys the right of application;
- （三）没有参加创作，为谋取个人名利，在他人作品上署名的； (3) having one's name indicated on a work created by others, in order to seek personal fame and gain, where one has not participated in the creation of the work;
- （三）申请人与作为优先权基础的在先申请的申请人不是同一人，或者提出在先申请后更改姓名的，必要时，应当提供申请人享有优先权的证明材料； (3) he shall, when necessary, provide the certified documents proving that the applicant enjoys the right of priority if he is not the same person as the applicant of the earlier application (which is regarded as the basis of the right of priority), or if he changes his name after filing the earlier application;
- （三）布图设计权利人，是指依照本条例的规定，对布图设计享有专有权的自然人、法人或者其他组织； (3) Holder of right of layout-design means the natural person who, or the legal entity or any other organisation which, according to the provisions of the Regulations, enjoys the exclusive right in a layout-design;
- （四）国际申请涉及的发明创造有专利法第二十四条第（一）项或者第（二）项所列情形之一，在提出国际申请时作过声明的，应当在进入中国国家阶段声明中予以说明，并自办理进入中国国家阶段手续之日起２个月内提交本细则第三十一条第二款规定的有关证明文件。 (4) he/it shall make a statement in the declaration for the entry of the National Phase in China, and shall, within 2 months as of the date when he/it fulfills the formalities for the entry of the National Phase in China, submit relevant certified documents provided in Paragraph 2 of Article 31 of these Rules if the invention-creation involved in the international application is under any of the circumstances enumerated in Item (1) or Item (2) of Article 24 of the Patent Law, and a declaration was made when the international application was filed.
- （二）有与竞赛规模相适应的组织机构和管理人员； 2. Having organizing institutions and managerial personnel matched to the contest scale;
- （三）有具体的竞赛规程、规则和组织实施方案； 3. Having specific contest regulations, rules and organization and implementation plans;
- （四）有与竞赛规模相适应的经费； 4. Having funds matched to the contest scale; and
- （五）有竞赛所需的场所、设施和器材。 5. Having places, facilities and apparatus necessary for contests.
- 冠以区、县行政区域名举办体育竞赛或者参赛的，应当报区、县体育行政部门批准。 Having the names of district or county administrative areas precede the names of sports contests or contestants must be reported to the district or county physical cultural administrative department for approval.
- 没收违法所得，可以并处违法所得三倍以下的罚款，没有违法所得的，可以处五万元以下的罚款； His illegal earnings shall be confiscated and , in addition, he may be imposed a fine of not more than three times his illegal earnings and, if there is no illegal earnings, a fine of not more than RMB 50,000 yuan.
- 但是，专利申请已经被驳回、撤回或者视为撤回的，不能提出分案申请。 However, if an application for a patent has been rejected, withdrawn or deemed to have been withdrawn, the request for division of application may not be submitted.
- 但是，提出后一申请时，在先申请的主题有下列情形之一的，不得作为要求本国优先权的基础： However, if, when the later application is filed, the earlier application is in any of the following circumstances, it may not be the basis of the right of domestic priority:
- 但是，修改应当仅限于消除驳回决定或者复审通知书指出的缺陷。 however, such amendment shall be only limited to the elimination of the defects pointed out in the decision on rejection or the notification on re-examination.
- 但是，撤回专利申请的声明应当在以后出版的专利公报上予以公告。 However, the declaration to withdraw an application for a patent shall be announced on the subsequently published Patent Gazette.
- 但是，申请人提供证明的时间不得迟于本细则第一百零一条规定的期限届满后６个月。 However, the time for the applicant to provide the proof shall not be later than 6 months after the expiry of the time limit provided in Article 101 of these Rules.
- 但若所持有的侵权软件不销毁不足以保护软件著作权人的权益时，持有者有义务销毁所持有的侵权软件，为此遭受的损失可以向侵权软件的提供者追偿。 However, when failure to destroy the infringed software will not adequately protect the rights and interests of the software copyright owner, the owner has a duty to destroy the infringing software, so that losses may be forced back onto the provider of the infringing software.
- 但使用时应当说明该软件的名称、开发者，并且不得侵犯著作权人或者其合法受让者依本条例所享有的其他各项权利。 However, when used, the name of the software and its developer must be stated, and none of the rights enjoyed by the copyright owners or their transferees under the terms of these regulations shall be violated.
- 但是，专利权人于专利权授予之日前即已得知或者应当得知的，自专利权授予之日起计算。 However, where the patentee has already obtained or should have obtained knowledge before the date of the grant of the patent right, the prescription shall be counted from the date of the grant.
