  第三十三条 土地使用权抵押时,其地上建筑物、其他附着物随之抵押。    Article 33. With the mortgage of the right to the use of the land, the above-ground buildings and other attached objects thereon shall be mortgaged accordingly.
  第三十四条? 工程监理单位应当在其资质等级许可的监理范围内,承担工程监理业务。    Article 34 The construction supervising units shall undertake project supervising business within the scope of supervision as allowed by their level of qualifications.
第三十四条国家实行基本农田保护制度。下列耕地应当根据土地利用总体规划划入基本农田保护区,严格管理:    Article 34 The State fosters the system of protecting the basic farmland. The following cultivated land shall be demarcated as basic farmland protection areas and subject to stringent control according to the general plans for the utilization of land:
  第三十四条 土地使用权抵押,抵押人与抵押权人应当签订抵押合同。    Article 34. A mortgage contract shall be signed for mortgaging the right to the use of the land by and between the mortgagor and the mortgagee.
第三百四十二条违反土地管理法规,非法占用耕地改作他用,数量较大,造成耕地大量毁坏的,处五年以下有期徒刑或者拘役,并处或者单处罚金。    Article 342 Illegal turning of cultivated land occupied into other uses in a big amount to cause damages to large tracts of cultivated land in violation of the land administrative law and regulations, a punishment of from less than five years' in prison or forced labor shall be given, together with a fine concurrently or separately.
  第三十五条? 工程监理单位不按照委托监理合同的约定履行监理义务,对应当监督检查的项目不检查或者不按照规定检查,给建设单位造成损失的,应当承担相应的赔偿责任。    Article 35 If the construction supervising units do not fulfill their obligations in accordance with the terms of the contract for supervision and do not inspect the items that should be supervised or do not follow the regulations in carrying out the supervision, which has resulted in losses on the part of project owners, the supervising units shall bear the corresponding liability for damages.
第三十五条各级人民政府应当采取措施,维护排灌工程设施,改良土壤,提高地力,防止土地荒漠化、盐渍化、水土流失和污染土地。    Article 35 People's governments at all levels shall adopt measures to maintain and protect irrigation and drainage facilities, ameliorate the soil to raise fertility and prevent desertification, salinization, water loss and soil erosion and pollution.
  第三十五条 土地使用权和地上建筑物、其他附着物抵押,应当按照规定办理抵押登记。    Article 35. With respect to the mortgage of the right to the use of the land together with the above-ground buildings and other attached objects, registration for the mortgage shall be undertaken in accordance with the relevant provisions.
第三十六条非农业建设必须节约使用土地,可以利用荒地的,不得占用耕地;可以利用劣地的,不得占用好地。    Article 36 Land shall be used sparingly for non-agricultural construction purposes. Whereas wasteland can be used, no cultivated land should be occupied; whereas poor land can be used, no good land should be occupied.
  第三十六条? 建筑工程安全生产管理必须坚持安全第一、预防为主的方针,建立健全安全生产的责任制度和群防群治制度。    Article 36 The administration of safety in construction operation shall follow the principle of safety and prevention first. The responsibility system for operation safety and the regime of prevention and treatment by the masses shall be established and perfected.
  第三十六条 抵押人到期未能履行债务或者在抵押合同期间宣告解散、破产的,抵押权人有权依照国家法律、法规和抵押合同的规定处分抵押财产。    Article 36. If the mortgagor fails to fulfil liabilities within the prescribed period of time or declares dissolution or bankruptcy within the term of the mortgage contract, the mortgagee shall have the right to dispose of the mortgaged property in accordance with the laws and regulations of the State and the stipulations of the mortgage contract.
第三十七条禁止任何单位和个人闲置、荒芜耕地。已经办理审批手续的非农业建设占用耕地,一年内不用而又可以耕种并收获的,应当由原耕种该幅耕地的集体或者个人恢复耕种,也可以由用地单位组织耕种;一年以上未动工建设的,应当按照省、自治区、直辖市的规定缴纳闲置费;连续二年未使用的,经原批准机关批准,由县级以上人民政府无偿收回用地单位的土地使用权;该幅土地原为农民集体所有的,应当交由原农村集体经济组织恢复耕种。    Article 37 No unit or individual is allowed to let the land to lie idle or go wasted. Whereas a cultivated land which has been occupied for non- agricultural construction upon approval and can sure start construction within one year is found cultivable and yieldable, it should be cultivated by the unit or individual that originally cultivates the land or cultivated by units occupying the land. Whereas construction work fails to start for over one year, land idling fees shall be paid according to the provisions by various provinces, autonomous region and municipalities. Whereas construction work fails to start for two successive years, the people's governments at and above the county level shall revoke the use right of the land with the approval of the original organ of approval. Whereas the land used to be owned by peasant collectives, it should be turned over to original rural collective economic organizations for recultivation.
  第三十七条? 建筑工程设计应当符合按照国家规定制定的建筑安全规程和技术规范,保证工程的安全性能。    Article 37 The design of construction projects shall be in line with the safety standards for construction and technical specifications in order to ensure the safety performance of the projects.
  第三十七条 处分抵押财产所得,抵押权人有优先受偿权。    Article 37. The mortgagee shall have the priority of compensation with respect to the receipts resulting from the disposal of the mortgaged property.
第三十八条国家鼓励单位和个人按照土地利用总体规划,在保护和改善生态环境、防止水土流失和土地荒漠化的前提下,开发未利用的土地;适宜开发为农用地的,应当优先开发成农用地。    Article 38 The State encourages development of unused land by units or individuals according to the general plans for the utilization of land and under the precondition of protecting and improving the ecological environment, preventing water loss, soil erosion and desertification. Land suitable for agricultural use should have the priority of developing into land for agricultural use.
  第三十八条? 建筑施工企业在编制施工组织设计时,应当根据建筑工程的特点制定相应的安全技术措施;对专业性较强的工程项目,应当编制专项安全施工组织设计,并采取安全技术措施。    Article 38 When planning construction organization and designing, the construction projects shall formulate appropriate safety technical measures according to the characteristics of the construction projects; With regard to construction projects with a high degree of technical speciality, special safety construction organization and designs shall be formulated and safety technical measures shall be adopted.
  第三十八条 抵押权因债务清偿或者其他原因而消灭的,应当依照规定办理注销抵押登记。    Article 38. If the mortgage is eliminated as a result of the liquidation of liabilities or for other reasons, procedures shall be undertaken to nullify the mortgage registration.
第三十九条开垦未利用的土地,必须经过科学论证和评估,在土地利用总体规划划定的可开垦的区域内,经依法批准后进行。    Article 39 Reclaiming unused land shall go through scientific argumentation and evaluation and can proceed according to law after approval within the reclaimable areas demarcated in the general plans for the utilization of land.
  第三十九条? 建筑施工企业应当在施工现场采取维护安全、防范危险、预防火灾等措施;有条件的,应当对施工现场实行封闭管理。    Article 39 The construction enterprises shall take measures aimed at maintaining safety, preventing dangers and fires. When condition allows, the construction site shall be sealed up.
第三十九 条土地使用权因土地使用权出让合同规定的使用年限届满、提前收回及土地灭失等原因而终止。    Article 39. The right to the use of the land shall terminate for such reasons as the expiration of the term of use as stipulated in the contract for assigning the right to the use of the land, the withdrawal of the right before the expiration, or the loss of the land.
第四条(安置方式)    Article 4 (Ways of Resettlement)
第四条 外商投资建筑业企业在中华人民共和国境内从事建筑活动,应当遵守中国的法律、法规、规章。    Article 4 Foreign-invested construction enterprises which engage in construction business within the territory of the People’s Republic of China shall abide by the laws, regulations and rules of the People’s Republic of China.
  第四条? 国家扶持建筑业的发展,支持建筑科学技术研究,提高房屋建筑设计水平,鼓励节约能源和保护环境,提倡采用先进技术、先进设备、先进工艺、新型建筑材料和现代管理方式。    Article 4 The State assists the development of construction industry, supports research on construction science and technology in order to raise the level of housing and construction design, encourages saving of energy and environmental protection and advocates the adoption of advanced technology, advanced equipment, advanced process, new building materials and modern managerial methods.
第四条国家实行土地用途管制制度。    Article 4 The State is to place a strict control on the usages of land.
  第四条 依照本条例的规定取得土地使用权的土地使用者,其使用权在使用年限内可以转让、出租、抵押或者用于其他经济活动,合法权益受国家法律保护。    Article 4. Users of the land who have obtained the right to the use of the land in accordance with these Regulations may, within the term of land use, transfer, lease, or mortgage the right to the use of the land or use it for other economic activities, and their lawful rights and interests shall be protected by the laws of the State.
