- （一）有符合国家规定的注册资本； (1) Possession of registered capital that complies with the State provisions;
- （二）有与其从事的建筑活动相适应的具有法定执业资格的专业技术人员； (2) Possession of specialized technical personnel with statutory professional qualifications consistent with the construction activities they engage in;
- （三）具有地上建筑物、其他附着物合法的产权证明； (3) Possessing legitimate certificates of property rights to the above-ground buildings and other attached objects; and
- （三）有从事相关建筑活动所应有的技术装备； (3) Possession of technologies and equipment that are necessary for related construction activities.

- （四）保护和改善生态环境，保障土地的可持续利用； 4. Protect and improve the ecological environment to ensure a sustainable use of land.
- 经过前期开发的土地，依法由市、县人民政府国土资源部门统一组织出让。 ?Pre-developed land shall be assigned under the unified organization of the departments of land and resources of municipal or county people's governments according to law.
- 单位和个人依法使用的国有土地，由县级以上人民政府登记造册，核发证书，确认使用权；其中，中央国家机关使用的国有土地的具体登记发证机关，由国务院确定。 People's government at the country level shall register and put on record uses of land owned by the State by units or individuals and issue certificates to certify the right of use. The State Council shall designate specific units to register and put on record State-owned land used by central government organs.
- 农民集体所有的土地依法用于非农业建设的，由县级人民政府登记造册，核发证书，确认建设用地使用权。 People's government at the county level shall register and put on record the use of land collectively owned by peasants for non-agricultural construction and issue certificates to certify the right to use the land for construction purposes.

- 禁止建筑施工企业超越本企业资质等级许可的业务范围或者以任何形式用其他建筑施工企业的名义承揽工程。禁止建筑施工企业以任何形式允许其他单位或者个人使用本企业的资质证书、营业执照，以本企业的名义承揽工程。 Project contracting units are prohibited from contracting projects beyond the business scope as allowed by their level of qualification or in the name of other construction enterprises in any form.??Construction enterprises are prohibited from allowing other units or individuals to use their own certificates of qualification, business licenses or their name in any form in order to contract construction projects.
- 依照前款第（一）项规定收回农民集体所有的土地的，对土地使用权人应当给予适当补偿。 Proper compensation shall be given to land users in the case of recovering the land owned by peasant collectives provided for in item 1 of the preceding paragraph.
- 依照前款第（一）项、第（二）项的规定收回国有土地使用权的，对土地使用权人应当给予适当补偿。 Proper compensation should be given to land use right users whereas the use right of State-owned land is recovered according to the provisions of 1 and 2 of the preceding paragraph.
