- 第二十一条? 建筑工程招标的开标、评标、定标由建设单位依法组织实施,并接受有关行政主管部门的监督。 Article 21 The opening, evaluation and determination of bids in the process of tendering for construction projects shall be organized and implemented by the project owners and shall be subject to the supervision of relevant administrative departments.
- 第二十一条 外商投资建筑业企业从事建筑活动,违反《中华人民共和国建筑法》、《中华人民共和国招标投标法》、《建设工程质量管理条例》、《建筑业企业资质管理规定》等有关法律、法规、规章的,依照有关规定处罚。 Article 21 Where a foreign-invested construction enterprise carrying out construction business violates the Construction Law of the People’s Republic of China, the Tendering and Bidding Law of the People’s Republic of China, Regulations on Administration of Engineering Construction Quality and Regulations on Administration of Construction Enterprise Qualifications and other relevant laws, regulations and rules, it shall be penalised in accordance with relevant provisions.
- 第二十一条 土地使用权转让时,土地使用权出让合同和登记文件中所载明的权利、义务随之转移。 Article 21. With the transfer of the right to the use of the land, the rights and obligations specified in the contract for assigning the right to the use of the land and in the registration documents shall be transferred accordingly.
- 第二十二条 本规定实施前已经取得《外国企业承包工程资质证》的外国企业投资设立外商投资建筑业企业,可以根据其在中华人民共和国境内承包工程业绩等申请相应等级的建筑业企业资质。 Article 22 For a foreign enterprise which has already obtained a Foreign Enterprise Qualification Certificate for Contracting for Construction Projects prior to these Regulations come into force, it may apply for a construction enterprise qualification of an appropriate grade based on its track record of project contracting within the territory of the People’s Republic of China when establishing a foreign-invested construction enterprise.
- 第二十二条? 建筑工程实行招标发包的,发包单位应当将建筑工程发包给依法中标的承包单位。建筑工程实行直接发包的,发包单位应当将建筑工程发包给具有相应资质条件的承包单位。 Article 22 For construction projects subject to bidding, the out- contracting units shall contract out the projects to the contracting units which have won the bid in accordance with law.??For construction projects subject to direct contracting, the out-contracting units shall contract out the project to the contracting units with appropriate qualifications.
- 第二十二条城市建设用地规模应当符合国家规定的标准,充分利用现有建设用地,不占或者尽量少占农用地。 Article 22 The amount of land used for urban construction shall conform to the standards prescribed by the State so as to make full use of the existing land for construction purposes, not to occupy or occupy as less agricultural land as possible.

- 第二百二十八条以牟利为目的,违反土地管理法规,非法转让、倒卖土地使用权,情节严重的,处三年以下有期徒刑或者拘役,并处或者单处非法转让、倒卖土地使用权价额百分之五以上百分之二十以下罚金;情节特别严重的,处三年以上七年以下有期徒刑,并处非法转让、倒卖土地使用权价额百分之五以上百分之二十以下罚金。 Article 228 Illegal transfer or trade of land use right for personal gains in violation of the land administrative law and regulations shall be sentenced to a prison term of less than three years or to forced labor, with a concurrent fine amounting to more than 5% and less than 20% of the proceeds from the illegal transfer or trading whereas the case is serious enough, and whereas the case is very serious, it shall be sentenced to a prison term ranging from more than three years to less than seven years, with a fine ranging from more than 5% to less than 20% of the proceeds from the illegal transfer or trading of the land use right.
- 第二十三条 香港特别行政区、澳门特别行政区和台湾地区投资者在其他省、自治区、直辖市投资设立建筑业企业,从事建筑活动的,参照本规定执行。法律、法规、国务院另有规定的除外。 Article 23 Investors from Hong Kong Special Administrative Region, Macao Special Administrative Region or Taiwan shall establish construction enterprises and carry out construction businesses in other provinces, autonomous regions or directly administered municipalities in accordance with these Regulations, unless it is otherwise provided by laws, regulations or the State Council.
- 第二十三条? 政府及其所属部门不得滥用行政权力,限定发包单位将招标发包的建筑工程发包给指定的承包单位。 Article 23 The government and its subordinate departments shall not abuse their administrative power by requiring the out-contracting units to contract out the construction projects to designated contracting units.
- 第二十三条江河、湖泊综合治理和开发利用规划,应当与土地利用总体规划相衔接。在江河、湖泊、水库的管理和保护范围以及蓄洪滞洪区内,土地利用应当符合江河、湖泊综合治理和开发利用规划,符合河道、湖泊行洪、蓄洪和输水的要求。 Article 23 The plans for the comprehensive control, development and utilization of rivers and lakes should be in accordance with the general plans for land use. Land uses within the areas of management and protection of rivers, lakes and reservoirs and flood storage and detention areas should be in line with plans for the comprehensive control, development and utilization of rivers and lakes and to the requirements of river channels, flood flows of rivers and lakes, flood storage and water transmission.
- 第二十三条 土地使用权转让时,其地上建筑物、其他附着物所有权随之转让。 Article 23. With the transfer of the right to the use of the land, the ownership of the above-ground buildings and other attached objects shall be transferred accordingly.
- 第二十四条? 提倡对建筑工程实行总承包,禁止将建筑工程肢解发包。 Article 24 Overall contracting of projects is encouraged and the contracting of construction projects in parts shall be prohibited.
- 第二十四条各级人民政府应当加强土地利用计划管理,实行建设用地总量控制。 Article 24 People's governments at all levels shall strengthen the administration of plans for land use and exercise control of the aggregate land for construction purposes.
- 第二十四条 本规定由国务院建设行政主管部门和国务院对外贸易经济行政主管部门按照各自职责负责解释。 Article 24 The construction administration department of the State Council and the foreign trade and economic cooperation administration department of the State Council shall be responsible for interpretation of these Regulations in accordance with their respective functions.
- 第二十四条 地上建筑物、其他附着物的所有人或者共有人,享有该建筑物、附着物使用范围内的土地使用权。 Article 24. The owners or joint owners of the above-ground buildings and other attached objects shall have the right to the use of the land within the limits of use of the said buildings and objects.
- 第二十五条? 按照合同约定,建筑材料、建筑构配件和设备由工程承包单位采购的,发包单位不得指定承包单位购入用于工程的建筑材料、建筑构配件和设备或者指定生产厂、供应商。第三节? 承? 包 Article 25 For building materials, components and equipment which shall be purchased by the project contracting units as specified by the contracts, the out-contracting units shall not designate the building materials, components and equipment for the projects to be purchased by the contracting units or designate manufacturers and suppliers thereof.
- 第二十五条省、自治区、直辖市人民政府应当将土地利用年度计划的执行情况列为国民经济和社会发展计划执行情况的内容,向同级人民代表大会报告。 Article 25 The people's governments of provinces, autonomous regions and municipalities shall report the implementations of their annual plans for the use of land to the people's congresses at the same level as part of the implementation of their economic and social development plans.
- 第二十五条 本规定自2002年12月1日起施行。 Article 25 These Regulations shall come into force on 1 December 2002.
- 第二十五条 土地使用权和地上建筑物、其他附着物所有权转让,应当按照规定办理过户登记。 Article 25. With respect to the transfer of the right to the use of the land and of the ownership of the above-ground buildings and other attached objects, registration for the transfer shall be undertaken in accordance with the relevant provisions.
- 第二十六条经批准的土地利用总体规划的修改,须经原批准机关批准;未经批准,不得改变土地利用总体规划确定的土地用途。 Article 26 Revision of the general plans for land use shall be approved by the original organ of approval. Without approval, the usages of land defined in the general plans for the utilization of land shall not be changed.
- 第二十六条? 承包建筑工程的单位应当持有依法取得的资质证书,并在其资质等级许可的业务范围内承揽工程。 Article 26 The project contracting units shall hold legally-obtained certificates of qualifications and contract projects within the business scope as allowed by their level of qualification.
- 第二十六条 自2003年10月1日起,1994年3月22日建设部颁布的《在中国境内承包工程的外国企业资质管理暂行办法》(建设部令第32号)废止。 Article 26 The Tentative Measures on Administration of Foreign Enterprise Qualifications for Contracting for Construction Projects Within the Territory of China issued by the Ministry of Construction (Decree No. 32 of the Ministry of Construction) shall be repealed as of 1 October 2003.
- 第二十六条 土地使用权转让价格明显低于市场价格的,市、县人民政府有优先购买权。 Article 26. When the transfer of the right to the use of the land is priced at a level obviously lower than the prevailing market price, the people's governments at the municipal and county levels shall have the priority of the purchase thereof.
- 第二十七条? 大型建筑工程或者结构复杂的建筑工程,可以由两个以上的承包单位联合共同承包。共同承包的各方对承包合同的履行承担连带责任。 Article 27 Large construction projects or complex construction projects can be jointly contracted by two or more contracting units. Parties to joint project contracting shall bear joint responsibilities for the implementation of the contract.
