第二十七条 自2002年12月1日起,建设部和对外贸易经济合作部联合颁布的《关于设立外商投资建筑业企业的若干规定》(建建[1995]533号)废止。(来源:建设部网站)    Article 27 Provisions on Establishment of Foreign-invested Construction Enterprises (File No. 533, 1995) jointly issued by the Ministry of Construction and the Ministry of Foreign Trade and Economic Cooperation shall be repealed as of 1 December 2002.
第二十七条国家建立土地调查制度。    Article 27 The State fosters land survey system.
  第二十七条 土地使用权转让后,需要改变土地使用权出让合同规定的土地用途的,依照本条例第十八条的规定办理。    Article 27. If, after the transfer of the right to the use of the land, necessity arises for altering the purposes of land use as stipulated in the contract for assigning the right to the use of the land, it shall be handled in accordance with the provisions in Article 18 of these Regulations.
  第二十八条? 禁止承包单位将其承包的全部建筑工程转包给他人,禁止承包单位将其承包的全部建筑工程肢解以后以分包的名义分别转包给他人。    Article 28 Contracting units are prohibited from subcontracting the entire construction projects undertaken by the contracting units to others and they are prohibited from dividing the entire construction projects into parts and then subcontracting those parts to others.
第二十八条县级以上人民政府土地行政主管部门会同同级有关部门根据土地调查成果、规划土地用途和国家制定的统一标准,评定土地等级。    Article 28 Land administrative departments of the people's government at and above the county level shall, together with related departments at the same level, grade the land according to the results of the surveys, their planned uses and the unified standards formulated by the State.
第二十八条 土地使用权出租是指土地使用者作为出租人将土地使用权随同地上建筑物、其他附着物租赁给承租人使用,由承租人向出租人支付租金的行为。    Article 28. The lease of the right to the use of the land refers to the act of the land user as the lessor to lease the right to the use of the land together with the above-ground buildings and other attached objects to the lessee for use who shall in turn pay lease rentals to the lessor.
  第二十九条? 建筑工程总承包单位可以将承包工程中的部分工程发包给具有相应资质条件的分包单位;但是,除总承包合同中约定的分包外,必须经建设单位认可。施工总承包的,建筑工程主体结构的施工必须由总承包单位自行完成。    Article 29 The overall contracting units can subcontract part of the projects to subcontractors with appropriate qualifications.??However, except for the subcontracting as specified in the overall contracts, approval from project owners shall be obtained. With regard to overall project contracting, the construction of the main structure of the project shall be completed by the overall contracting units.
第二十九条国家建立土地统计制度。    Article 29 The State establishes the land statistical system.
  第二十九条 土地使用权出租,出租人与承租人应当签订租赁合同。    Article 29. A lease contract shall be signed for leasing the right to the use of the land by and between the lessor and the lessee.
第三条(补偿)    Article 3 (Compensation)
第三条 外国投资者在中华人民共和国境内设立外商投资建筑业企业,并从事建筑活动,应当依法取得对外贸易经济行政主管部门颁发的外商投资企业批准证书,在国家工商行政管理总局或者其授权的地方工商行政管理局注册登记,并取得建设行政主管部门颁发的建筑业企业资质证书。    Article 3 A foreign investor, which intends to establish a foreign-invested construction enterprise within the territory of the People’s Republic of China and conduct construction business, shall, in accordance with laws, obtain the approval certificate from the relevant foreign trade and economic cooperation administration department and register with the State Administration of Industry and Commerce or its authorised administration of industry and commerce at local levels, and the qualification certificate from the relevant construction administration department.
  第三条? 建筑活动应当确保建筑工程质量和安全,符合国家的建筑工程安全标准。    Article 3 Construction activities have to guarantee the quality and safety of construction projects and comply with the State's safety standards for construction projects.
第三条十分珍惜、合理利用土地和切实保护耕地是我国的基本国策。各级人民政府应当采取措施,全面规划,严格管理,保护、开发土地资源,制止非法占用土地的行为。    Article 3 To cherish and give a rational use to the land as well as to give a true protection to the cultivated land are seen as a basic principle of land use in the country. The people's governments at all levels should manage to make an overall plan for the use of land to strictly administer, protect and develop land resources and stop any illegal occupation of land.
  第三条 中华人民共和国境内外的公司、企业、其他组织和个人,除法律另有规定者外,均可依照本条例的规定取得土地使用权,进行土地开发、利用、经营。    Article 3. Any company, enterprise, other organization and individual within or outside the People's Republic of China may, unless otherwise provided by law, obtain the right to the use of the land and engage in land development, utilization and management in accordance with the provisions of these Regulations.
  第三十条? 国家推行建筑工程监理制度。    Article 30 The State adopts the system of project construction supervision.
第三十条国家建立全国土地管理信息系统,对土地利用状况进行动态监测。    Article 30 The State shall establish the national land management information system to conduct dynamic monitoring of the utilization of land.
  第三十条 土地使用权出租后,出租人必须继续履行土地使用权的出让合同。    Article 30. After leasing the right to the use of the land the lessee must continue to perform the contract for assigning the right to the use of the land.
  第三十一条? 实行监理的建筑工程,由建设单位委托具有相应资质条件的工程监理单位监理。建设单位与其委托的工程监理单位应当订立书面委托监理合同。    Article 31 Construction projects subject to supervision shall be supervised by project supervising units with appropriate qualifications entrusted by the project owners. The project owners shall enter into written contracts on supervision with the entrusted project supervising units.
第三十一条国家保护耕地,严格控制耕地转为非耕地。    Article 31 The State protects the cultivated land and strictly controls the conversion of cultivated land into non-cultivated land.
  第三十一条 土地使用权和地上建筑物、其他附着物出租,出租人应当依照规定办理登记。    Article 31. With respect to the lease of the right to the use of the land together with the above-ground buildings and other attached objects, the lessee shall undertake registration in accordance with the relevant provisions.
  第三十二条? 建筑工程监理应当依照法律、行政法规及有关的技术标准、设计文件和建筑工程承包合同,对承包单位在施工质量、建设工期和建设资金使用等方面,代表建设单位实施监督。    Article 32 The construction supervising units shall, on behalf of project owners, carry out supervision of the construction quality, construction period and the use of construction funds in accordance with laws, administrative regulations and relevant technical standards, design documents and contracts for project contracting.
第三十二条县级以上地方人民政府可以要求占用耕地的单位将所占用耕地耕作层的土壤用于新开垦耕地、劣质地或者其他耕地的土壤改良。    Article 32 The local people's governments at and above the county level may demand units which occupy cultivated land to use the topsoil of the land occupied for use in the newly reclaimed land, poor land or other cultivated land for soil amelioration.
第三十二条 土地使用权可以抵押。    Article 32. The right to the use of the land may be mortgaged.
第三十三条省、自治区、直辖市人民政府应当严格执行土地利用总体规划和土地利用年度计划,采取措施,确保本行政区域内耕地总量不减少;耕地总量减少的,由国务院责令在规定期限内组织开垦与所减少耕地的数量与质量相当的耕地,并由国务院土地行政主管部门会同农业行政主管部门验收。    Article 33 People's governments of all provinces, autonomous regions and municipalities shall strictly implement the general plans for the utilization of land and annual plan for the use of land, adopt measures to ensure not to reduce the total amount of cultivated land within their jurisdictions. Whereas reductions occur, the State Council shall order it to organize land reclamation within the prescribed time limit to make up for the reduced land in the same quantity and quality and the land administrative department of the State Council shall, together with agricultural administrative department, examine and accept it.
  第三十三条? 实施建筑工程监理前,建设单位应当将委托的工程监理单位、监理的内容及监理权限,书面通知被监理的建筑施工企业。    Article 33 Prior to the implementation of the supervision of project construction, the project owners shall inform the construction enterprises in written form of the project supervising unites entrusted, contents for supervision and the scope for supervision.
