- 第十二条 土地使用权出让最高年限按下列用途确定: Article 12. The maximum term with respect to the assigned right to the use of the land shall be determined respectively in the light of the purposes listed below:

- 第十三条? 从事建筑活动的建筑施工企业、勘察单位、设计单位和工程监理单位,按照其拥有的注册资本、专业技术人员、技术装备和已完成的建筑工程业绩等资质条件,划分为不同的资质等级,经资质审查合格,取得相应等级的资质证书后,方可在其资质等级许可的范围内从事建筑活动。 Article 13 Construction engineering enterprises, prospecting units, design units and project supervisory units are rated into different classes according to their registered capital, professionals and technicians, technical equipment and performance record of completed construction projects, etc.??Only when they pass qualification examinations and obtain appropriate qualification certificates may they engage in construction activities commensurate to the scope of their qualification classes.
- 第十三条 本规定实施前,已经设立的中外合资经营建筑业企业、中外合作经营建筑业企业,应当按照本规定和建筑业企业资质管理规定重新核定资质等级。 Article 13 Qualifications of Sino-foreign equity construction joint ventures and Sino-foreign cooperative construction enterprises established prior to the issuance of these Regulations are required to be re-examined and ratified in accordance with these Regulations and Regulations on Administration of Construction Enterprise Qualifications.
- 第十三条依法登记的土地的所有权和使用权受法律保护,任何单位和个人不得侵犯。 Article 13 The ownership and use right of land registered according to law shall be protected by law and no unit or individual is eligible to infringe upon it.

- 第十四条 本规定中要求申请者提交的资料应当使用中文,证明文件原件是外文的,应当提供中文译本。 Article 14 All documents required to be submitted by an applicant under these Regulations shall be in Chinese. If the original documentary evidence is in a foreign language, a Chinese translation shall be provided.
- 第十四条农民集体所有的土地由本集体经济组织的成员承包经营,从事种植业、林业、畜牧业、渔业生产。土地承包经营期限为三十年。发包方和承包方应当订立承包合同,约定双方的权利和义务。承包经营土地的农民有保护和按照承包合同约定的用途合理利用土地的义务。农民的土地承包经营权受法律保护。 Article 14 Land collectively owned by peasant shall be contracted out to members of the collective economic organizations for use in crop farming, forestry, animal husbandry and fisheries production under a term of 30 years. The contractees should sign a contract with the correspondents contractor to define each other's rights and obligations. Peasants who have contracted land for operation are obliged to use the land rationally according to the purposes agreed upon in the contracts. The right of operation of land contracted by peasants shall be protected by law.
- 第十四条? 从事建筑活动的专业技术人员,应当依法取得相应的执业资格证书,并在执业资格证书许可的范围内从事建筑活动。 Article 14 Specialized technical personnel engaging in construction activities shall attain the relevant certificates of professional qualification and conduct building activities within the scope of their certificates of professional qualifications.
- 第十四条 土地使用者应当在签订土地使用权出让合同后六十日内,支付全部土地使用权出让金。逾期未全部支付的,出让方有权解除合同,并可请求违约赔偿。 Article 14. The land user shall, within 60 days of the signing of the contract for the assignment of the right to the use of the land, pay the total amount of the assignment fee thereof, failing which, the assigning party shall have the right to terminate the contract and may claim compensation for breach of contract.
- 第十五条(购房差额款的处理) Article 15 (Handling of the Difference Between the Purchase Price and the Amount of the Deposit)
- 第十五条? 建筑工程的发包单位与承包单位应当依法订立书面合同,明确双方的权利和义务。 Article 15 Contract awarding units and contractors for construction projects shall conclude written covenants, specifying the rights and obligations of each party.
- 第十五条国有土地可以由单位或者个人承包经营,从事种植业、林业、畜牧业、渔业生产。农民集体所有的土地,可以由本集体经济组织以外的单位或者个人承包经营,从事种植业、林业、畜牧业、渔业生产。 Article 15 Land owned by the State may be contracted out to units or individuals for farming, forestry, animal husbandry and fisheries operations. Land collectively owned by peasants may be contracted out to units or individuals who are not belonging to the corresponding collectives for farming, forestry, animal husbandry and fisheries operations.
- 第十五条 外资建筑业企业只允许在其资质等级许可的范围内承包下列工程: Article 15 Wholly foreign-owned construction enterprises may only undertake the following types of construction projects within the scope of their qualifications:
- 第十五条 出让方应当按照合同规定,提供出让的土地使用权。未按合同规定提供土地使用权的,土地使用者有权解除合同,并可请求违约赔偿。 Article 15. The assigning party shall, in compliance with the stipulations of the contract, provide the right to the use of the land thus assigned, failing which, the land user shall have the right to terminate the contract and may claim compensation for breach of contract.
- 第十六条(购房产权归属) Article 16 (Title to the House Purchased)
- 第十六条土地所有权和使用权争议,由当事人协商解决;协商不成的,由人民政府处理。 Article 16 Disputes arising from the ownership or use right of land shall be settled through consultation among parties concerned; should consultation fails, the disputes should be handled by people's governments.
- 第十六条 中外合资经营建筑业企业、中外合作经营建筑业企业应当在其资质等级许可的范围内承包工程。 Article 16 Sino-foreign equity construction joint ventures and Sino-foreign cooperative construction enterprises shall undertake construction projects within the permitted scope of their grades of qualifications.
- 第十六条? 建筑工程发包与承包的招标投标活动,应当遵循公开、公正、平等竞争的原则,择优选择承包单位。 Article 16 The tendering and bidding activities for contracting of construction projects shall follow the principle of openness, justice and equal competition, and contractors should be selected based on their merits.
- 第十六条 土地使用者在支付全部土地使用权出让金后,应当依照规定办理登记,领取土地使用证,取得土地使用权。 Article 16. After paying the total amount of the fee for the assignment of the right to the use of the land, the land user shall, in accordance with the relevant provisions, go through the registration thereof, obtain the certificate for land use and accordingly the right to the sue of the land.
- 第十七条(货币化安置达不成协议的处理) Article 17 (Handling of Cases in Which No Agreement Can Be Reached on Monetized Resettlement)
