第五十三条 违反本法第十八条的规定，生产、销售、进口禁止生产、销售、进口的设备的，由县级以上人民政府经济综合主管部门责令改正； Article 53 Anyone who, in violation of the provisions of Article 18 of this Law, manufactures, sells or imports equipment prohibited to be manufactured, sold or imported, shall be ordered by the competent department for comprehensive economic and trade affairs of the people's government at or above the county level to set it right;第五十三条违反本法规定，造成水污染事故的排污单位，由事故发生地的县级以上地方人民政府环境保护部门根据所造成的危害和损失处以罚款。 Article 53 If a pollutant discharging unit, in violation of the provisions of this Law, causes a water pollution accident, the environmental protection department of the people's government at or above the county level in the place where the accident occurs shall, in light of the consequent damage and loss, impose a fine on it.第五十三条任何单位和个人不得截留、挪用防洪、救灾资金和物资。 Article 53 No unit or individual may intercept or appropriate funds and materials for flood control and disaster relief. 第五十三条煤矿企业和煤炭经营企业供应用户的煤炭质量应当符合国家标准或者行业标准，质级相符，质价相符。 Article 53 The quality of coal supplied to customers by coal mining and coal trading enterprises shall meet the national or trade standards. The quality of a specific type of coal shall match its grade and price. 第五十三条 收集、贮存、运输、处置危险废物的场所、设施、设备和容器、包装物及其他物品转作他用时，必须经过消除污染的处理，方可使用。 Article 53 When sites, installations, equipment as well as containers, packages and other articles for the collection, storage, transportation and treatment of hazardous waste are to be used for other purposes, they can be put to use only after treatment to eliminate pollution.第五十三条 违反本法第三十二条规定，制造、销售或者进口超过污染物排放标准的机动车船的，由依法行使监督管理权的部门责令停止违法行为，没收违法所得，可以并处违法所得一倍以下的罚款； Article 53 Whoever, in violation of the provisions of Article 32 of this Law, manufactures, sells or imports motor-driven vehicles and vessels that discharge atmospheric pollutants in excess of the prescribed standards shall be ordered by the department exercising the power of supervision and management according to law to stop the illegal act, confiscated of the illegal gains if any, and may concurrently be imposed of a fine of less than one time of the illegal gains; 第五十三条 本法自1988年7月1日起施行。 Article 53. This Law shall come into force as of July 1, 1988.第五十四条当事人对行政处罚决定不服的，可以在收到通知之日起十五天内，向人民法院起诉； Article 54 A party that refuses to accept the decision on administrative penalty may, within 15 days from Article l7 of this Law who, without his consent document for planning approved by the water conservancy administrative department, builds flood control works or other hydraulic works and hydropower stat ions on rivers and lakes shall be ordered to stop the illegal act and complete the formalities for the consent document for planning.第五十四条 违反本法第十九条的规定，未经当地公安机关批准，进行产生偶发性强烈噪声活动的，由公安机关根据不同情节给予警告或者处以罚款。 Article 54 Anyone who, in violation of the provisions of Article 19 of this Law and without approval of the local public security organ, conducts activities that emit sporadic strong noise shall be given a disciplinary warning or fined by the said organ in light of the seriousness of the violation. 第五十四条煤矿企业和煤炭经营企业供应用户的煤炭质量不符合国家标准或者行业标准，或者不符合合同约定，或者质级不符、质价不符，给用户造成损失的，应当依法给予赔偿。 Article 54 If the quality of coal supplied by coal mining enterprises and coal trading enterprises to customers does not meet the national or trade standards or the requirements agreed upon in a contract, or the quality does not match the grade or the price, thus causing losses to customers, compensation shall be made according to law. 第五十四条 直接从事收集、贮存、运输、利用、处置危险废物的人员，应当接受专业培训，经考核合格，方可从事该项工作。 Article 54 Persons who are directly engaged in the collection, storage, transportation, utilization and treatment of hazardous waste shall receive professional training and shall be allowed to take up such jobs only after they pass due examinations.第五十四条 在预备役军官管理工作中，收受贿赂、营私舞弊，或者玩忽职守致使预备役工作遭受严重损失，构成犯罪的，依法追究刑事责任；未构成犯罪的，依法给予行政处分。 Article 54 Whoever, in his work of the administration of reserve officers, takes bribes, engages in malpractices for selfish ends or causes serious losses to work of reserve service because of his dereliction of duty shall be investigated for criminal responsibility according to law if the case constitutes a crime, or shall be given administrative sanctions if the case does not constitute a crime.第五十四条 违反本法第三十四条第二款规定，未按照国务院规定的期限停止生产、进口或者销售含铅汽油的，由所在地县级以上地方人民政府环境保护行政主管部门或者其他依法行使监督管理权的部门责令停止违法行为，没收所生产、进口、销售的含铅汽油和违法所得。 Article 54 Whoever, in violation of the provisions of the second paragraph of Article 34 of this Law, fails to stop the production, import or marketing of the leaded gasoline according to the time limit prescribed by the State Council shall be ordered to stop the illegal act with the produced, imported or marketed leaded gasoline and the illegal gains confiscated by the administrative department of environmental protection under the local people's government at or above the county level or any of the competent departments exercising the power of supervision and management according to law in the place where the violator is located.第五十五条造成水污染危害的单位，有责任排除危害，并对直接受到损失的单位或者个人赔偿损失。 Article 55 A unit which has caused a water pollution hazard shall have the responsibility to eliminate it and make compensation to the unit or individual that has suffered direct losses.第五十五条 排放环境噪声的单位违反本法第二十一条的规定，拒绝环境保护行政主管部门或者其他依照本法规定行使环境噪声监督管理权的部门、机构现场检查或者在被检查时弄虚作假的，环境保护行政主管部门或者其他依照本法规定行使环境噪声监督管理权的监督管理部门、机构可以根据不同情节，给予警告或者处以罚款。 Article 55 Any unit emitting environmental noise that, in violation of the provisions of Article 21 of this Law, refuses to undergo on-the-spot inspection by the competent administrative department for environmental protection or by any other department or institution that exercises its power of supervision and control of environmental noise in accordance with the provisions of this Law, or resorts to fraud when being inspected, may be given a disciplinary warning or be fined in light of the seriousness of the violation by the said competent administrative department or the said department or institution.第五十五条违反本法第十九条规定，未按照规划治导线整治河道和修建控制引导河水流向、保护堤岸等工程，影响防洪的，责令停止违法行为，恢复原状或者采取其他补救措施，可以处一万元以上十万元以下的罚款。 Article 55 Any violator of the provisions of Article 19 of this Law who fails to follow the planned realigning and leading line to realign river courses and build up construct ion projects for leading the river direction or protecting embankments shall, if the flood control work is affected, be ordered to stop the illegal act, restore to the original state or take other remedies and may be concurrently fined not less than RMB 10, 000 yuan and not more than RMB 100, 000 yuan. 第五十五条煤矿企业、煤炭经营企业、运输企业和煤炭用户应当依照法律、国务院有关规定或者合同约定供应、运输和接卸煤炭。 Article 55 Coal mining enterprises, coal trading enterprises, transport enterprises and customers shall supply, transport, and accept and unload coal according to law, the relevant regulations of the State Council or the agreement in contracts.第五十五条 中国人民武装警察部队退出现役的人员，服人民解放军军官预备役的，适用本法。 Article 55 The present Law shall apply to the persons released from active service in the Chinese People's Armed Police Force and assigned to reserve service as reserve officers of the People's Liberation Army. 第五十五条 产生、收集、贮存、运输、利用、处置危险废物的单位，应当制定在发生意外事故时采取的应急措施和防范措施，并向所在地县级以上地方人民政府环境保护行政主管部门报告；环境保护行政主管部门应当进行检查。 Article 55 Units discharging, collecting, storing, transporting, using or treating hazardous waste shall work out emergency and protection measures to be adopted in cases of accident, and report such to the competent administrative department of environmental protection of the local people's government at or above the county level, which shall conduct inspection.第五十五条 违反本法第三十五条第一款或者第二款规定，未取得所在地省、自治区、直辖市人民政府环境保护行政主管部门或者交通、渔政等依法行使监督管理权的部门的委托进行机动车船排气污染检测的，或者在检测中弄虚作假的，由县级以上人民政府环境保护行政主管部门或者交通、渔政等依法行使监督管理权的部门责令停止违法行为，限期改正，可以处五万元以下罚款；情节严重的，由负责资质认定的部门取消承担机动车船年检的资格。 Article 55 Whoever, in violation of the provisions of the first paragraph or the second paragraph of Article 35 of this Law, conducts test of pollution by motor-driven vehicle or vessel's exhaust fume without authorization of the administrative departments of environmental protection under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government or the authorization of the departments of communications, fishery or other competent authorities exercising supervisory and administrative power according to law, or practices fraud in the test, he/she shall be ordered to stop the illegal act, make rectification within a time limit and may concurrently be imposed upon a fine of not more than 50,000 yuan by the administrative department of environmental protection under the people's government at or above the county level or the departments of communications, fishery exercising the power of supervision and management according to law; if the circumstances are serious, the violator's qualifications to undertake annual test of motor-driven vehicles and vessels may be revoked by the authorities defining such qualifications.第五十六条 建筑施工单位违反本法第三十条第一款的规定，在城市市区噪声敏感建筑的集中区域内，夜间进行禁止进行的产生环境噪声污染的建筑施工作业的，由工程所在地县级以上地方人民政府环境保护行政主管部门责令改正，可以并处罚款。 Article 56 Any construction unit that, in violation of the provisions of Paragraph 1 of Article 30 of this Law, conducts at night, in an urban area where noise-sensitive structures are concentrated, construction operation that produces environmental noise pollution and that is therefore prohibited, shall be ordered to set it right and may also be fined by the competent administrative department for environmental protection of the people's government at or above the county level in the place where the construction project is located.第五十六条违反本法第二十二条第二款、第三款规定，有下列行为之一的，责令停止违法行为，排除阻碍或者采取其他补救措施，可以处五万元以下的罚款： Article 56 Any violator of the provisions of the second and third paragraphs of Article 22 of this Law who commits one of the following acts shall be ordered to stop the illegal act, remove the obstacles or take other remedies and may be concurrently fined not more than RMB 50, 000 yuan:第五十六条 违反本法规定，有下列行为之一的，由县级以上地方人民政府环境保护行政主管部门或者其他依法行使监督管理权的部门责令停止违法行为，限期改正，可以处五万元以下罚款： Article 56 Any violator of this Law shall be ordered to stop his or her illegal act, make rectification within a time limit, and may be fined not more than 50,000 yuan for any of the following acts by the administrative department of environmental protection under the local people's government at or above the county level or any other department exercising the power of supervision and management according to law:第五十六条完全由于不可抗拒的自然灾害，并经及时采取合理措施，仍然不能避免造成水污染损失的，免予承担责任。 Article 56 If the loss from water pollution is caused entirely by irresistible natural disasters which cannot be averted even after reasonable measures have been promptly taken, the party concerned shall be exempted from liability.
