第五十六条 本法自１９９６年１月１日起施行 Article 56 These present Law shall come into force as of January 1, 1996. 第五十六条煤炭的进出口依照国务院的规定，实行统一管理。 Article 56 Unified control shall be maintained over the import and export of coal in accordance with the relevant regulations of the State Council. 第五十六条 因发生事故或者其他突发性事件，造成危险废物严重污染环境的单位，必须立即采取措施消除或者减轻对环境的污染危害，及时通报可能受到污染危害的单位和居民，并向所在地县级以上地方人民政府环境保护行政主管部门和有关部门报告，接受调查处理。 Article 56 Units that have caused severe environmental pollution by hazardous waste due to accident or other unexpected events must immediately take measures to eliminate or reduce the danger and damage of environmental pollution, promptly inform the units and residents that may be harmed by the pollution, in the meantime, report to the competent administrative department of environmental protection of the local people's government at or above the county level and other relevant departments, and be ready for investigation and settlement of the matter.第五十七条违反本法第十五条第二款、第二十三条规定，围海造地、围湖造地、围垦河道的，责令停止违法行为，恢复原状或者采取其他补救措施，可以处五万元以下的罚款； Article 57 Any violator of the provisions of the second paragraph of Article 15 and Article 23 of this Law who reclaims land from seawaters or encloses a lake or river course for cultivation shall be ordered to stop the illegal act, restore land to the original state or take other remedies and may be concurrently fined not more than RMB 50, 000 yuan.第五十七条 违反本法第三十四条的规定，机动车辆不按照规定使用声响装置的，由当地公安机关根据不同情节给予警告或者处以罚款。 Article 57 Anyone who uses the sound apparatus on the motor vehicle in violation of the provisions of Article 34 of this Law shall be given a disciplinary warning or be fined by the local public security organ in light of the seriousness of the violation.第五十七条违反本法规定，造成重大水污染事故，导致公私财产重大损失或者人身伤亡的严重后果的，对有关责任人员可以比照刑法第一百一十五条或者第一百八十七条的规定，追究刑事责任。 Article 57 If any one, in violation of the provisions of this Law, gives rise to a major water pollution accident which leads to any heavy loss to public or private property or serious injury to or death of a person, the persons who are responsible for it may be investigated for criminal responsibility by applying mutatis mutandis the provisions of Article 115 or Article 187 of the Criminal Law. 第五十七条煤炭经营管理办法，由国务院依照本法制定。 Article 57 Measures for control of coal marketing shall be formulated by the State Council in accordance with this Law. 第五十七条 在发生危险废物严重污染环境、威胁居民生命财产安全时，县级以上地方人民政府环境保护行政主管部门必须立即向本级人民政府报告，由人民政府采取有效措施，解除或者减轻危害。? Article 57 When severe environmental pollution by hazardous waste has happened, thus threatening the safety of the lives and property of residents, the competent administrative department of environmental protection of the local people's government at or above the county level must immediately report to the people's government at the corresponding level. The people's government shall take effective measures to eliminate or reduce the danger and damage.第五十七条 违反本法第四十一条第一款规定，在人口集中地区和其他依法需要特殊保护的区域内，焚烧沥青、油毡、橡胶、塑料、皮革、垃圾以及其他产生有毒有害烟尘和恶臭气体的物质的，由所在地县级以上地方人民政府环境保护行政主管部门责令停止违法行为，处二万元以下罚款。 Article 57 Whoever, in violation of the provisions of the first paragraph of Article 41 of this Law, burns asphalt, asphalt felt, rubber, plastics, leather, garbage or other materials that may produce toxic or harmful smoke or dust or fetor in densely inhabited areas or other areas that need special protection according to law shall be ordered to stop the illegal act and imposed upon a fine of not more than 20,000 yuan by the administrative department of environmental protection under the local people's government at or above the county level in the place the violator is located.第五十八条违反本法第二十七条规定，未经水行政主管部门对其工程建设方案审查同意或者未按照有关水行政主管部门审查批准的位置、界限，在河道、湖泊管理范围内从事工程设施建设活动的，责令停止违法行为，补办审查同意或者审查批准手续； Article 58 Any violator of the provisions of Article 27 of this Law who fails to obtain approval for its engineering construction scheme from the relevant water conservancy administrative department, or fails to follow the posit ion and border as approved by the water conservancy administrative department in engaging in the construct ion of engineering structures within the scope of control for river courses and lakes shall be ordered to stop the illegal act and to complete the formalities for examination and approval.第五十八条 违反本法规定，有下列行为之一的，由公安机关给予警告，可以并处罚款： Article 58 Anyone who, in violation of the provisions of this Law, commits any of the following acts, shall be given a disciplinary warning and may also be fined by the public security organ:第五十八条环境保护监督管理人员和其他有关国家工作人员滥用职权、玩忽职守、徇私舞弊的，由其所在单位或者上级主管机关给予行政处分；构成犯罪的，依法追究刑事责任。 Article 58 If any supervisor or administrator from the environmental protection department or any other State functionary abuses his power, neglects his duty or engages in malpractice for personal gain, the unit to which he belongs or the competent department at a higher level shall give him an administrative sanction; if a crime is constituted, he shall be investigated for criminal responsibility according to law. 第五十八条 禁止经中华人民共和国过境转移危险废物。? Article 58 It is forbidden to transfer hazardous waste via the territory of the People's Republic of China. 第五十八条任何单位或者个人不得危害煤矿矿区的电力、通讯、水源、交通及其他生产设施。 Article 58 No units or individuals may damage the installations of electric power and communications, the sources of water, the means of transportation and other production facilities in coal mine areas.第五十八条 违反本法第四十三条第二款规定，在城市市区进行建设施工或者从事其他产生扬尘污染的活动，未采取有效扬尘防治措施，致使大气环境受到污染的，限期改正，处二万元以下罚款；对逾期仍未达到当地环境保护规定要求的，可以责令其停工整顿。 Article 58 Whoever, in violation of the provisions of the second paragraph of Article 43 of this Law, conducts construction operations or other activities that generate dust pollution in the city's urban areas but fails to take effective measures to prevent and control the dust pollution, thus causing pollution to the atmospheric environment shall make rectification within a time limit and be fined not more than 20,000 yuan. Those not meeting the requirements of the local regulations on environmental protection at the expiration of the time limit may be ordered to stop their work to make rectification.第五十九条 违反本法第四十三条第二款、第四十四条第二款的规定，造成环境噪声污染的，由县级以上地方人民政府环境保护行政主管部门责令改正，可以并处罚款。 Article 59 Any operators or managers who, in violation of the provisions of Paragraph 2 of Article 43 or Paragraph 2 of Article 44 of this Law, cause environmental noise pollution, shall be ordered to set it right and may also be fined by the competent administrative department for environmental protection of the local people's government at or above the county level. 第五十九条对盗窃或者破坏煤矿矿区设施、器材及其他危及煤矿矿区安全的行为，一切单位和个人都有权检举、控告。 Article 59 Any units and individuals shall have the right to inform against or accuse persons who steal or damage the facilities and equipment in coal mine areas or commit other acts that threaten the security in coal mine areas.第五十九条违反本法第三十三条第一款规定，在洪泛区、蓄滞洪区内建设非防洪建设项目，未编制洪水影响评价报告的，责令限期改正；逾期不改正的，处五万元以下的罚款。 Article 59 Any violator of the provisions of the first paragraph of Article 33 of this Law who fails to provide a flood impact assessment report for a construction project not intended for flood control within a flooded area or a flood storage and detention area shall be ordered to make corrections within a time limit. If he fails to do so within the time limit, the violator shall be fined not more than RMB 50, 000 yuan. 第五十九条 违反本法规定，有下列行为之一的，由县级以上人民政府环境保护行政主管部门责令限期改正，并处罚款： Article 59 If anyone, in violation of the provisions of this Law, commits any of the following acts, the competent administrative department of environmental protection of the people's government at or above the county level shall order him to put it right within a specified period of time and impose a penalty on him:第五十九条对个体工商户向水体排放污染物，污染严重的，由省、自治区、直辖市人民代表大会常务委员会参照本法规定的原则制定管理办法。 Article 59 The standing committees of the people's congresses of provinces, autonomous regions and municipalities directly under the Central Government shall, with reference to the principles of this Law, formulate control measures governing discharge of pollutants by private industrialists and businessmen who cause serious pollution.第五十九条 违反本法第四十五条第二款规定，在国家规定的期限内，生产或者进口消耗臭氧层物质超过国务院有关行政主管部门核定配额的，由所在地省、自治区、直辖市人民政府有关行政主管部门处二万元以上二十万元以下罚款；情节严重的，由国务院有关行政主管部门取消生产、进口配额。 Article 59 Whoever, in violation of the provisions of the second paragraph of Article 45 of this Law, produces or imports ozone-layer-depleting substances in excess of the quotas approved by the competent administrative department under the State Council within the time limit prescribed by the State shall be fined not less than 20,000 yuan but not more than 200,000 yuan. Fines shall be administered by the competent administrative departments under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in the place the violator is located. If the circumstances is serious, the production or import quotas may be revoked by the competent administrative department under the State Council.第五十一条国家设立水利建设基金，用于防洪工程和水利工程的维护和建设。具体办法由国务院规定。 Article 5l The state establishes a fund for water conservancy projects for the purpose of the maintenance and construction of flood control works and water conservancy works. The State Council shall stipulate the specific measures for this fund.第六条任何单位和个人都有保护防洪工程设施和依法参加防汛抗洪的义务。 Article 6 All units and individuals shall have the obligations to protect flood control works and to take part in flood control and flood fighting according to law.??? 第六条? 除按下列规定可以转让外，探矿权、采矿权不得转让：? Article 6 Exploration right and mining right shall not be transferred except for the transfers made according to the following provisions:第六条 国家鼓励开展有关清洁生产的科学研究、技术开发和国际合作，组织宣传、普及清洁生产知识，推广清洁生产技术。 Article 6 It is the policy of the nation to encourage scientific research, technical development and international cooperation to develop cleaner production, and to organize the dissemination of information with respect to and to popularize cleaner production and extend the range of cleaner production technologies.
