Relevant scientific research, technical development and promotion are also encouraged. 第五条 国家制定节能政策，编制节能计划，并纳入国民经济和社会发展计划，保障能源的合理利用，并与经济发展、环境保护相协调。 Article 5 The State formulates policies and plans for energy conservation, which shall be incorporated into plans for national economic and social development so as to ensure the rational utilization of energy resources and coordinate energy conservation with economic development and environmental protection.??? 第五条? 国家实行探矿权、采矿权有偿取得的制度。但是，国家对探矿权、采矿权有偿取得的费用，可以根据不同情况规定予以减缴、免缴。具体办法和实施步骤由国务院规定。? Article 5 The State practises a system wherein the exploration right and mining right shall be obtained with compensation; however, the State may, in light of specific conditions, prescribe reduction of or exemption from the compensation for acquiring the exploration right and mining right. Specific measures and implementation procedures shall be formulated by the State Council.第五条国家鼓励矿山安全科学技术研究，推广先进技术，改进安全设施，提高矿山安全生产水平。 Article 5 The State shall encourage research in science and technology relating to safety in mines, popularize advanced technology, improve safety facilities and enhance the level of safe production in mines. 第五条国家依法保护煤炭资源，禁止任何乱采、滥挖破坏煤炭资源的行为。 Article 5 The State shall protect the coal resources according to law and forbid any indiscriminate mining which is destructive to the coal resources.第五条防洪工作按照流域或者区域实行统一规划、分级实施和流域管理与行政区域管理相结合的制度。 Article 5 The work for flood control shall be carried out in the light of river basins or administrative areas and according to a system by which unified planning shall be implemented at different levels and consideration given to the administration of river basins as well as the administration of administrative areas.第五条转让探矿权，应当具备下列条件： Article 5 Transfer of mineral exploration right shall meet the following conditions:第五条 拟从境外引进畜禽遗传资源的单位，应当向其所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门提出申请，并提交畜禽遗传资源买卖合同或者赠与协议。 Article 5 Where any entity plans to import livestock or poultry genetic resource from abroad, it shall make an application to stockbreeding and veterinary administrative department of the People’s Government at its province, autonomous region and municipality directly under the Central Government, and submit contract of sales or gift agreement of livestock or poultry genetic resource.第五条 任何国际组织、外国的组织或者个人进入中华人民共和国的专属经济区从事渔业活动，必须经中华人民共和国主管机关批准，并遵守中华人民共和国的法律、法规及中华人民共和国与有关国家签订的条约、协定。 Article 5. All international organizations, foreign organizations or individuals that wish to enter the exclusive economic zone of the People's Republic of China for fishing shall be subject to approval of the competent authorities of the People's Republic of China and shall comply with its laws and regulations as well as the accords and agreements it has signed with the states concerned. 第五条 遇有自然灾害等特殊情况，需要临时调剂使用草原的，按照自愿、互利的原则，由双方协商解决；需要跨县临时调剂使用草原的，由有关县级人民政府组织协商解决。 Article 5. If there is a need for temporary adjustments in the use of grasslands under special circumstances, such as in the event of natural disasters, the matter shall be settled by the parties concerned through negotiation on the principles of voluntariness and mutual benefit. Where there is a need for temporary adjustments in the use of grasslands that cross the borders of different counties, the county people's governments concerned shall sponsor negotiations for the settlement of the matter.???第五条在增殖和保护渔业资源、发展渔业生产、进行渔业科学技术研究等方面成绩显著的单位和个人，由各级人民政府给予精神的或者物质的奖励。 Article 5. People's governments at various levels shall give moral encouragement or material awards to units and individuals who make outstanding contributions to the increase and protection of fishery resources, to development of fishery production, or to research in fishery science and technology. 第五条 国务院环境保护部门主管全国海洋环境保护工作。 Article 5. The environmental protection department under the State Council shall be in charge of the marine environmental protection of the whole country.第五条 建设项目中大气污染防治所需资金、材料和设备，应当与主体工程统筹安排。? Article 5. The funds, materials, and equipment as needed to affect the prevention of air pollution of construction projects should be included in the overall planning of the main parts of these projects.????第五条??国家鼓励环境保护科学教育事业的发展，加强环境保护科学技术的研究和开发，提高环境保护科学技术水平，普及环境保护的科学知识。 Article 5. The state shall encourage the development of education in the science of environmental protection, strengthen the study and development of the science and technology of environmental protection, raise the scientific and technological level of environmental protection and popularize scientific knowledge of environmental protection. 第五条 国家保护水资源，采取有效措施，保护自然植被，种树种草，涵养水源，防治水土流失，改善生态环境。 Article 5. The state shall protect water resources and adopt effective measures to preserve natural flora, plant trees and grow grass, conserve water sources, prevent and control soil erosion and improve the ecological environment.第五十条 违反本法第十五条的规定，未经环境保护行政主管部门批准，擅自拆除或者闲置环境噪声污染防治设施，致使环境噪声排放超过规定标准的，由县级以上地方人民政府环境保护行政主管部门责令改正，并处罚款。 Article 50 Any enterprise or institution that, in violation of the provisions of Article 15 of this Law, dismantles or leaves idle the facilities for prevention and control of environmental noise pollution without approval of the competent administrative department for environmental protection, thereby emitting environmental noise in excess of the limits prescribed, shall be ordered to set it right and also be fined by the competent administrative department for environmental protection of the local people's government at or above the county level. 第五十条煤炭经营应当减少中间环节和取消不合理的中间环节，提倡有条件的煤矿企业直销。 Article 50 For the marketing of coal, the intermediate links shall be reduced and unreasonable intermediate links shall be removed, and, where conditions permit, direct sale by coal mining enterprises shall be encouraged. 第五十条 收集、贮存危险废物，必须按照危险废物特性分类进行。禁止混合收集、贮存、运输、处置性质不相容而未经安全性处置的危险废物。 Article 50 Hazardous wastes must be collected and stored separately according to their different characteristics. It is forbidden to collect, store, transport and treat mixed hazardous wastes of incompatible nature that have not undergone safety treatment.第五十条违反本法第二十二条规定，生产、销售、进口或者使用禁止生产、销售、进口、使用的设备，或者采用禁止采用的工艺的，由县级以上人民政府经济综合主管部门责令改正； Article 50 If any unit, in violation of the provisions of Article 22 of this Law, manufactures, sells, imports or uses equipment that is prohibited from being manufactured, sold, imported or used or employs production techniques that are prohibited from being employed, the competent department for comprehensive economic and trade affairs of the people's government at or above the county level shall order to set it right;
