Standards of subsidies shall be formulated by the Ministry of Finance jointly with the General Staff, the General Political Department and the General Logistics Department of the People's Liberation Army, and the funds thus needed shall be guaranteed by the Central Government. 第四十五条 采伐林木的单位或者个人没有按照规定完成更新造林任务的，发放采伐许可证的部门有权不再发给采伐许可证，直到完成更新造林任务为止；情节严重的，可以由林业主管部门处以罚款，对直接责任人员由所在单位或者上级主管机关给予行政处分。 Article 45 Should tree cutting organizations or private individuals fail to finish the reforestation task in line with the provisions, the authorities which have issued the cutting license shall have the right to issue no more cutting licenses to them until they have completed their reforestation tasks; in case of acts serious in nature, the competent forestry authorities may impose a fine and give administrative punishments to the employer or competent authorities at a higher level of those directly responsible persons.??? 第四十五条? 本法第三十九条、第四十条、第四十二条规定的行政处罚，由县级以上人民政府负责地质矿产管理工作的部门按照国务院地质矿产主管部门规定的权限决定。? Article 45 The administrative penalties prescribed in Articles 39, 40 and 42 of this Law shall be meted out by the department in charge of geology and mineral resources under the people's government at or above the county level in accordance with the limits of authority stipulated by the department in charge of geology and mineral resources under the State Council.第四十五条 国家鼓励、支持消耗臭氧层物质替代品的生产和使用，逐步减少消耗臭氧层物质的产量，直至停止消耗臭氧层物质的生产和使用。 Article 45 The State encourages and supports the production and use of substitutes for the ozone-layer-depleting substances, and gradually reduces the output of the ozone layer depleting substances until the termination of their production and use.第四十五条 本法自２０００年１月１日起施行。 Article 45 This Law shall go into effect as of January 1, 2000. 第四十五条 产生危险废物的单位，必须按照国家有关规定申报登记。 Article 45 Units discharging hazardous waste must report and register according to the relevant regulations of the State. 第四十五条 违反本法第二十五条规定，使用国家明令淘汰的用能设备的，由县级以上人民政府管理节能工作的部门责令停止使用，没收国家明令淘汰的用能设备；情节严重的，县级以上人民政府管理节能工作的部门可以提出意见，报请同级人民政府按照国务院规定的权限责令停业整顿或者关闭。 Article 45 Where an enterprise uses, in violation of the provisions of Article 25 of this Law, energy-using equipment which the State has eliminated by official order, the administrative department for energy conservation of the people's government at or above the county level shall order that it stop using such equipment and have the equipment confiscated; if the circumstances are serious, the said department may submit its proposal to the people's government to which it belongs that the government shall, in line with the limits of authority as prescribed by the State Council, order suspension of operation for consolidation or close-down.????第四十五条??环境保护监督管理人员滥用职权、玩忽职守、徇私舞弊的，由其所在单位或者上级主管机关给予行政处分；构成犯罪的，依法追究刑事责任。 Article 45. Any person conducting supervision and management of environmental protection who abuses his power, neglects his duty or engages in malpractices for personal gains shall be given administrative sanction by the unit to which he belongs or the competent higher authorities; if his act constitutes a crime, he shall be investigated for criminal responsibility according to law. 第四十五条 本法中下列用语的含义是： Article 45. For the purpose of this Law, the definitions of the following terms are: 第四十五条 违反本法规定，有下列行为之一的，由县级以上地方人民政府水行政主管部门或者有关主管部门责令其停止违法行为，限期清除障碍或者采取其他补救措施，可以并处罚款；对有关责任人员可以由其所在单位或者上级主管机关给予行政处分： Article 45. Whoever, in violation of this Law, commits any of the following acts shall be ordered, by the department of water administration or another competent department concerned of the relevant local people's government at or above the county level, to stop his illegal act and clear away the obstacles or take other remedial measures within the specified time limit, and may be concurrently fined; the person who is responsible may be given administrative sanctions by the unit to which he belongs or by the competent authority at a higher level:第四十六条违反本法规定，有下列行为之一的，环境保护部门或者建部门的航政机关可以根据不同情节，给予警告或者处以罚款： Article 46 Any one who, in violation of the provisions of this Law, commits any of the following acts, shall, in light of the seriousness of the case, be warned or fined by the environmental protection department or by the navigation administration office of the communications department:第四十六条矿山企业主管人员违章指挥、强令工人冒险作业，因而发生重大伤亡事故的，依照刑法第一百一十四条的规定追究刑事责任。 Article 46 Any responsible person of a mining enterprise who gives command in violation to established regulations and compels workers to carry out operations at risks, thus causing accidents involving serious causalities, shall be investigated for criminal responsibilities in accordance with the provisions of Article 114 of the Criminal Law.第四十六条 违反本法规定，有下列行为之一的，环境保护行政主管部门或者本法第四条第二款规定的监督管理部门可以根据不同情节，责令停止违法行为，限期改正，给予警告或者处以五万元以下罚款： Article 46 Any violator of this Law shall, according to the circumstances of the case, be ordered to stop the illegal act, make rectification within a time limit, be given a warn or be imposed upon a fine of not more than 50,000 yuan by the competent administrative department of environmental protection or any of the supervisory and management departments as mentioned in Paragraph 2 of Article 4 for any of the following acts: 第四十六条依法取得煤炭生产许可证的煤矿企业，有权销售本企业生产的煤炭。 Article 46 Coal mining enterprises which have legally obtained coal production licenses shall have the right to sell the coal they themselves produce.??? 第四十六条? 当事人对行政处罚决定不服的，可以依法申请复议，也可以依法直接向人民法院起诉。? Article 46 If a party refuses to accept the decision on administrative penalty, it may, in accordance with law, apply for reconsideration or file a suit with the People's Court directly. 第四十六条 从事森林资源保护、林业监督管理工作的林业主管部门的工作人员和其他国家机关的有关工作人员滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。 Article 46 In case that the staff members of the competent forestry authorities and other state authorities engaged in the protection of forest resources and forestry supervision and administration abuse their powers, neglect their duties and play favoritism, if a criminal offense is committed, the legal responsibilities shall be investigated and dealt with; and, if a criminal offense is not committed, administrative punishments shall be given. 第四十六条 产生危险废物的单位，必须按照国家有关规定处置；不处置的，由所在地县级以上地方人民政府环境保护行政主管部门责令限期改正； Article 46 Units discharging hazardous waste must treat the waste in accordance with relevant State regulations. Otherwise, the competent administrative department of environmental protection of the local people's government at or above the county level shall order them to set it right within a specified period of time.第四十六条 违反本法第二十五条规定，将淘汰的用能设备转让他人使用的，由县级以上人民政府管理产品质量监督工作的部门没收违法所得，并处违法所得一倍以上五倍以下的罚款。 Article 46 Where a unit or individual, in violation of the provisions of Article 25 of this Law, transfers eliminated energy-using equipment to another user, the administrative department for supervision over product quality of the people's government at or above the county level shall confiscate its or his illegal gains and impose a fine of not less than one time but not more than five times the illegal gains.第四十六条 预备役军官在参加军事训练、执行军事勤务等军事活动中牺牲、伤残的，参照国家关于军人抚恤优待的规定办理。 Article 46 Where reserve officers have died or become disabled in the course of their performance of military activities such as military training and military duties, the relevant affairs shall be handled with reference to the regulations of the State in respect of pensions and preferential treatment granted to the families of the deceased servicemen or to the disabled servicemen.第四十六条江河、湖泊水位或者流量达到国家规定的分洪标准，需要启用蓄滞洪区时，国务院，国家防汛指挥机构，流域防汛指挥机构，省、自治区、直辖市人民政府，省、自治区、直辖市防汛指挥机构，按照依法经批准的防御洪水方案中规定的启用条件和批准程序，决定启用蓄滞洪区。 Article 46 Where the water level or the flow of any river or lake attains the flood divers on standards of the state which needs to put a flood storage and detention area in use，the State Council，the state flood control headquarters the flood control headquarters of the river basin, the people's government and the flood control headquarters of the province，autonomous region or municipality directly under the Central Government shall，according to the conditions for starting the use of a flood storage and detention area and approval procedures stipulated in the approved flood prevention scheme，make a decision on starting the use of the flood storage and detention area．第四十六条 使用家用电器、乐器或者进行其他家庭室内娱乐活动时，应当控制音量或者采取其他有效措施，避免对周围居民造成环境噪声污染。 Article 46 Whoever uses household appliances or musical instruments or holds other indoor entertainment activities shall keep the sound volume under control or take other effective measures to avoid producing environmental noise pollution to the neighbours. 第四十六条 截留、挪用地震救灾资金和物资，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，给予行政处分。 Article 46 Whoever withholds or embezzles funds or goods set aside for earthquake disaster relief, if the offence constitutes a crime, shall be investigated for criminal liability in accordance with law; otherwise, he shall be given administrative sanctions.
