第四十三条 生产耗能较高的产品的单位，违反本法第二十四条规定，超过单位产品能耗限额用能，情节严重，经限期治理逾期不治理或者没有达到治理要求的，可以由县级以上人民政府管理节能工作的部门提出意见，报请同级人民政府按照国务院规定的权限责令停业整顿或者关闭。 Article 43 Where an enterprise that manufactures energy-consuming products uses energy exceeding the quota set for energy consumption per unit product, in violation of the provisions of Article 24 of this Law and to a serious extent, and fails to solve the problem or meet the requirements within the time limit, the administrative department for energy conservation of the people's government at or above the county level may submit its proposal to the people's government to which it belongs that the government shall, in line with the limits of authority as prescribed by the State Council, order suspension of production for consolidation or closedown.第四十三条矿山建设工程的安全设施未经验收或者验收不合格擅自投入生产的，由劳动行政主管部门会同管理矿山企业的主管部门责令停止生产，并由劳动行政主管部门处以罚款；拒不停止生产的，由劳动行政主管部门提请县级以上人民政府决定由有关主管部门吊销其采矿许可证和营业执照。 Article 43 Where the safety facilities in a mine construction project are put into operation without having been inspected for acceptance or without having passed inspection for acceptance, the mining enterprise concerned shall be ordered to stop production by the competent department of labour administration in conjunction with the authorities in charge of mining enterprises, and shall also be fined by the competent department of labour administration; with respect to the mining enterprise refusing to stop production, the matter shall be submitted by the competent department of labour administration to the relevant people's government at or above the county level for a decision on the rescission of its mining permit and business license by the competent authorities. 第四十三条 违反本法规定，有下列行为之一的，由国务院地震行政主管部门或者县级以上地方人民政府负责管理地震工作的部门或者机构，责令停止违法行为，恢复原状或者采取其他补救措施； Article 43 Whoever, in violation of the provisions of this Law, commits one of the following acts shall be ordered by the competent administrative department for seismic work under the State Council or the administrative department or institution for seismic work under the local people's government at or above the county level to stop violating the Law and to put the place back to its former state or take other remedial measures; 第四十三条 完全属于下列情形之一，经过及时采取合理措施仍然不能避免对海洋环境造成污染损害的，免予承担赔偿责任： Article 43. If a violation of this Law causes a serious environmental pollution accident, leading to the grave consequences of heavy losses of public or private property or human injuries or deaths of persons, the persons directly responsible for such an accident shall be investigated for criminal responsibility according to law. 第四十三条 在汛情紧急的情况下，各级防汛指挥机构可以在其管辖范围内，根据经批准的分洪、滞洪方案，采取分洪、滞洪措施。采取分洪、滞洪措施对毗邻地区有危害的，必须报经上一级防汛指挥机构批准，并事先通知有关地区。 Article 43. In case of a flood emergency, flood prevention headquarters at different levels may, within their jurisdiction, take measures to divert or detain the flood pursuant to the approved plans. Where these measures are detrimental to the adjoining districts, the adoption of such measures must be reported to the flood prevention headquarters at the next higher level for approval, and the districts concerned shall be notified in advance. 第四十四条 对危险废物的容器和包装物以及收集、贮存、运输、处置危险废物的设施、场所，必须设置危险废物识别标志。 Article 44 A distinguishing mark of hazardous waste must be put on the containers and packages of hazardous waste as well as on the installations and sites for collection, storage, transportation and treatment of hazardous waste. 第四十四条 违反本法第十七条第三款规定，有关建设单位不进行地震安全性评价的，或者不按照根据地震安全性评价结果确定的抗震设防要求进行抗震设防的，由国务院地震行政主管部门或者县级以上地方人民政府负责管理地震工作的部门或者机构，责令改正，处一万元以上十万元以下的罚款。 Article 44 Any construction unit that, in violation of the provisions in paragraph 3 of Article 17 of this Law, fails to conduct seismic safety evaluation or provide fortification against earthquakes in compliance with the requirements for such fortification, which are drawn up on the basis of the results of seismic safety evaluation, shall be ordered by the competent administrative department for seismic work under the State Council or the administrative department or institution for seismic work under the local people's government at or above the county level to set it right and be fined not less than 10,000 yuan but not more than 100,000 yuan.第四十四条 城市饮食服务业的经营者，必须采取措施，防治油烟对附近居民的居住环境造成污染。 Article 44 Business-operators in the catering services industry in urban areas must adopt measures to prevent and control the pollution caused by lampblack to the residential environment in the neighborhood. 第四十四条煤矿企业必须为煤矿井下作业职工办理意外伤害保险，支付保险费。 Article 44 Coal mining enterprises must provide accidental injury insurance for miners working underground and pay premiums.第四十四条在汛期，水库、闸坝和其他水工程设施的运用，必须服从有关的防汛指挥机构的调度指挥和监督。 Article 44 During the flood reason, the use of reservoirs, sluices, dams and other water engineering structures must be subjected to the command, control and supervision of the relevant flood control headquarters.第四十四条 预备役军官参加军事训练、执行军事勤务期间，其工作单位是国家机关、社会团体、企业事业单位的，由其所在单位照发工资和奖金，其享受的福利待遇不变。 Article 44 During the period when reserve officers working in State organs, public organizations, enterprises or institutions are participating in military training or carrying out military duties, their wages and bonuses shall be paid in full by their work units, and the benefits and treatment they are entitled to shall not be affected.??? 第四十四条? 违反本法规定，采取破坏性的开采方法开采矿产资源的，处以罚款，可以吊销采矿许可证；造成矿产资源严重破坏的，依照刑法第一百五十六条的规定对直接责任人追究刑事责任。? Article 44 If a person, in violation of the provisions of this Law, mines mineral resources in a destructive way, he shall be fined and his mining license may be revoked; if serious damage is caused to the mineral resources, the person who are directly responsible shall be investigated for criminal responsibility in accordance with the provisions of Article 156 of the Criminal Law. 第四十四条 违反本法规定，进行开垦、采石、采砂、采土、采种、采脂和其他活动，致使森林、林木受到毁坏的，依法赔偿损失； Article 44 In case that land reclamation, rock quarrying, sand quarrying, soil extracting, seed collecting, resin tapping and other activities are conducted in violation of the provisions of this law, as a result of which the forests and trees are damaged, the compensation in damages shall be paid;第四十四条 禁止在商业经营活动中使用高音广播喇叭或者采用其他发出高噪声的方法招揽顾客。 Article 44 In commercial activities high-pitch loudspeakers and other loud-noise instruments are forbidden to be used for attracting customers.第四十四条已经投入生产的矿山企业，不具备安全生产条件而强行开采的，由劳动行政主管部门会同管理矿山企业的主管部门责令限期改进；逾期仍不具备安全生产条件的，由劳动行政主管部门提请县级以上人民政府决定责令停产整顿或者由有关主管部门吊销其采矿许可证和营业执照。 Article 44 Where a mining enterprise already put into operation but without the due conditions for safe production insists on forced exploitation, it shall be ordered by the competent authorities of labour administration in conjunction with the authorities in charge of mining enterprises to make improvement within a fixed period of time; with respect to the mining enterprise that still fails to meet the conditions for safe production upon expiration of the period, the matter shall be submitted by the competent department of labour administration to the relevant people's government at or above the county level for a decision on the suspension of production for the purpose of readjustment or on the rescission of its mining permit and business license by the competent authorities.第四十四条 违反本法第二十五条规定，生产、销售国家明令淘汰的用能产品的，由县级以上人民政府管理产品质量监督工作的部门责令停止生产、销售国家明令淘汰的用能产品，没收违法生产、销售的国家明令淘汰的用能产品和违法所得，并处违法所得一倍以上五倍以下的罚款；可以由县级以上人民政府工商行政管理部门吊销营业执照。 Article 44 Where an enterprise that, in violation of the provisions of Article 25 of this Law, produces or sells energy-using products which the State has eliminated by official order, the administrative department for supervision over product quality of the people's government at or above the county level shall order that it stop producing or selling such products, confiscate such products and the illegal gains therefrom and impose a fine of not less than one time but not more than five times the illegal gains; and the administrative department for industry and commerce of the people's government at or above the county level may revoke its business license.第四十四条 中华人民共和国缔结或者参加的有关气象活动的国际条约与本法有不同规定的，适用该国际条约的规定；但是，中华人民共和国声明保留的条款除外。 Article 44 Where differences in provisions are found between an international treaty on meteorological activities concluded or acceded to by the People's Republic of China and this Law, the provisions contained in the international treaty shall prevail, with the exception of the clauses on which the People's Republic of China has expressed reservations.第四十四条兴建地下工程设施或者进行地下勘探、采矿等活动，应当采取防护性措施，防止地下水污染。 Article 44 While constructing underground engineering facilities or carrying out underground prospecting, mining and other underground activities, protective measures shall be taken to prevent ground water pollution. 第四十四条 凡违反本法污染损害海洋环境，造成公私财产重大损失或者致人伤亡的，对直接责任人员可以由司法机关依法追究刑事责任。 Article 44. In cases where violations of this Law result in pollution damage to the marine environment and cause heavy losses to public or private property or deaths or injuries to persons, those who are directly responsible may be prosecuted for criminal responsibility by judicial organs in accordance with the law.????第四十四条??违反本法规定，造成土地、森林、草原、水、矿产、渔业、野生动植物等资源的破坏的，依照有关法律的规定承担法律责任。 Article 44. Whoever, in violation of this Law, causes damage to natural resources like land, forests, grasslands, water, minerals, fish, wild animals and wild plants shall bear legal liability in accordance with the provisions of relevant laws. 第四十四条 违反本法规定取水、截水、阻水、排水，给他人造成妨碍或者损失的，应当停止侵害，排除妨碍，赔偿损失。 Article 44. Whoever, in violation of this Law, draws, intercepts, blocks or discharges water and thereby causes obstruction or losses to others shall stop his acts of infringement, remove the obstruction and compensate for the losses. 第四十五条煤矿企业使用的设备、器材、火工产品和安全仪器，必须符合国家标准或者行业标准。 Article 45 All equipment, facilities, explosives and safety instruments used by coal mining enterprises must meet the national or trade standards.第四十五条 禁止任何单位、个人在城市市区噪声敏感建设物集中区域内使用高音广播喇叭。 Article 45 All units and individuals are forbidden to use high-pitch loudspeakers in urban areas where noise-sensitive structures are concentrated. 第四十五条 违反本法规定，有下列行为之一的，由县级以上人民政府建设行政主管部门或者其他有关专业主管部门按照职责权限责令改正，处一万元以上十万元以下的罚款： Article 45 Any unit that, in violation of the provisions of this Law, commits one of the following acts shall be ordered by the administrative department for construction or a department concerned under the people's government at or above the county level, within the limits of its powers and duties, to set it right and be fined not less than 10,000 yuan but not more than 100,000 yuan:
