????第四十六条??中华人民共和国缔结或者参加的与环境保护有关的国际条约，同中华人民共和国法律有不同规定的，适用国际条约的规定，但中华人民共和国声明保留的条款除外。 Article 46. If an international treaty regarding environmental protection concluded or acceded to by the People's Republic of China contains provisions differing from those contained in the laws of the People's Republic of China, the provisions of the international treaty shall apply, unless the provisions are ones on which the People's Republic of China has announced reservations. 第四十六条 现行的有关海洋环境保护的规定，凡与本法抵触的，均以本法为准。 Article 46. Where existing provisions concerning marine environmental protection contradict this Law, this Law shall prevail. 第四十六条 违反本法规定，有下列行为之一的，由县级以上地方人民政府水行政主管部门或者有关主管部门责令其停止违法行为，采取补救措施，可以并处罚款；对有关责任人员可以由其所在单位或者上级主管机关给予行政处分；构成犯罪的，依照刑法规定追究刑事责任： Article 46. Whoever, in violation of this Law, commits any of the following acts shall be ordered, by the department of water administration or another competent department concerned of the relevant local people's government at or above the county level, to stop his illegal act and take remedial measures and may be concurrently fined; the person who is responsible may be given administrative sanctions by the unit to which he belongs or by the competent authority at a higher level and, where a crime is constituted, he shall be prosecuted for criminal responsibility in accordance with the Criminal Law:第四十七条发生洪涝灾害后，有关人民政府应当组织有关部门、单位做好灾区的生活供给、卫生防疫、救灾物资供应、治安管理、学校复课、恢复生产和重建家园等救灾工作以及所管辖地区的各项水毁工程设施修复工作。 Article 47 After the occurrence of flood and waterlogging，the relevant people's government should organize the relevant departments and units to ensure the relief work in the disaster area in respect of supply of necessities health care and immunity，supply of relief materials，public security，resumption of classes，resumption of production and rebuilding of homes as well as repairing of various engineering structures destroyed in floodwater within its jurisdiction.第四十七条矿山企业主管人员对矿山事故隐患不采取措施，因而发生重大伤亡事故的，比照刑法第一百八十七条的规定追究刑事责任。 Article 47 Any responsible person who fails to take measures with respect to hidden dangers of accidents in a mine, thereby causing accidents involving serious causalities, shall be investigated for criminal responsibilities by applying mutatis mutandis the provisions of Article 187 of the Criminal Law. 第四十七条 国家工作人员在防震减灾工作中滥用职权，玩忽职守，徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，给予行政处分。 Article 47 Any State functionary who abuses his power, neglects his duty or commits malpractices for selfish ends, if the offence constitutes a crime, shall be investigated for criminal liability in accordance with law; otherwise, he shall be given administrative sanctions.第四十七条违反本法第十三条第三款规定，建设项目的水污染防治设施没有建成或者没有达到国家规定的要求，即投入生产或者使用的，由批准该建设项目的环境影响报告书的环境保护部门责令停止生产或者使用，可以并处罚款。 Article 47 If any unit, in violation of the provisions of the third paragraph of Article 13 of this Law, puts into production or to use a construction project for which the construction of facilities for prevention and control of water pollution has not been completed or whose facilities for prevention and control of water pollution fail to meet the requirements laid down by the State, the environmental protection department that approved the environmental impact statement of the said project shall order the unit to suspend production or use, and may also impose a fine on it.第四十七条 预备役军官达到平时服预备役最高年龄时，应当退出预备役。 Article 47 Reserve officers shall be retired from reserve service when they have attained the maximum age for reserve service in peacetime.??? 第四十七条? 负责矿产资源勘查、开采监督管理工作的国家工作人员和其他有关国家工作人员徇私舞弊、滥用职权或者玩忽职守，违反本法规定批准勘查、开采矿产资源和颁发勘查许可证、采矿许可证，或者对违法采矿行为不依法予以制止、处罚、构成犯罪的，依法追究刑事责任；不构成犯罪的，给予行政处分。违法颁发的勘查许可证、采矿许可证，上级人民政府地质矿产主管部门有权予以撤销。? Article 47 State functionaries in charge of supervision and administration of exploration and mining of mineral resources or other relevant State functionaries who commit malpractices for personal gain, abuse their power or neglect their duties, approve exploration and mining of mineral resources or issue exploration or mining licenses, in violation of this Law, or does not stop illegal mining activities and punish illegal miners, which constitutes a crime, shall be investigated for criminal responsibility; if their acts do not constitute a crime, administrative penalties shall be given. The department in charge of geology and mineral resources under the people's government at a higher level shall have the authority to revoke the exploration and mining licenses illegally issued. 第四十七条 国务院林业主管部门根据本法制定实施办法，报国务院批准施行。 Article 47 The competent forestry authorities under the State Council shall, according to this law, formulate the implementing methods, which shall be implemented after submission to and approval of the State Council. 第四十七条设立煤炭经营企业，应当具备下列条件： Article 47 To establish a coal trading enterprise, the following requirements shall be met: 第四十七条 城市人民政府应当组织建设对危险废物进行集中处置的设施。 Article 47 Urban people's governments shall arrange for the construction of installations for centralized treatment of hazardous waste. 第四十七条 违反本法第二十六条规定，未在产品说明书和产品标识上注明能耗指标的，由县级以上人民政府管理产品质量监督工作的部门责令限期改正，可以处5万元以下的罚款。 Article 47 Where a unit or individual, in violation of the provisions of Article 26 of this Law, fails to clearly indicate the norm for energy consumption in its or his product specifications or labels, the administrative department for supervision over product quality of the people's government at or above the county level shall order that it or he make amends within a time limit and may impose a fine of not more than 50,000 yuan.第四十七条 违反本法第十一条规定，建设项目的大气污染防治设施没有建成或者没有达到国家有关建设项目环境保护管理的规定的要求，投入生产或者使用的，由审批该建设项目的环境影响报告书的环境保护行政主管部门责令停止生产或者使用，可以并处一万元以上十万元以下罚款。 Article 47 Where the provisions of Article 11 of this Law is violated and a construction project is put into operation or to use in circumstances where its facilities for the prevention and control of atmospheric pollution either have not been completed or have not met the requirements specified in the state provisions concerning environmental protection for such a construction project, the administrative department of environmental protection responsible for the examination and approval of the environmental impact statement on the construction project shall order the suspension of its operations or use and may concurrently impose a fine of not less than 10,000 yuan but not more than 100,000 yuan.第四十七条 在已竣工交付使用的住宅楼进行室内装修活动，应当限制作业时间，并采取其他有效措施，以减轻、避免对周围居民造成环境噪声污染。 Article 47 Whoever makes indoor decoration and refitting in a residential building that is already completed and delivered for use shall do so in restricted hours and take other effective measures to mitigate or avoid producing environmental noise pollution to the neighbours. 第四十七条 国务院环境保护部门可根据本法制订实施细则，报国务院批准施行。 Article 47. The environmental protection department under the State Council may, in accordance with this Law, formulate rules for its implementation, which shall be put into effect after being submitted to and approved by the State Council.????第四十七条??本法自公布之日起施行。《中华人民共和国环境保护法（试行）》同时废止 Article 47. This Law shall enter into force on the date of promulgation. The Environmental Protection Law of the People's Republic of China (for Trial Implementation) shall be abrogated therefrom. 第四十七条 违反本法规定，有下列行为之一的，由县级以上地方人民政府水行政主管部门或者有关主管部门责令其停止违法行为，赔偿损失，采取补救措施，可以并处罚款；应当给予治安管理处罚的，依照治安管理处罚条例的规定处罚；构成犯罪的，依照刑法规定追究刑事责任： Article 47. Whoever, in violation of this Law, commits any of the following acts shall be ordered, by the department of water administration or another competent department concerned of the relevant local people's government at or above the county level, to stop his illegal act, compensate for the losses caused and take remedial measures, and may be concurrently fined; where a penalty for violation of public security should be given, the person shall be given a penalty in accordance with the Regulations on Administrative Penalties for Public Security; where a crime is constituted, the person shall be prosecuted for criminal responsibility in accordance with the Criminal Law:第四十八条 违反本法第十四条的规定，建设项目中需要配套建设的环境噪声污染防治设施没有建成或者没有达到国家规定的要求，擅自投入生产或者使用的，由批准该建设项目的环境影响报告书的环境保护行政主管部门责令停止生产或者使用，可以并处罚款。 Article 48 Anyone who, in violation of the provisions of Article 14 of this Law, puts into production or use a construction project before the necessary facilities for prevention and control of environmental noise pollution have been completed or meet the requirements laid down by the State, shall be ordered to stop production or use and may also be fined by the competent administrative department for environmental protection that originally approved the environmental impact statement regarding this construction project. 第四十八条设立煤炭经营企业，须向国务院指定的部门或者省、自治区、直辖市人民政府指定的部门提出申请；由国务院指定的部门或者省、自治区、直辖市人民政府指定的部门依照本法第四十七条规定的条件和国务院规定的分级管理的权限进行资格审查；符合条件的，予以批准。 Article 48 For establishment of a coal trading enterprise, an application must be submitted to the department designated by the State Council or by the people's government of a province, autonomous region or municipality directly under the Central Government, which shall conduct qualification examination in accordance with the provisions of Article 47 of this Law and within the limits of its power, as authorized by the State Council to different levels of administration and grant the application if the requirements are met.第四十八条违反本法第十四条第二款规定，排污单位故意不正常使用水污染物处理设施，或者未经环境保护部门批准，擅自拆除、闲置水污染物处理设施，排放污染物超过规定标准的，由县级以上地方人民政府环境保护部门责令恢复正常使用或者限期重新安装使用，并处罚款。 Article 48 If any pollutant discharging unit, in violation of the provisions of the second paragraph of Article 14 of this Law, intentionally does not use the water pollutant treatment facilities in a normal manner, or dismantles or lays idle such facilities without approval of the environmental protection department and thus discharges pollutants in excess of the standards, the environmental protection department of the local people's government at or above the county level shall order the unit to restore the normal use or to re-install and use the facilities within a time limit, and may also impose a fine on it.??? 第四十八条? 以暴力、威胁方法阻碍从事矿产资源勘查、开采监督管理工作的国家工作人员依法执行职务的，依照刑法第一百五十七条的规定追究刑事责任；拒绝、阻碍从事矿产资源勘查开采监督管理工作的国家工作人员依法执行职务未使用暴力、威胁方法的，由公安机关依照治安管理处罚条例的规定处罚。? Article 48 If anyone resorts to violence or intimidation when obstructing State functionaries engaged in supervision and administration of exploration and mining of mineral resources from performing their duties according to law, he shall be investigated for criminal responsibility in accordance with the provisions of Article 157 of the Criminal Law. If he does not resort to violence or intimidation when obstructing State functionaries engaged in supervision and administration of exploration and mining of mineral resources from performing their duties according to law, he shall be punished in accordance with relevant provisions of the Regulations on Administrative Penalties for Public Security. 第四十八条 民族自治地方不能全部适用本法规定的，自治机关可以根据本法的原则，结合民族自治地方的特点，制定变通或者补充规定，依照法定程序报省、自治区或者全国人民代表大会常务委员会批准施行。 Article 48 If the provisions of this law cannot be fully applicable to ethnic minority autonomous regions, the autonomy authorities may, in line with the principles of this law and based upon the characteristics of ethnic minority autonomous regions, formulate contingent or supplementary provisions, which shall be implemented after submission to and approval of the provincial or autonomous government or the Standing Committee of the National People's Congress in conformity with legal procedures. 第四十八条 以填埋方式处置危险废物不符合国务院环境保护行政主管部门的规定的，应当缴纳危险废物排污费。 Article 48 In disposing of hazardous waste by the land-fill method, the unit that failed to comply with the regulations of the competent administrative department of environmental protection under the State Council shall pay fees for discharge of hazardous waste.第四十八条各级人民政府应当采取措施，提高防洪投入的总体水平。 Article 48 People's governments at all levels should take measures to improve the overall level of flood control allocations．
