第四十条 县级以上人民政府应当根据流域规划和确保重点兼顾一般的原则，制定防御洪水方案，确定防洪标准和措施。全国主要江河的防御洪水方案，由中央防汛指挥机构制定，报国务院批准。 Article 40. The schemes for the prevention of floods along major rivers throughout the country shall be formulated by the Central Flood Prevention Headquarters and submitted to the State Council for approval. 第四十条 获准倾倒废弃物的单位，应当详细记录倾倒的情况，并在倾倒后向批准部门作出书面报告。倾倒废弃物的船舶须向驶出港的港务监督作出书面报告。 Article 40. Units that have obtained permits for dumping wastes shall make a detailed record of such operations and present a written report to the approving department thereafter. The work units of reserve officers and the departments concerned of the local people's governments shall provide assistance in this connection. 第四十一条在煤矿井下作业中，出现危及职工生命安全并无法排除的紧急情况时，作业现场负责人或者安全管理人员应当立即组织职工撤离危险现场，并及时报告有关方面负责人。 Article 41 When an irresistible emergency occurs which may endanger the lives and safety of the miners who are working underground in coal mines, the person in charge on the spot or other persons in charge of safety shall immediately help the miners to leave the dangerous site and report the matter to the leading members concerned without delay.????第四十一条??造成环境污染危害的，有责任排除危害，并对直接受到损害的单位或者个人赔偿损失。 Article 41. A unit that has caused an environmental pollution hazard shall have the obligation to eliminate it and make compensation to the unit or individual that suffered direct losses. 第四十一条 在防洪河道和滞洪区、蓄洪区内，土地利用和各项建设必须符合防洪的要求。 Article 41. Along floodways and in flood detention basins and flood storage basins, the utilization of land and the various construction projects must meet the requirements for the prevention of floods. 第四十一条 凡违反本法，造成或者可能造成海洋环境污染损害的，本法第五条规定的有关主管部门可以责令限期治理，缴纳排污费，支付消除污染费用，赔偿国家损失；并可以给予警告或者罚款。当事人不服的，可以在收到决定书之日起十五日内，向人民法院起诉；期满不起诉又不履行的，由有关主管部门申请人民法院强制执行。 Article 41. In the case of a violation of this Law that has caused or is likely to cause pollution damage to the marine environment, the competent authorities prescribed in Article 5 of this Law may order the violator to remedy the pollution damage within a definite time, pay a pollutant discharge fee, pay the cost for eliminating the pollution and compensate for the losses sustained by the state; they may also give the violator a warning or impose a fine. An involved party contesting the decision may file a suit in a people's court within 15 days after it has received the written decision. If a suit has not been filed and the decision has not been carried out upon the expiration of that period, the competent authorities shall request the people's court to enforce the decision in accordance with the law.第四十二条 在城市市区噪声敏感建筑物集中区域内，因商业经营活动中使用固定设备造成环境噪声污染的商业企业，必须按照国务院环境保护行政主管部门的规定，向所在地的县级以上地方人民政府环境保护行政主管部门申报拥有的造成环境噪声污染的设备的状况和防治环境噪声污染的设施的情况。 Article 42 A commercial enterprise that, in an urban area where noise-sensitive structures are concentrated, produce environmental noise pollution as the result of its use of permanent equipment in the course of commercial activities must, in accordance with the regulations of the competent administrative department for environmental protection under the State Council, report to the competent administrative department for environmental protection of the local people's government at or above the county level the condition of the equipment that produces environmental noise pollution and provide information about the facilities for prevention and control of such pollution.第四十二条在无良好隔渗地层，禁止企业事业单位使用无防止渗漏措施的沟渠、坑塘等输送或者存贮含有毒污染物的废水、含病原体的污水和其他废弃物。 Article 42 At places where no satisfactory impervious strata exist, enterprises and institutions shall be forbidden to use ditches, pits or ponds devoid of safeguards against seepage for conveyance or storage of waste water containing toxic pollutants or pathogens, or of other wastes.??? 第四十二条? 买卖、出租或者以其他形式转让矿产资源的，没收违法所得，予以罚款。? Article 42 If a person purchases, sells or leases mineral resources or transfers them by other means, his unlawful proceeds shall be confiscated and he shall be fined. 第四十二条 违反本法规定，买卖林木采伐许可证、木材运输证件、批准出口文件、允许进出口证明书的，由林业主管部门没收违法买卖的证件、文件和违法所得，并处违法买卖证件、文件的价款一倍以上三倍以下的罚款；构成犯罪的，依法追究刑事责任。 Article 42 In case that the tree cutting license, timber transport documentation, export approval documentation and import and export permit certificate are traded in violation of the provisions of this law, the competent forestry authorities shall confiscate the unlawfully traded certificates and documentation and illegal income, and impose a fine amounting to between one time and three times the payment for the unlawfully traded certificates and documentation; if a criminal offense is committed, the legal responsibilities shall be investigated and dealt with.
