第二十七条 本办法所称“生产性废旧金属”，是指用于建筑、铁路、通讯、电力、水利、油田、市政设施及其他生产领域，已失去原有全部或部分使用价值的金属材料和金属制品。 Article 27 The term ""producing waste metal"" as mentioned in these Measures refers to metal materials and metals products that are used in construction, railway, communication, electric power, water conservancy, oil field, public utilities and other fields, and now lose all or part of use value. 第二十七条 国有企业事业单位、机关、团体、部队营造的林木，由营造单位经营并按照国家规定支配林木收益。 Article 27 The trees planted by state-owned enterprises, institutions, government authorities, mass organizations and troops shall be operated by the forestation organizations and the yields from trees shall be disposed by them in accordance with the provisions of the State. 第二十七条 生产用能产品的单位和个人，不得使用伪造的节能质量认证标志或者冒用节能质量认证标志。 Article 27 Units and individuals that manufacture energy-using products may not use labels bearing forged certificates for the quality of their energy-conserving products or labels bearing the certificates for the quality of another's energy-conserving products.第二十七条 向境外输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，违反国家保密规定的，依照《中华人民共和国保守国家秘密法》的有关规定追究法律责任。 Article 27 Where any entity exporting or researching and utilizing livestock or poultry genetic resource included in the protection list within China in cooperation with any foreign institution or individual violates secrecy provisions of the state, legal responsibilities shall be investigated in accordance with relevant provisions in Law of the People’s Republic of China on Guarding State Secrets.第二十七条 根据《中华人民共和国大气污染防治法》第三十三条第一款规定，对经限期治理逾期未完成治理任务的企业事业单位，可处以一万元以上十万元以下罚款。 Article 27. A penalty of between ten thousand yuan and one hundred thousand yuan and one hundred thousand yuan may be meted out to enterprises and institutions which have been ordered to tackle with their pollution problems by a set time but failed to do so, in accordance with the provisions under Section One of Article 33 of ""Law on the prevention of Air pollution of the People's Republic of China"". 第二十七条 １５０总吨以上的油轮和４００总吨以上的非油轮，应当设有相应的防污设备和器材。 Article 27. Protection shall be provided to rare aquatic animals whose capture is banned by the state. In case there is a special need to catch them, the matter shall be handled in accordance with the relevant laws and regulations. 第二十七条 禁止围湖造田。禁止围垦河流，确需围垦的，必须经过科学论证，并经省级以上人民政府批准。 Article 27. Reclaiming parts of a lake for use as farmland shall be prohibied. Reclaiming parts of a river for use as farmland shall also be prohibited. Where reclamation is necessary, a scientific justification must be provided and approval obtained from a people's government at or above the provincial level. 第二十八条 破坏性地震应急预案主要包括下列内容： Article 28 An emergency preplan for a destructive earthquake mainly includes the following:第二十八条因猎捕野生动物造成农作物或者其他损失的，由猎捕者负责赔偿。 Article 28 Anyone who has caused losses to crops or other losses while hunting or catching wildlife shall be held responsible for compensation.第二十八条 各级气象主管机构应当组织对重大灾害性天气的跨地区、跨部门的联合监测、预报工作，及时提出气象灾害防御措施，并对重大气象灾害作出评估，为本级人民政府组织防御气象灾害提供决策依据。 Article 28 Competent meteorological departments at all levels shall make arrangements for joint monitoring and forecast of significant weather events among regions or departments, propose timely measures for preventing meteorological disasters and make assessment of severe weather disasters, which shall serve as the decision making basis for the people's governments at the corresponding levels to arrange prevention of meteorological disasters.第二十八条 企业应当对生产和服务过程中的资源消耗以及废物的产生情况进行监测，并根据需要对生产和服务实施清洁生产审核。 Article 28 Enterprises shall monitor resource consumption and generation of wastes during the course of production and provision of services, and conduct cleaner production audits with respect to production and service procedures according to need.第二十八条排污单位发生事故或者其他突然性事件，排放污染物超过正常排放量，造成或者可能造成水污染事故的，必须立即采取应急措施，通报可能受到水污染危害和损害的单位，并向当地环境保护部门报告。 Article 28 If a pollutant discharging unit, as a result of an accident or other exigency, discharges pollutants in excess of normal quantities and thus causes or may possibly cause a water pollution accident, it shall immediately take emergency measures, inform such units as are likely to be endangered or damaged by the water pollution and report the matter to the local environmental protection department.第二十八条 重点用能单位应当按照国家有关规定定期报送能源利用状况报告。能源利用状况包括能源消费情况、用能效率和节能效益分析、节能措施等内容。 Article 28 Key energy-using units shall, in accordance with the relevant regulations of the State, regularly submit reports on their utilization of energy. These reports shall include information on energy consumption, energy efficiency, analysis of the benefits derived from energy conservation and the measures taken for energy conservation.第二十八条矿山企业必须向职工发放保障安全生产所需的劳动防护用品。 Article 28 Mining enterprises must distribute to their workers and staff labour protective gadgets necessary for guaranteeing safe production.??? 第二十八条? 矿床勘探报告及其他有价值的勘查资料，按照国务院规定实行有偿使用。? Article 28 Prospecting reports on mineral deposits and other valuable exploration data shall be provided for use with compensation in accordance with the regulations of the State Council.第二十八条 在城市市区范围内向周围生活环境排放建筑施工噪声的，应当符合国家规定的建筑施工场界环境噪声排放标准。 Article 28 The construction noise emitted to the living environment of the neighbourhood within an urban area shall be kept within the limits set by the State on the emission of environmental noise within the boundary of a construction site.第二十八条 本办法自2008年10月1日起施行。 Article 28 The Measures shall enter into force as of October 1, 2008.第二十八条在水土流失地区建设的水土保持设施和种植的林草，由县级以上人民政府组织有关部门检查验收。 Article 28 The people's governments at or above the county level shall organize departments concerned to inspect for acceptance the water and soil conservation facilities bui1t and the trees and grass planted in soil-eroded regions. 第二十八条 县级以上人民政府有关部门应当制定工业固体废物污染环境防治工作规划，推广能够减少工业固体废物产生量的先进生产工艺和设备，推动工业固体废物污染环境防治工作。 Article 28 The relevant departments of the people's governments at or above the county level shall formulate a program for the prevention and control of environmental pollution by industrial solid waste, disseminate the advanced production techniques and equipment which can reduce the discharge of industrial solid waste, and promote the prevention and control of environmental pollution by industrial solid waste. 第二十八条对国民经济具有重要价值的特殊煤种或者稀缺煤种，国家实行保护性开采。 Article 28 The State shall ensure protective mining for the special or rare types of coal which are of important value to the national economy.第二十八条对于河道、湖泊管理范围内依照本法规定建设的工程设施，水行政主管部门有权依法检查； Article 28 The water conservancy administrative department shall have the right to inspect engineering structures constructed according to the provisions of this Law within the scope of control for river courses or lakes. When the water conservancy administrative department exercises inspect ion, the inspected should truthfully provide the information and materials concerned.第二十八条 本办法由商务部、发展改革委、公安部、工商总局、环保总局、建设部负责解释。 Article 28 These Measures are subject to the interpretation of Ministry of Commerce, National Development and Reform Commission, Ministry of Public Security, State Administration for Industry and Commerce, State Environmental Protection Administration and Ministry of Construction.第二十八条 城市建设应当统筹规划，在燃煤供热地区，统一解决热源，发展集中供热。 Article 28 Urban construction shall be conducted on the basis of over-all planning. In areas with coal heating, unified provision of heat sources shall be practiced and central heating system shall be developed.
